NOTE:

The Contractor shall provide equipment on a fully-operated basis. All equipment shall be in good mechanical and operating condition and shall be operated by skilled operators experienced in the type of work for which the equipment is being ordered.

Equipment substitutions of at least equivalent or better equipment, as determined by the Government, may be approved for the same price as the awarded equipment.

ADDENDUM TO 52.212-4 CONTRACT TERMS AND CONDITIONS-COMMERCIAL ITEMS

MOVING OF EQUIPMENT

Mobilization. Mobilization is the moving of equipment, accessories, support equipment, and personnel to the point of hire and from the point of release. There shall be one Mobilization, paid at the lump sum.

Noxious Weed Control. Prior to moving of the equipment to the worksite, the Contractor shall be required to clean all equipment prior to entry on to the project area. This cleaning shall remove all dirt and plant parts and material that could carry noxious weed seeds into the project area. Failure to provide clean equipment may result in the rejection of equipment.

METHOD OF MEASUREMENT

An hour consists of 60 minutes of actual operation of equipment on authorized Government work. Moving of equipment under its own power, when so ordered by the Forest Service, (except move-in/move-out) will constitute authorized work. Nonproductive time such as, but not restricted to, lack of operating supplies or qualified operator, service time, time lost by reason of breakdown or being stuck, or loading time of specified accessories shall not constitute "actual operation".

DAILY RECORD

The Government and the Contractor shall maintain a daily record for each piece of equipment showing:

(a)Contract number, and item number applicable to the equipment.
(b)Hours of actual operation on authorized work to nearest quarter hour.
(c)Hours of standby (if any) and mobilization
(d)Time for fueling and/or any lost time with explanation
(e)Name of Operator
(f)Both Contractor Rep/Operator and COR/Inspector signatures required

This daily record may be documented on a shift ticket-see sample in attachments. The operator performing the work shall sign the shift ticket and give a copy to the COR or Inspector each day. Appropriate Government surveillance of contractor performance is required to give reasonable assurance that efficient methods and effective cost controls are being used.

QUALIFYING REIMBURSABLES, LABOR-HOUR TERMS (FAR 52.212-4, (i) Payment.)

Payments will be made only for Services Accepted based upon the Hourly Rates in the Schedule of Items for Operated Equipment time. In lieu of specific modification to the contrary, there shall be no payment for direct labor, other equipment or service costs, materials of any kind, or other direct or indirect costs.

CEILING PRICE – TOTAL COST TO GOVERNMENT (FAR 52.212-4, (i) Payment) A Ceiling Price is established for performance of the work specified. It is estimated the total cost to the Government for performance will not exceed the Ceiling Price. The Contractor agrees to use its best efforts to perform the specified work as efficiently as possible within the Ceiling Price. The Government is not obligated to pay the Contractor any amount in excess of the Ceiling Price, or any Modified adjusted Ceiling Price.

METHOD OF PAYMENT (52.212-4 (i) Payments).

(a) The rate specified in the Schedule of Items will be paid for all hours of actual operation of equipment on authorized work.

(b) Mobilization. No mobilization will be paid for replacement equipment.

(c) Standby will only be paid when specifically ordered by the Government (see definition at ADDITIONAL DELIVERIES OR PERFORMANCE REQUIREMENTS) during authorized hours of work. The Government will pay 50 percent of the hourly working rate, rounded to the nearest quarter hour. The standby rate will be paid for equipment ordered to the project site and required to standby rather than starting specified work. If transport is ordered to standby, it will be paid 50% of the rate.

Invoice Processing Platform (IPP) The Forest Service is utilizing the Invoice Processing Platform (IPP) for the electronic submission and tracking of contracts/purchase orders, invoices, and payment information. IPP is a secure Government-wide, Web-based invoice processing service. Visit http://www.ipp.gov to learn more.

Upon award of a contract, Contractors must enroll at https://www.ipp.gov/vendors/enrollment-vendors.htm. Contractors shall submit all invoices electronically via IPP. Paper copies of invoices will no longer be accepted.

Inspection and Acceptance

(a) Rejected and Replacement Equipment. Equipment may be inspected by the Government to ensure it meets the requirements. If any requirements are not met, the equipment may be rejected: This may include, but is not limited to, washing of equipment, fluid leaks, inappropriate size/type, poor condition/maintenance effecting safety or efficiency. Payment shall not be made for rejected equipment.

