CONTRACT TIME: The contract time for the completion of this project shall be 230 calendar days.
PAYMENT: Partial payments may be paid for work completed as recommended by the Contracting Officer’s Representative.
PERFORMANCE: Performance of the contract shall begin within 14 calendar days after the effective date of the Notice to Proceed, prosecute the work diligently, and complete the entire work ready for use within 230 calendar days.

Site Visit
(a) Offerors are urged to inspect the site where the work will be performed. Contractors may do this on their own time using the area maps or:
(b) A site visit has been scheduled for March 3, 2010 at 9:00 AM. Meet at the Osceola National Forest District Office, 24874 US Highway 90, Olustee, FL 32072.

Project Summary: The work consist of performing mechanical fuel reduction on approximately 2115 acres and herbicide treatment on approximately 20 acres of National Forest Land. Fuel reduction is to be accomplished by severing vegetation and grinding downed vegetation with appropriate equipment in accordance with the Specifications/Statement of Work.

(d)(1) )The Comptroller General of the United States, an appropriate Inspector General appointed under section 3 or 8G of the Inspector General Act of 1978 (5 U.S.C. App.), or an authorized representative of either of the foregoing officials shall have access to and right to—
(i) Examine any of the Contractor’s or any subcontractors’ records that pertain to, and involve transactions relating to, this contract; and
(ii) Interview any officer or employee regarding such transactions.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settelement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), and (c), of this clause, the Contractor is not required to flow down any FAR clause in a subcontract for commercial items, other than—
(i) Paragraph (d) of this clause. This paragraph flows down to all subcontracts, except the authority of the Inspector General under paragraph (d)(1)(ii) does not flow down; and
(ii) Those clauses listed in this paragraph (e)(1). Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

FAR 52.212-2 Evaluation – Commercial Items (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
EXPERIENCE AND TECHNICAL CAPABILITY: Each offeror shall provide a written summary of the Firm’s and key personnel’s (past 3 years) experience in similar efforts outlined in the Specifications/Statement of Work. Offeror is required to submit information on the type of equipment that he/she plans to use and their experience using that equipment.
PAST PERFORMANCE: Each offeror shall provide the Company name, address, contact name and phone number of recent similar/relevant contracts performed (at least 3).
PRICE: Price should be entered on the Schedule of Items.
Experience, technical capability and past performance, when combined, are approximately equal to price
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

DIVISION 100 - GENERAL SPECIFICATIONS
110 GENERAL - This invitation is for the furnishing of equipment, materials, tools, labor, transportation, and supervision to mechanically mow using a rotary or drum cutter on 2095 acres for fuel reduction and, mechanically mowing using a rotary or drum cutter and application of herbicides on 20 acres of National Forest land in accordance with specifications and provisions of this contract. No materials, labor, or equipment will be furnished by the Government unless specifically identified in the Government-furnished Property Clause.
120 DESCRIPTION AND LOCATION – Area is within the boundaries of the Osceola National Forest, Columbia County, Florida. (See attached map).

130 - Information on the Areas –
Fuel Reduction: All mature stands are approximately 65 to 75 year old stands comprised of longleaf and slash pine with small wetlands imbedded within the stands. Immature stands are 22 to 44 years old. The area to be herbicided includes several invasive species that includes skunk vine that has created a dense 3-acre mat of vegetation climbing up into the tree canopy and on the remainder of the 20 acres are Chinese tallow tree (Sapium sebiferum), Chinaberry (Melia azedarach), camphor tree (Cinnamomum camphora), Chinese ligustrum (Ligustrum sinense), mimosa or silktree (Albizia jullibrissin), coral ardisia (Ardisia crenulata), and tung-oil tree (Aleurites fordii) all of which will be treated. Areas have been delineated on the ground using either flagging, natural boundaries, trails, or roads.
DIVISION 200 - TECHNICAL SPECIFICATIONS
210 – Equipment Requirements - All equipment proposed to accomplish the work shall be of proper type, sufficient size, operated at sufficient speed, and in such mechanical condition as to meet with the requirements of the work and produce a satisfactory quality of work. There must be at least two pieces of equipment on site that are equal to brand name machinery such as “Gyro-Trac”, “Kershaw Klear-Way”, or “ASV Positrack”. This equipment must have a front-mounted, heavy-duty mower with a rotary or drum cutting head capable of cutting trees up to an 8 inch diameter measured at ground level. Tractors and mowing equipment must be small enough to work between pines and avoid damaging pines larger than 5” dbh. All tractors must be equipped with protective canopies and fire extinguishers. The COR may order the removal and require replacement of any unsatisfactory equipment. In order to perform successfully in the dense, variable diameter vegetation in the time permitted Contractor is expected to mow an average of 14 acres per work day. Herbicide application will be conducted using backpack sprayers.
220 - Mowing –
All brush and small trees (other than pine trees) in areas to mow that are less than 8 inches in diameter (at base) will be mowed to a 2-4” stump except the following:
1. All longleaf pine saplings. Protect as many as possible from the mowing operation. Due to the density of the vegetation, some pines will be incidentally cut. The contractor’s work will be monitored closely to determine, if in the judgment of the inspector, longleaf pine saplings were cut by negligence or by accident. A penalty of $1.00 to $5.00 will be assessed the contractor for each pine tree cut carelessly or through negligence.
2. All snags larger than 6” dbh will be left standing.
3. All mature longleaf and slash pines. Protect all stems from the mowing operation. The contractor’s work will be monitored closely to determine, if in the judgment of the inspector, pine stems are cut or damaged by negligence or by accident. A penalty of $1.00 to $5.00 will be assessed the contractor for each pine tree stem cut or damaged carelessly or through negligence.
Herbicide treatment area
First herbicide treatment will be applied prior to mowing.
1. Two herbicide treatments are required. The first herbicide treatment will be implemented mid-April to May after leaf-out. The second retreatment of herbicide will be in late August or early September
2. The skunk vine will be treated by direct foliar treatment using a 1% Garlon 3A solution, not to exceed the application of more than 1.0 lb a.e./ac of triclopyr (as measured by the acid equivalent, or “a.e”, resulting from the application of the herbicide). The herbicide solution will be sprayed by backpack sprayers until the foliage appears wet but not to run-off. Before application, the vines will be cut where they extend upward into the overstory to prevent fruiting and seed dispersal in the upcoming growing season, and to keep herbicide spray at workers’ waist level or below during application.
3. For trees and saplings a 20% solution of Garlon 4 mixed in an vegetable oil diluent will be used to treat the bark of the tree around the tree trunk, not to exceed the application of more than 1 lb a.e./ac of active ingredient (triclopyr). Coral ardisia will be treated using a 5% direct foliar application to the point of run-off.

