Contractor Acceptance Statement: By signing the offer, the Contractor agrees to all terms, conditions, and provisions included in the solicitation and agrees to furnish any awarded items at the price set in the schedule unless otherwise excepted as follows:
Additional Contractor Notes:
1. This will be an Indefinite Delivery, Indefinite Quantity contract which means that the Government does not currently know the exact amount and timing of the work to be done.
Actual task orders will be issued as needed during the life of the contract.
2. This acquisition is set aside for Small Business concerns. The solicitation will result in the award of a firm-fixed price Indefinite Delivery / Indefinte Quantity (IDIQ) contract. One or more awards may be made to the responsible Offeror(s) whose proposal(s) are determined to offer the best value to the Government price and other evaluation factors considered. Task orders for identified work will then be competed between the contractors receiving IDIQ contract awards from this solicitation.
3. In order to be eligible for a contract award under this solicitation, you must comply with all requirements of FAR Clause 52.204-7 – System for Award Management. Contractors may register in SAM at www.sam.gov; registration in SAM is free. If you do not have an “Active” profile or you do not submit the requested information according to the solicitation provision, you will be considered non-responsive.
4. The Government intends to evaluate proposals and award a contract(s) without further negotations or discussion, unless clarification is required. Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a price and technical standpoint. The Government reserves the right to enter into discussions later, if the Contracting Officer deems that it is in the interest of the Government to do so.

6. All quantities listed in the schedule of items are estimates only and do not reflect antual quantities to be ordered over the life of the contract. Actual quantities to be ordered in any given http://www.sam.gov/ year are dependent on the needs of the Forest Service, weather conditions and/or budget. Not all items may be included on every task order.
7. The pricing offered is considered by the Forest Service to be contractually binding unit ceiling pricing. If a contract is awarded, the Contractor is bound to this offered pricing as the maximum pricing that can be offered when a task order is solicited. Whe offering a task order proposal, the IDIQ Contractor can elect to offer less than the contractually established ceiling pricing; however, this reduction is only in effect for that specific task order solicitation / issued task order, and does not constitute a contractual change to the unti ceiling pricing. IDIQ contracts will not be awarded to Offeror(s) who do not propose reasonable initial (ceiling) pricing.
AGAR 452.216-73 Minimum And Maximum Contract Amounts (FEB 1988)
During the period specified in FAR clause 52.216-18, ORDERING, the Government shall place orders totaling a minimum of $2,500 (per contract; base year only), but not in excess of $500,000 (all contracts combined over the life of the contract).
SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
I. Introduction
Statement of Work The purpose of this contract is to secure services to construct barbed-wire and woven wire fences throughout the Monongahela National Forest. This contract includes new fence construction, removal of existing fence, gate installation and clearing of brush from fence lines.
The Contractor shall furnish all labor, supervision, tools, equipment, transportation, supplies (unless otherwise designated), permits, licenses and incidentals necessary to perform the required services on the Monongahela National Forest.
Execution of an agreement does not establish an obligation of total price and does not commit the Government to any quantity. The individual Orders issued to the Contractor will include actual quantities for each unit to be treated.
Location and Description The Monongahela National Forest is located in central West Virginia. The work will be performed on U.S. Forest Service administered lands. The specific location of the projects will be shown on maps attached to individual orders issued under this contract.
This solicitation is asking for bids in each of the three geographic areas of the Forest with range allotments. North area is the Cheat-Potomac Ranger District, Central area is the Greenbrier Ranger District and the South area is the Marlinton-White Sulphur Springs Ranger District (See map)
Access Access to project areas will be highly variable. Seasonal roads may be impassable for several days after heavy rains or snow-blocked during the winter and early spring months. Special equipment may be required to access project work areas.
II. Technical Requirements
A. GENERAL
Operations
1. Operation shall not be conducted when soil moisture conditions promote rutting and compaction of soil.
2. The contractor shall notify the COR prior to beginning work in any area.
3. Work shall not be performed on Weekends or Federal Holidays unless otherwise approved.
4. Once started, work on a work order, shall be continuous until the project has been completed and accepted, barring inclement weather or other unforeseen circumstances outside of the contractor’s control.
5. The contractor may not start work on a second work order under this contract without having first completed work on any open work orders, or without having received written permission, from the CO or COR, stating that the contractor may proceed on the second order.
6. Mobilization to and from the site of work shall be considered incidental to items of construction.
There will be no additional compensation for moving equipment, materials, or any other items to or from the project site.
Protection of Bearing and Property Line Trees
1. Utmost caution shall be applied when operating near these trees. Trees are marked with red paint and are not to be damaged.
Soil and Water Protection
1. Operations shall avoid the digging, gouging and moving of soil unless otherwise specified.
2. If needed, stream and ditch crossings shall be designated by the Forest Service representative.
3. All equipment shall be pressure washed to remove NNIS seed and soils prior to moving onto or between Forest Service project locations.
Other Resource Protection
1. System Roads
a. Tracked and Heavy Equipment shall not be trammed on Forest system roads. Equipment should be hauled to work area and unloaded.
b. Lead off ditch and wing ditch structures shall be protected.
2. Utilities
a. Protect utilities from operations within rights-of-way
b. The Contractor shall be responsible for contacting utility companies to determine location of underground lines (natural gas, water, telephone, etc.)
3. Improvements
a. All improvements shall be protected by Contractor, including but not limited to: utilities, roads, fences, gates, property boundaries, and corner monuments.
b. Any damage resulting to improvements as a result off the contractor’s negligence shall be repaired at the contractor’s expense.
B. ITEMS OF WORK
1. Barbed Wire Fence Construction
1. Wire and hardware will be new, galvanized material. Wire shall be attached on the side of posts that will receive the greatest pressure from animals. Wire will be placed on the outside of posts on curves.
2. Fences will be constructed of 5 strands of barbed wire. The bottom strand shall not be more than 8 inches above the ground at any point. Spacing between strands shall be equal +/- ½ inch, and not greater than 10 inches. The top strand of barbed wire shall be 44 to 48 inches above the ground.
3. Materials will meet the following requirements:
• Barbed wire: Double strand, class 1 galvanized, 15 ½ gauge or heavier, with 4 point barbs.
• Posts: Black locust is preferred as the most durable wood to use untreated. All other woods will be treated with preservative if used. When used, pressure treated posts shall not be cut. Steel posts may also be used. Wood line posts – 6-1/2 feet or longer, 4 inch minimum diameter if pressure treated and a minimum of 3 1/2” diameter if locust.
Wood corner and brace posts – 8 feet or longer, 5 inch minimum diameter. Gate posts shall be a minimum of 8 feet long and 6” diameter. Steel line posts – Standard “T”

