GENERAL INFORMATION
SCOPE: The Contractor shall provide all labor, supervision, materials, equipment, transportation, permits, insurance and incidental supplies necessary to furnish and deliver various grades of stone/crushed aggregate to various locations on the Daniel Boone National Forest in accordance with the specifications and attachments hereto which form a part of the solicitation and any resultant contract.
CONTRACT TIME: The contract period shall be from the Date of Award through December 31, 2010.
INSPECTION BY THE GOVERNMENT: Inspection of the supplies/materials shall be made by the Contracting Officer’s Representative (COR) or their designated Inspector as deliveries are made and at such intervals as are necessary to ensure compliance with the contract specifications and provisions.
PLACING ORDERS: All Warranted Contracting Officers of the USDA, Forest Service may place orders under this contract. Orders may be placed either orally or in writing. Prior to issuing an order, the Government will determine which contract has the lowest overall cost to the Government.
PLACING ORDERS – PRICE DETERMINATION: A determination as to which contract has the lowest overall cost to the Government will be made for each order to be placed. This determination will be calculated by adding twenty-five cents ($0.25) per ton-mile to the quarry price shown in the schedule of items for the quarry or quarries located closest to the project site.
For forest road projects, the miles will be measured from the quarry to the midpoint of the project using the shortest practical route.
For a recreation site or other location, the miles will be measured from the quarry to the actual project location.
PLACING ORDERS - DELIVERY SCHEDULING: A Contractor’s ability to deliver the requested type and quantity of stone in accordance with the Government’s requested delivery schedule will also be a factor in determining with which Contractor an order will be placed.
DELIVERIES: Delivery locations will be specified by the individual or office ordering stone.
Deliveries will normally be made Monday through Friday between the hours of 7:30 a.m. and 4:30 p.m., unless alternate times are agreed upon by both parties. No deliveries will be scheduled to be made on a federal holiday.
Schedules for delivery of stone will be negotiated at the time the order is placed. The Government will generally order stone a minimum of two (2) working days prior to desired delivery. Negotiated delivery schedules will allow for a reasonable period of time for the Contractor to deliver the requested quantity of stone using a suitable number of trucks and trips per truck per day. Any changes to the negotiated schedule, including the nunber of trucks to be used or the number of trips per truck per day, must be mutually agreed upon by the Government and the Contractor.
Minimum and Maximum Delivery Quantities: The following minimum and maximum delivery quantities will apply to this contract unless alternate quantities are agreed upon by both the Government and the Contractor.
Minimum Quantity: 16 Tons. The Contractor, at their option, may deliver quantities less than the stated minimum without additional cost to the Government.
Maximum Quantity: 300 Tons. The Contractor, at their option, may deliver quantities in excess of the maximum without additional cost to the Government.
ACCEPTANCE: Acceptance will be made for all stone which is delivered in compliance with the specifications and requirements shown elsewhere in this contract. Stone not meeting the specifications and requirements will be rejected and payment will not be made for quantities rejected.
MEASUREMENT: The following will apply:
STONE: Measurement of the actual tons of stone delivered will be determined from the weight tickets furnished with each delivery. The scales used to weigh stone must be inspected and approved by the State of Kentucky.
HAUL DISTANCE: The measurement of haul costs will be determined using odometer readings and/or Kentucky State Highway maps. All mileage will be rounded to the nearest whole mile in accordance with the specifications and requirements shown elsewhere in this contract. Haul distances for different types of delivery will be made as follows:
Delivery to a Road for Tailgate Spreading: The haul distance will be the mileage from the nearest quarry to the midpoint of the road.
Delivery to a Stockpile, Recreation Area or other Dump Point: The haul distance will be the mileage from the nearest quarry to the actual dump point.
If a Contractor chooses to haul a grade of stone from a quarry that is not the quarry (where that grade of stone is priced under the contract) closest to the project site, the haul distance will be calculated from the closest quarry to the project site, as shown above.
PAYMENT: Payment of stone will be made at the unit prices quoted for the actual number of tons, or fractions thereof, delivered to and accepted by the Government. Payment for haul costs will be made by adding twenty-five cents ($0.25) per ton per mile to the price of stone at the quarry.
The Contractor shall furnish to the Government, at the time of delivery, two (2) copies of the weight tickets showing the following information:
a. Contractor/Quarry Name
b. Date of the Order
c. Order Number
d. Item Number and Description