If equipment becomes inoperative, the Contractor will be notified to correct the deficiencies or furnish replacement equipment meeting specifications. No additional moving costs will be paid for replacement of equipment. If the contractor is unable to repair or replace inoperative equipment within 24 hours, the equipment may be released. Payment will not be made for move-out of such released equipment. Equipment suffering repeated down time that is determined to be the result of age or maintenance related mechanical failure will be released without payment for de-mobilization.

(b) Dependent Equipment. If any piece of equipment becomes inoperative and prevents a dependent piece of equipment from doing productive work, then no payment will be made for any dependent equipment until affected equipment resumes operation.

(c) Inspection and Acceptance of Operator. It is expected equipment operators will be experienced, proficient, and productive in the work being performed. If the COR determines an operator provided for a project does not meet these expectations or is otherwise not performing to a reasonable standard, the operator may be rejected. If the operator is rejected, the contractor will be notified to furnish a replacement operator within 24 hours. This notification will be documented in writing. Failure to replace the operator within 24 hours will render the equipment inoperative, the equipment will be released.

(d) If the Contractor believes work is directed in an unsafe manner, operator shall immediately notify the CO/COR in writing.

Rework and Reinspection After Rework. Acceptance of the work will be made when the COR has made the determination of satisfactory compliance. When inspection indicates the performance objectives were not met, the work will be deemed unsatisfactory and payment will not be made until the Contractor has assured the Government that its Quality Control measures have corrected the deficiencies. Inspections after rework will be made in the same manner as the first inspection. The Contractor may be charged for actual costs incurred by the Government for inspection of rework.

FAR 52.204-7 System for Award Management (JUL 2013)

(a) Definitions. As used in this provision--

"Data Universal Numbering System (DUNS) number" means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.

"Data Universal Numbering System +4 (DUNS+4) number" means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional System for Award Management records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same concern.

"Registered in the System for Award Management (SAM) database" means that--

(1) The offeror has entered all mandatory information, including the DUNS number or the DUNS+4 number, the Contractor and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see Subpart 4.14) into the SAM database;

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in the SAM database;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and
(4) The Government has marked the record “Active”.

(b) (1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "DUNS" or "DUNS +4" followed by the DUNS or DUNS +4 number that identifies the offeror's name and address exactly as stated in the offer. The DUNS number will be used by the Contracting Officer to verify that the offeror is registered in the SAM database.

(c) If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.

(1) An offeror may obtain a DUNS number--

(i) Via the Internet at http://fedgov.dnb.com/webform or if the offeror does not have internet access, it may call Dun and Bradstreet at 1-866-705-5711 if located within the United States; or
(ii) If located outside the United States, by contacting the local Dun and Bradstreet office. The offeror should indicate that it is an offeror for a U.S. Government contract when contacting the local Dun and Bradstreet office.

(2) The offeror should be prepared to provide the following information:

(i) Company legal business.
(ii) Tradestyle, doing business, or other name by which your entity is commonly recognized.
(iii) Company Physical Street Address, City, State, and Zip Code.
(iv) Company Mailing Address, City, State and Zip Code (if separate from physical).
(v) Company Telephone Number.
(vi) Date the company was started.
(vii) Number of employees at your location.
(viii) Chief executive officer/key manager.
(ix) Line of business (industry).
(x) Company Headquarters name and address (reporting relationship within your entity).

(d) If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.

(e) Processing time, which normally takes 48 hours, should be taken into consideration when registering. Offerors who are not registered should consider applying for registration immediately upon receipt of this solicitation.

(f) Offerors may obtain information on registration at http://www.acquisition.gov.

AGAR 452.209-71 Assurance Regarding Felony Conviction or Tax Delinquent Status for Corporate Applicants (FEB 2012) Alternate I (FEB 2012)

(a) This award is subject to the provisions contained in section 433 and 434 of the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, as amended and/or subsequently enacted, regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it –

(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and

(2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government.

(b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434, amended and/or subsequently enacted.

AGAR 452.211-74 Period of Performance (FEB 1988) The period of performance of this contract is from approx May 25, 2014 through June 25, 2014.

FAR 52.216-31 Time and Materials/Labor-Hour-Proposal Requirements-Commercial Item Acquisition. (Feb 2007).

(a) The Government contemplates award of a Time-and-Materials or Labor-Hour type of contract resulting from this solicitation.

