FSAR 4G52.222-701 Employment of Eligible Workers (DEC 1999)
Section 274A of the Immigration and Nationality Act (8 USC 1324a) makes it unlawful for an employer to hire undocumented workers. The Immigration and Naturalization Service (INS) has established the Form I-9, Employment Eligibility Verification Form, as the document to be used for employment eligibility verification (see 8 CFR 274a).
The contractor is required to (1) have all employees complete and sign the I-9 Form to certify that they are eligible for employment; (2) examine documents presented by the employee and ensure the documents appear to be genuine and related to the individual; (3) record information about the documents on the form, and complete the certification portion of the form; (4) retain the form for three years, or one year past the end of employment of the individual, whichever is longer.
It is illegal to discriminate against any individual (other than a citizen of another country who is not authorized to work in the United States) in hiring, discharging, or recruiting because of that individual's national origin or citizenship status.
Compliance with Section 274A of the Immigration and Nationality Act (8 U.S.C. 1324a) is a material condition of the contract. If the contractor employs unauthorized workers during contract performance in violation of section 274A, the Government may terminate the contract, in addition to other remedies or penalties prescribed by law.
For further information on the requirements of the Act, contractors should contact the Employer and Labor Relations Officer of their local INS office.

ADDENDA to 52.212-2 EVALUATION –COMMERCIAL ITEMS (JAN 1999)
(a) General
In accordance with FAR Subpart 9.1, award of a contract resulting from this solicitation will be subject to the CO’s determination that the offeror meets the following minimum standards for performing the required work:
1. Has adequate financial resources and financial accounting systems;
1. Is able to meet the required delivery or performance dates;
1. Has sufficient technical ability, capacity and capability to perform;
1. Has a satisfactory performance record, including performance on other task orders resulting from this contract;
1. Is otherwise qualified and eligible to receive an award under applicable laws and regulations.
(b) BASIS FOR CONTRACT AWARD: The basis for award will be an integrated assessment based on tradeoff between past performance and price. The Government will award the contract to the offeror who represents the best value to the Government in terms of past performance and price.
1. PRICE:
(1) Completeness: The proposal covers all requirements of the specifications (Attachment 1), includes all pricing information required by the solicitation, and the Schedule of items is completed as required. Offeror must provide pricing for all items listed on the schedule of items.
(2) Reasonableness: Prices are reasonable in comparison to estimates, prior prices paid, competition, historical and projected inflation and can be supported by suitable estimating techniques.
(3) Realism: The government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between the line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated, as indicated by the application of cost or price analysis techniques. (For instance, the price variance between gas tiers is not realistic considering the price increase in gas for the task/item indicated or there is an inconsistent application of inflation rates and price increases between fuel tiers/line items for any base and option year and/or between a base and option year.) The burden of proof of realism rests solely with the offeror. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the government.
(4) Contract Award Amount: The estimated quantities are shown for evaluation purposes only. The estimated quantities are a good faith estimate on the part of the Government. The total contract award amount will be not to exceed $5 million over the life of the contract.
2. PAST PERFORMANCE: Past performance assessments shall be accomplished for all. Each offeror shall be assigned one of the following ratings:
RATING
DEFINITION
Exceptional/High Confidence
Based on the offeror’s performance record, essentially no doubt exists that the offeror will successfully perform the required effort.
Very Good/Significant Confidence
Based on the offeror’s performance record, little doubt exists that the offeror will successfully perform the required effort.
Satisfactory/Confidence
Based on the offeror’s performance record, some doubt exists that the offeror will successfully perform the required effort.
Neutral/Unknown Confidence
No performance record identifiable (see FAR 15.305(a)(2) (iii) and (iv)).
Marginal/Little Confidence
Based on the offeror’s performance record, substantial doubt exists that the offeror will successfully perform the required effort. Changes to the offeror’s existing processes may be necessary in order to achieve contract requirements.
Unsatisfactory/No Confidence
Based on the offeror’s performance record, extreme doubt exists that the offeror will successfully perform the required effort.
(1) A number of past performance references provided by offerors will be selected and investigated. Any derogatory past performance information obtained will be presented to the affected offeror and that offeror will have an opportunity to respond with any mitigating facts. The final determination of past performance ratings shall rest with the contracting officer.
(2) An offeror with limited or no recent or relevant past performance will receive a rating of Neutral/Unknown Confidence, and will not be rated favorably or unfavorably on past performance.
(3) Past performance shall be evaluated on the basis of the following subfactors of equal importance:
i. Contract performance in projects of the same size and scope
ii. Quality of service
iii. Timeliness of Performance
3. Experience / Past Performance is slightly more important than price.
4. The Government reserves the right to award the contract to other than the lowest priced offeror.
(c) AWARD WITHOUT DISCUSSIONS. The Contracting Officer will only clarify the offerors’ information; no discussions are contemplated in accordance with FAR 15.306. Offerors may be given the opportunity to clarify relevance or adverse past performance to which the offeror has not previously had an opportunity to respond. Clarifications are limited exchanges between the Government and offerors that may occur when award without discussions is contemplated. If discussions are determined to be necessary the procedures described in FAR 15.306 will be used.
(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212-3 -- Offeror Representations and Certifications -- Commercial Items. (NOV 2013) An offeror shall complete only paragraphs (b) of this provision if the offeror has completed the annual representations and certificates electronically via http://www.acquisition.gov .