5. A dye will be added to these solutions to allow workers to identify treated vegetation. All vegetative material will be left on site until the first application is complete. Large trees greater than 10 inches dbh will be treated by basal bark treatment or cut-surface treatment. Larger diameter invasive trees will be treated and left to die in place.

7. All mowing equipment must be cleaned prior to moving off the herbicide treatment site to remove any seeds or spores from invasive species.
It is highly recommended that all prospective bidders examine the areas thoroughly before bidding. Work must be completed by SEPTEMBER 24.
DIVISION 300 – RESOURCE PROTECTION
310 - Erosion Control - The contractor's operation will be conducted so as to avoid unnecessary soil erosion. He will install and/or maintain drainage dips and water bars on skid trails and/or roads where designated by the COR. He will perform the necessary erosion prevention work and remove any temporary structures (if installed by contractor) that are no longer necessary to his operation.
320 - Protection of Lands, Streams, Sinkholes, Lakes and Reservoirs - The contractor shall prevent pollution of streams, lakes, and reservoirs by fuels, oils, and other chemicals, silt, or other harmful materials. He shall schedule and conduct operations so as to avoid siltation of streams, lakes, and reservoirs, loss of embankment material during high flow periods
330 – Protection of Improvements – All survey monuments, road signs, traffic counters, and other improvements must be protected whenever encountered. If any of these improvements are damaged or destroyed, the contractor will be responsible for all replacement costs.
340 - Access - The contractor shall protect all trails, roads, ditches, fences, and other improvements in the project area. Roads and all adjacent private land shall be kept free from logs, slash, and debris. The contractor shall promptly repair any road or trail used by the contractor that is damaged by contract operations. There are numerous unauthorized roads and trails in the area. Travelways not shown on the map are not authorized by the Forest Service and do not require any protection.
350 - Protection of Archeological/Historical Resources - The Contractor upon discovery of suspected archeological or historical materials, shall cease work in the vicinity of such material and immediately notify the COR. Known significant archeological sites will be marked on the ground and discussed at the pre-work meeting. Mowing operations will not be allowed in these areas.
360 - Protection of Land Control Monuments - All land control monuments likely to be disturbed may be identified by 4 X 4 posts or signs. Contractor may not damage these monuments during contract operations.
370 - Protection of Gopher Tortoise Burrows - Areas may have gopher tortoise burrows which should be excluded from mowing. The tractor should not be driven in the 15-foot radius around the burrow entrance to prevent the collapse of the burrows. Gopher tortoise burrows have been delineated with flagging (in a different color than area boundary marking) to demarcate the 15-foot protection zone around the burrow entrance.
380 – Protection of Red Cockaded Woodpecker Colonies – Areas containing Red Cockaded Woodpecker colonies are identifies on the maps and flagged on the ground. No mowing will be permitted within these colonies during the nesting season March 1st through July 31st.
390 – Other Wildlife Protection - Contractor will not destroy or knock down any larger (greater than 6 inches in diameter) dead trees or snags. These serve as perch trees and/or den trees for cavity nesting birds and raptors such as hawks and owls. Contractor will keep lookout for eastern indigo snakes, Florida pine snakes, and gopher tortoises to reduce mortality or physical injury.
DIVISION 400 – INSPECTION AND ACCEPTANCE
Upon completion of an area, the Contractor shall notify the COR so that an inspection can be made of that area. When remedial work is required, the Contractor shall perform such work before moving equipment to the next area.
DIVISION 500 – MEASUREMENT AND PAYMENT
510 – Method of Measurement –Acreage for fuel reduction was determined by a GPS traverse or GIS measurement of the area.
520 – Basis of Payment – Payment will be made for the actual number of acres satisfactorily completed and accepted by the COR times the contract unit price.