(b) The offeror must specify fixed hourly rates in its offer that include wages, overhead, general and administrative expenses, and profit. The offeror must specify whether the fixed hourly rate for each labor category applies to labor performed by—

(1) The offeror;

(2) Subcontractors; and/or

(3) Divisions, subsidiaries, or affiliates of the offeror under a common control.

AGAR 452.216-74 CEILING PRICE. (FEB 1988). The ceiling price of this contract will be $89,000. The Contractor shall not make expenditures or incur obligations in the performance of this contract which exceed the ceiling price specified herein, except at the Contractor’s own risk.

FAR 52.217-7 Option for Increased Quantity—Separately Priced Line Item. (MAR 1989) The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.

FAR 52.223-2 Affirmative Procurement of Biobased Products Under Service and Construction Contracts (SEPT 2013) *(If applicable; see FAR 23.406(b))

(a) In the performance of this contract, the contractor shall make maximum use of biobased products that are United States Department of Agriculture (USDA)-designated items unless—

(1) The product cannot be acquired—

(i) Competitively within a time frame providing for compliance with the contract performance schedule;

(ii) Meeting contract performance requirements; or

(iii) At a reasonable price.

(2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 3201.3(e)). For example, all USDA-designated items are exempt from the preferred procurement requirement for the following:

(i) Spacecraft system and launch support equipment.

(ii) Military equipment, i.e., a product or system designed or procured for combat or combat-related missions.

(b) Information about this requirement and these products is available at http://www.biopreferred.gov.

(c) In the performance of this contract, the Contractor shall—

(1) Report to http://www.sam.gov, with a copy to the Contracting Officer, on the product types and dollar value of any USDA-designated biobased products purchased by the Contractor during the previous Government fiscal year, between October 1 and September 30; and

(2) Submit this report no later than—

(i) October 31 of each year during contract performance; and

(ii) At the end of contract performance.

AGAR 452.236-72 USE OF PREMISES (NOV 1996)

(a) Before any camp, quarry, borrow pit, storage, detour, or bypass site, other than shown on the drawings, is opened or operated on USDA land or lands administered by the USDA, the Contractor shall obtain written permission from the Contracting Officer. A camp is interpreted to include a campsite or trailer parking area of any employee working on the project for the Contractor.

(b) Unless excepted elsewhere in the contract, the Contractor shall (i) provide and maintain sanitation facilities for the work force at the site and (ii) dispose of solid waste in accordance with applicable Federal, State and local regulations.

AGAR 452.236-77 Emergency Response (NOV 1996)

(a) Contractor’s Responsibility for Fire Fighting.

(1) The Contractor, under the provisions of FAR clause 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements, shall immediately extinguish all fires on the work site other than those fires in use as a part of the work.
(2) The Contractor may be held liable for all damages and for all costs incurred by the Government for labor, subsistence, equipment, supplies, and transportation deemed necessary to control or suppress a fire set or caused by the Contractor or the Contractor’s agents or employees.

(b) Contractor’s Responsibility for Notification in Case of Fire. The Contractor shall immediately notify the Government of any fires sighted on or in the vicinity of the work site.

(c) Contractor’s Responsibility for Responding to Emergencies. When directed by the Contracting Officer, the Contractor shall allow the Government to temporarily use employees and equipment from the work site for emergency work (anticipated to be restricted to fire fighting). An equitable adjustment for the temporary use of employees and equipment will be made under the Changes Clause.

AGAR 452.237-74 Key Personnel (FEB 1988)

(a) The Contractor shall assign to this contract the following key personnel:

Equipment Operator(s) with minimum 1000 hours operating experience
On-Site Representative

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

AGAR 452.215-73 POST AWARD CONFERENCE (Nov 1996). A post award conference with the successful offeror is required. It will be scheduled within 10 days after the date of contract award. The conference will be held at a location to be agreed upon.

SAFETY. Contractors shall comply with OSHA regulations and provide employees a work environment that is sanitary and not hazardous, which includes providing personal protective equipment. Contractors must maintain a health and safety plan and an accident prevention program, which includes frequent and regular inspections of the project site, materials and equipment. Contractors are responsible for risk management regarding contractor/employee and public safety, which include experience of operator to handle road and terrain conditions, getting to the worksite, traffic control and coordination with other users.