ALL OCCUPATIONS LISTED ABOVE RECEIVE THE FOLLOWING BENEFITS:

** UNIFORM ALLOWANCE **
If employees are required to wear uniforms in the performance of this contract (either by the terms of the Government contract, by the employer, by the state or local law, etc.), the cost of furnishing such uniforms and maintaining (by laundering or dry cleaning) such uniforms is an expense that may not be borne by an employee where such cost reduces the hourly rate below that required by the wage determination. The Department of Labor will accept payment in accordance with the following standards as compliance:
The contractor or subcontractor is required to furnish all employees with an adequate number of uniforms without cost or to reimburse employees for the actual cost of the uniforms. In addition, where uniform cleaning and maintenance is made the responsibility of the employee, all contractors and subcontractors subject to this wage determination shall (in the absence of a bona fide collective bargaining agreement providing for a different amount, or the furnishing of contrary affirmative proof as to the actual cost), reimburse all employees for such cleaning and maintenance at a rate of $3.35 per week (or $.67 cents per day). However, in those instances where the uniforms furnished are made of "wash and wear" materials, may be routinely washed and dried with other personal garments, and do not require any special treatment such as dry cleaning, daily washing, or commercial laundering in order to meet the cleanliness or appearance standards set by the terms of the Government contract, by the contractor, by law, or by the nature of the work, there is no requirement that employees be reimbursed for uniform maintenance costs.
** NOTES APPLYING TO THIS WAGE DETERMINATION **
Under the policy and guidance contained in All Agency Memorandum No. 159, the Wage and Hour Division does not recognize, for section 4(c) purposes, prospective wage rates and fringe benefit provisions that are effective only upon such contingencies as "approval of Wage and Hour, issuance of a wage determination, incorporation of the wage determination in the contract, adjusting the contract price, etc." (The relevant CBA section) in the collective bargaining agreement between (the parties) contains contingency language that Wage and Hour does not recognize as reflecting "arm's length negotiation" under section 4(c) of the Act and 29 C.F.R. 5.11(a) of the regulations. This wage determination therefore reflects the actual CBA wage rates and fringe benefits paid under the predecessor contract.

REQUEST FOR AUTHORIZATION OF ADDITIONAL CLASSIFICATION AND WAGE RATE {Standard Form 1444 (SF 1444)}
Conformance Process:
The contracting officer shall require that any class of service employee which is not listed herein and which is to be employed under the contract (i.e., the work to be performed is not performed by any classification listed in the wage determination), be classified by the contractor so as to provide a reasonable relationship (i.e., appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination. Such conformed classes of employees shall be paid the monetary wages and furnished the fringe benefits as are determined. Such conforming process shall be initiated by the contractor prior to the performance of contract work by such unlisted class(es) of employees. The conformed classification, wage rate, and/or fringe benefits shall be retroactive to the commencement date of the contract.
{See Section 4.6 (C)(vi)} When multiple wage determinations are included in a contract, a separate SF 1444 should be prepared for each wage determination to which a class(es) is to be conformed.
The process for preparing a conformance request is as follows:
1) When preparing the bid, the contractor identifies the need for a conformed occupation(s) and computes a proposed rate(s).
2) After contract award, the contractor prepares a written report listing in order proposed classification title(s), a Federal grade equivalency (FGE) for each proposed classification(s), job description(s), and rationale for proposed wage rate(s), including information regarding the agreement or disagreement of the authorized representative of the employees involved, or where there is no authorized representative, the employees themselves. This report should be submitted to the contracting officer no later than 30 days after such unlisted class(es) of employees performs any contract work.
3) The contracting officer reviews the proposed action and promptly submits a report of the action, together with the agency's recommendations and pertinent information including the position of the contractor and the employees, to the Wage and Hour Division, Employment Standards Administration, U.S. Department of Labor, for review. (See section 4.6(b)(2) of Regulations 29 CFR Part 4).
4) Within 30 days of receipt, the Wage and Hour Division approves, modifies, or disapproves the action via transmittal to the agency contracting officer, or notifies the contracting officer that additional time will be required to process the request.
5) The contracting officer transmits the Wage and Hour decision to the contractor.
6) The contractor informs the affected employees.
Information required by the Regulations must be submitted on SF 1444 or bond paper.
When preparing a conformance request, the "Service Contract Act Directory of Occupations" (the Directory) should be used to compare job definitions to insure that duties requested are not performed by a classification already listed in the wage determination. Remember, it is not the job title, but the required tasks that determine whether a class is included in an established wage determination. Conformances may not be used to artificially split, combine, or subdivide classifications listed in the wage determination.