FAR 52.236-9 PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES, AND IMPROVEMENTS (APR 1984)

(a) The Contractor shall preserve and protect all structures, equipment, and vegetation (such as trees, shrubs, and grass) on or adjacent to the work site, which are not to be removed and which do not unreasonably interfere with the work required under this contract. The Contractor shall only remove trees when specifically authorized to do so, and shall avoid damaging vegetation that will remain in place. If any limbs or branches of trees are broken during contract performance, or by the careless operation of equipment, or by workmen, the Contractor shall trim those limbs or branches with a clean cut and paint the cut with a tree-pruning compound as directed by the Contracting Officer.

(b) The Contractor shall protect from damage all existing improvements and utilities (1) at or near the work site, and (2)on adjacent property of a third party, the locations of which are made known to or should be known by the Contractor. The Contractor shall repair any damage to those facilities, including those that are the property of a third party, resulting from failure to comply with the requirements of this contract or failure to exercise reasonable care in performing the work. If the Contractor fails or refuses to repair the damage promptly, the Contracting Officer may have the necessary work performed and charge the cost to the Contractor.

LOSS, DAMAGE, OR DESTRUCTION. Equipment furnished with operator. The Government shall not be liable for loss, damage, or destruction of equipment furnished under this contract except for such loss, damage, or destruction resulting from the negligent or wrongful act(s) of Government employee(s) while acting within the scope of their employment. All claims arising under this clause shall be submitted to the Contracting Officer.

PERFORMANCE WORK STATEMENT

Scope of Contract Contractor shall furnish equipment and operator for expansion of an existing pond, construction of an inlet channel, and in-stream placement of logs, boulders, cobble and gravel to restore fish habitat in Marx Creek.

The base item work includes clearing and grubbing of approximately 1.5 acres, falling and stockpiling trees with rootwads attached , removing and disposing of brush at the onsite waste areas (distance is waste area is approximately 0.5 miles), top soil excavation and stockpile, pond excavation and haul of up to 25,000 yd to designated waste area, construct pond inlet channel 504 ft X 4 ft X 4 ft, waste area contouring pond, outlet control structure (construct riffles composed of boulders, cobble and gravel) and construct fish habitat log structure.

The option items are dependent upon site conditions and availability of funding. Work may include stream bank contouring and topsoil placement, gravel sorting and placement for fish spawning bed rehabilitation, modification of water control weirs and construction for fish spawning bed rehabilitation, modification of water control weirs and construction of additional large wood fish habitat structures.

Location The Marx Creek Project site is located on the Ketchikan Ranger District in Misty Fiord National Monument near the City of Hyder, Alaska. The City of Hyder, Alaska is approximately 79 miles Northeast of Ketchikan Alaska. The project site is 4.8 miles north of Hyder, AK just off the Salmon River road (state access road). The City of Hyder has limited access by Air and Barge. Hyder, Alaska is connected by road to the Alaska Canadian highway system thru Stewart B.C. Canada. From Southeast Alaska, the Project can be accessed via ferry and vehicle thru Prince Rupert B.C. Canada or by chartered plane or barge/boat. The City of Hyder is a very small community with limited facilities and services available. The Communities of Stewart and Terrace B.C. have more developed infrastructure and facilities; they are 6 miles and 196 miles from the project area. See Figure 1-3.

DESCRIPTION OF WORK

The project includes but is not limited to, the following major items of work as shown on the plans and specified. The following descriptions are provided as an outline of major work items, and shall not be construed as an inclusive or complete listing of all items of work.

· Pond site preparation – clearing and grubbing of approximately 1.5 acres. Work includes falling and stockpiling trees with rootwads attached, removing and disposing of brush. Brush will be disposed of at the onsite waste area (distance to waste area is approximately 0.5 miles). Extents of clearing and grubbing area will be flagged by the COR.

· Top soil excavation and stockpile – All topsoil encountered on site will be excavated and stockpiled for use within the project area. The COR will determine the material that is stockpiled for topsoil.

· Pond excavation – Up to 25,000 yd3, will be excavated and hauled to the waste area. Excavation limits, including cut and fill will be staked by the COR.

· Construction of inlet channel – 504 ft x 4ft x 4ft pond inlet channel excavation and overburden haul to waste area. Channel centerline and elevations will be staked by the COR. New segments of the channel will be constructed “in the dry” wherever possible to minimize water quality disturbances, and water will be routed into these new channels after they are constructed to specifications and grade, as set by the COR.

· Waste area contouring – excavator will be used to slope waste piles to match existing ground. Elevations will be flagged by the COR if needed.

· Pond outlet control structure construction (constructed riffles composed of boulders, cobble and gravel) – Riffle, side channel and flood plain construction will be integrated into and accomplished in concert with log structure construction (See Figure 6). The grade or slope of the riffles (2.5-3.5%) will be refined and then the riffle ribs will be constructed. Grades will be staked by the COR. Riffle frames will be constructed with a series of log or boulder ribs (typically 2-3 ribs per riffle) and then back filled with cobble. Rock used for channel construction will be taken from on-site.

· Large wood fish habitat structure construction – Structures include Formidable Multi-Faceted Log structures (See Figure 4-5) and in-stream log/rock structures (See Figures 7-9). Log structures will utilize whole trees taken from on-site. Conceptual designs are provided and field engineered to adapt to varying site conditions.

· Depending on site conditions and the level of funding, work may also include stream bank contouring and topsoil placement, gravel sorting and placement for fish spawning bed rehabilitation, modification of water control weirs and construction for fish spawning bed rehabilitation, modification of water control weirs and construction of additional large wood fish habitat structures.

Technical Specifications/Requirements If equipment delivered does not meet the following minimum/maximum specification, the CO may, at his/her discretion, determine the specifications to have been met if the Contractor can produce reasonable and satisfactory evidence that assures the CO the equipment is so equipped and maintained as to practically meet the needs and specifications as described in this section. Simply modifying factory settings to produce a slight HP increase or adding weight will not meet these criteria and will not result in an automatic upgrade of the equipment to a category different from that dictated by the manufacturer’s specifications.

Hydraulic Excavator Excavators shall be used to pioneer a new stream channel course, extract whole trees and stock pile at designated sites. Excavate overburden from new stream channel and pond and construct new flood plains and terraces. Place riffle and spawning gravel substrate in designated areas of the channels. Approximately seven large woody debris (LWD) structures will be constructed along the banks of the new channel and on the constructed terraces and floodplains to prevent erosion and provide fish habitat.

Transport –for movement of equipment Mobilization shall meet all Federal, State and Local requirements for haul of heavy equipment as they apply to this item and for equipment being transported.

Equipment will at times be working in or around flowing water up to five feet in depth. Equipment may transport large boulders 4 yd3 in diameter and greater, cobble and gravel. In addition, trees and brush and large wood (up to but not limited to, >30” DBH, 60 ft. in length, approximately 50% or more with rootwads attached) from designated stockpile sites to desired locations (structure sites). Excavators will excavate trenches, contour banks and stream channels and place trees, woody debris, boulders, cobble and gravel in the stream banks.

Hydraulic oils are of specific concern because they are lost to the environment in the normal course of equipment operation. Vegetable-based hydraulic oils will be required to protect sensitive waterways and groundwater. Bio-based lubricants were tested and found to perform as well or better than petroleum oils, are readily biodegradable, low in toxicity, and offer worker-safety advantages. The agency also specifies that manufacturers fill new equipment with vegetable-based hydraulic fluid.

Hydraulic Tractor Fluid Description:

Hydraulic Tractor Fluid or approved equal is a readily biodegradable and non-hazardous ISO 40 grade hydraulic tractor oil for use in general purpose hydraulic systems. This oil must be a direct replacement for petroleum oil based hydraulic tractor fluids. Oil must meet or exceed the requirements of petroleum oil based hydraulic fluids and have excellent anti-wear characteristics.

i. Products supplied to this project shall be rated as Commercial and/or Industrial Grade.

ii. Contractors need to quote their nationally known, first line, premium quality products.

iii. All products shall be API certified and the vendor shall furnish documentation of the certification upon request. Products must meet the performance and warranty requirements of the manufacturers listed in the specifications.

iv. Technical Requirements

General: Must be readily biodegradable and non-toxic ISO 40(J-20-C) grade tractor oil for use in heavy-duty brake, transmission and hydraulic systems. Must be based on natural ester technology and a direct replacement for petroleum oil based tractor fluids.

A. All operations of the Contractor shall be conducted so as to minimize damage to the soil, existing vegetation and structures not designated for removal.

B. All materials to be moved and placed for the in-stream phase shall be as directed by the COR.

C. Contractor is responsible for operating the equipment in a manner that is safe and within the capabilities of the equipment specified.

D. A staging area for equipment will be available on the project job site. All maintenance work and fueling of equipment shall be done in an area approved by the COR where no damage to the streams or lake will occur. All preventative maintenance, lubrication and fueling of equipment will be done outside of work hours. Approved oil absorbent pads will be placed under all equipment and vehicles being serviced or fueled.

F. If the Contractor maintains storage facilities for oil or oil products on project area, Contractor shall take appropriate preventive measures to ensure that any spill of such oil or oil products does not enter stream or other waters. The Contractor shall not store more than 1,000 gallons of oil or oil products on site. Dispensing of oil or oil products shall only be done within a designated area. Fuel nozzles shall not be left unattended. All hoses shall be rewound immediately upon completion of use.

G. Pollutants such as fuels, lubricants, bitumens, sewage and other harmful material shall be controlled at the site and shall not be released into the environment. Wash water or waste waters from construction activities shall not be allowed to enter any stream or other waters. All contaminated soil, vegetation or debris resulting from the Contractor's operation shall be immediately contained and within 24 hours shall be removed from the National Forest at the Contractor's expense. Contractor shall furnish sorbent pads and loose sorbent material as follows: for each fuel or service vehicle, maintain in the vehicle a minimum of 100 sorbent pads and 100 pounds of particulate sorbent material. For all other equipment, maintain in the vehicle a minimum of 25 sorbent pads. Sorbent pads shall be heavy weight, minimum size 30” x 30” or as approved by the COR/Contracting Officer. All Federal, State, County, and Local regulation are to be followed.

Mobilization Consists of moving personnel, equipment, material, and incidentals to the project and performing all work necessary before beginning work at the project site. Mobilization includes the obtaining of permits and insurance.

Payments for mobilization may be paid as follows:

When 5 percent of the original contract amount is earned from other items, 50 percent of the mobilization item, or 5 percent of the original contact amount, whichever is less, may be paid.

When 10 percent of the original contract amount is earned from other items, 100 percent of the mobilization item, or 10 percent of the original contact amount, whichever is less, will be paid.

Radios: A minimum of 3 (three) two-way radios required for communication during equipment operations. Recommend Motorola RD series two-way radio with microphones or equivelant.

Clearing and Grubbing This work includes but is not limited to the falling and stockpiling of trees with rootwads attached. Harvest area shall be decompacted and graded to existing ground. Slash genrated from harvest and stockpiling shall be used to spread over exposed soil within the areas of disturbance.

Hydraulic Pump The contractor will supply all the materials, equipment and labor to dewater the pond and/or channel for sediment and water quality control. A 6” Diesel Pump with 200 feet of hose will be used to bypass work areas with clean water and pump turbid water within the construction zone into the adjacent forest. Work includes all equipment, labor and materials to dewater each work site/area. The Marx Creek channel receives its water from the groundwater table which fluctuates with weather conditions. The Contractor shall provide a dewatering plan which will include pump calculations and manufacturers data specifications for pump, proposed dewatering typical layout, prior to mobilizing to Hyder, to be approved by the COR in writing.

Vegetable based hydraulic fluid replacment (see biobased clause) Each machine shall be required to have petroleum based hydraulic fluid replaced with a vegetable based biodegradable equivalent. Option Items:

Excavators Excavators shall pioneer additional new stream channel segments, extract whole trees and stockpile at designated sites. Excavate overburden from new stream channel and construct new floodplains and terraces. Place riffle and spawning gravel substrate in designated areas of the channels and construct LWD structures.

Dump Trucks The dump truck will assist with the overburden removal, tree stockpiling and stream substrate placement.

Grizzly or Power Screen Gravel Sorter The work includes but is not limited to the development, sorting and stockpiling of channel substrate materials from on-site materials.

ADDITIONAL DELIVERIES OR PERFORMANCE REQUIREMENTS

(a) Days and Hours of Work. The work is to be accomplished as follows: There will be no minimum guarantees for any of the equipment, either in terms of hours per day or number of days. Work will be limited to daylight hours only. The work day shall be no longer than 10 hours, unless mutually agreed between the COR and Contractor. The work week is generally between the hours of 6:00 a.m. and 6:00 p.m., Monday through Saturday, unless otherwise mutually agreed. The Government will not pay for hours worked in excess of the work schedule that was agreed upon for the project. The COR will promptly notify the Contractor of work schedule changes necessitated by changed requirements, weather or availability of Government personnel. Such changes will not of themselves, obligate the Government to pay Standby or partial workdays.

(b) Repairs. All repairs to equipment under this agreement shall be made and paid for by the Contractor. Repairs shall be made promptly and equipment returned to use within 24 hours unless otherwise agreed. In lieu of repairing equipment, Contractor may furnish similar replacement equipment within the time specified.

(e) Operating Supplies. Fuel, oil, and other operating supplies will be furnished by the Contractor. The Government is not responsible for time spent for fueling and maintenance. If reasonable accessibility to work site by ¾ ton service truck is not available, roading of equipment for purposes of refueling will be paid at 50 percent of the hourly rate to and from the nearest site accessible to the service truck. To the best of its ability the Government will coordinate work schedules to allow contractor to provide for fueling needs within one mile of a point accessible by service truck.

(e) Standby. Standby shall be specifically ordered by the COR. Equipment ordered to the job site and required to standby, will be paid at 50 percent of the hourly rate. When multiple pieces of equipment are provided with a single operator, standby will not be applicable to the additional pieces of equipment when the operator is operating another item, unless standby has been specifically ordered . If the transport/mobilization vehicle will be needed to make repeated work site moves within short time periods, it may be ordered to standby rather than be released after delivery of equipment.

(f) Signing and Public Safety. The Contractor shall conduct operations in a manner that exercises due caution and care to prevent undue conflict with public users of the roads, providing for public/operator safety. Such industry standard measures should include: Attachment of a reflectorized "Slow Moving" vehicle emblem on all equipment as required.

Provide warning to road users of work in progress by posting warning signs with flags on both ends of sections being worked and moved, as needed, so that signs do not precede machinery more than one (1) mile. Signs shall be of size, number, and colors as required in Section 6B-25 of the current edition of the "Manual on Uniform Traffic Control Devices."

Any unusual conditions created in the roadway that must be left overnight or on weekends due to weather conditions or breakdowns, such as a berm, shall be properly signed as a hazard and visibly illuminated at night.

(g) Pollution and Erosion Control. During all operations, the Contractor shall exercise reasonable measures to direct surface runoff water to stabilized waterways and to keep the drainage systems functioning effectively to prevent or minimize soil erosion and pollution of water and other resources. All refuse, including garbage, rubbish, and solid or liquid wastes from the Contractor's operations, including camps, parking areas, and equipment maintenance areas shall be stored and collected in a sanitary manner and disposed of in a State-approved sanitary landfill.

Oil from crankcases or gear boxes, equipment waste or spilled or excess fuel shall be placed in containers and removed from the work site and disposed of as approved and required by Federal, State and Local laws.

Equipment ordered for operations in close proximity to streams or bodies of water will be required to meet more stringent requirements regarding seals and fittings that prevent the leaking of hydraulic fluids, lubricants and fuels. Failure to comply will result in immediate rejection of equipment.

All equipment will be spray washed to remove petroleum residue, dirt and noxious weed seeds prior to entering the project area. Contractor will have petroleum absorbent pads on site at all times during the construction period. Equipment fueling areas will be designated by the Contracting Officers Representative (COR) and will be situated at least 150 feet from the normal high water mark of Marx Creek. If a stationary fuel tank is used by the contractor, it shall be situated within a containment berm with impermeable liner as per the requirements of the state of Alaska enforceable policies for storage of petroleum.

FAR 52.212-2 -- Evaluation -- Commercial Items. (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(1) Technical capability to meet the Government requirement;

ii) Equipment Operator(s) and their 1000+ hours per year for past three years of relevant experience/skills performing the services required in this solicitation.

B) Identify the proposed Equipment listed in the Schedule to be used, include year, make, model and attachments available.

NOTE: Relevant equates to same or similar work performed on rural- often remote networked-forest roads characterized by gravel or native material surfaces, narrow, curving, often shoulderless, turn-outs; adjacent to environmental sensitive streams or wetlands; having apurtenances such as signs, gates & culverts; steep drop-offs; often un-focused public drivers of vehicles including motorcycles, four-wheel ATV’s, recreational vehicles and industrial traffic.

(3) Price – Schedule of Items

Technical Capability and Past Performance, when combined, are significantly more important, when compared to price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