/8 inch, galvanized or painted, with anchor plate. A minimum of every fourth post shall be wood.
• Braces: Wood – 3 ½ inches diameter at small end; or 3 ½ inches square, 8 feet long.
Brace wire – high tensile, galvanized steel, 9 gauge wire. Brace pins shall be 10” long by 3/8” min diameter class 1 galvanized steel. Brace pins shall be used at each brace/post connection.
• Staples: Staples used to fasten fence wire to wooden posts will be barbed, 9 gauge, class 3 galvanized wire with a minimum length of 1½ inches. Staples will be driven cross-wise to the grain and will not be driven in tight against wire.
4. Installation of Materials
• Line posts – shall be set in a straight line between corner posts or between corner post and brace assemblies. The pasture side of the post will be used for alignment and will be on line +/- 2 inches as determined by stretching a string line between the corners or corner post and brace post and measuring to the front face of the line post at a height of 42 +/- 2 inches.
• Wood line posts - maximum of 12 feet apart, set a minimum of 2 feet deep and vertical +/- ¾ inch/Foot.
• Steel line posts - maximum of 12 feet apart and set to top of anchor plate, and vertical +/- ½ inch/Foot.
• Brace assemblies in line - are placed not more than 660 feet apart on level or gently sloping land; and at any significant change in the land surface - 15° change in alignment or slope.(See Figure 2 for Brace Assemblies Guidance)
• Brace posts - are placed not less than 6 feet or more than 8 feet (outside edge to outside edge at brace height) from corner posts, end posts, and gate posts; and no less than 6 feet nor more than 8 feet apart in line brace assemblies.
• Corner, gate, and brace posts – are set at least 3 feet deep. If gate posts are replaced, gates shall be reinstalled using existing hardware. Payment for such installation shall be incidental to fence construction.
• NOTE: Posts may be driven or set in post holes and hand tamped with earth or filled with concrete
• In order to prevent wooden posts from loosening after construction due to frost/freeze action; all wooden posts shall be placed with the large end in the ground. Posts which are driven large end down and as a result are loose, shall be tightened by compacting the area around the posts prior to installation of barbed wire or bracing.
5. Corner and brace assemblies shall be completed and line posts set, prior to stretching wire in a given section (length of fence between brace assemblies, brace assemblies and corner, or between corners) of fence.
6. Wire shall be stretched between brace assemblies, corner and brace assembly, or corners, so that fence strands show no sag between posts and shall be sufficiently tight to prevent livestock from significantly increasing gaps between strands.
7. Fences across gullies or streams require special braces and design. The site specific design will be provided, and must be followed.
8. Trees will not be used as a part of the fence construction.
2. Woven Wire Fence Construction
1. Wire and hardware will be new, galvanized material. Wire shall be attached on the side of posts that will receive the greatest pressure from animals. Wire will be placed on the outside of posts on curves.
2. Fences will be constructed of 47 inch tall, high tensile, galvanized field fence with a single strand of barbed wire 4 “ above the top of the field fence. The bottom of the fence shall be no more than 6 inches above the ground at any point.
3. Materials will meet the following requirements:
• Woven Wire: 47”, class 3 Galvanized, high tensile field fence. Top and bottom wires must be at least 10 gauge with a min. of 12.5 gauge filler wire. Maximum spacing of vertical stays shall not exceed 6 inches in any direction. Fence shall have a minimum of 10 horizontal wires set at graduated spacings starting at 3” spacing between the bottom two wires with spacing increasing by ½”, to a maximum spacing of 8 inches at the top.
• Barbed wire: Double strand, class 1 galvanized, 15 ½ gauge or larger with 4 point barbs.

6. Wire shall be stretched between brace assemblies, corner and brace assembly, or corners, so that fence strands show no sag between posts and shall be sufficiently tight to prevent livestock from damaging or deforming fence.
7. Fences across gullies or streams require special braces and design. The site specific design will be provided, and must be followed.
8. Trees will not be used as a part of the fence construction.
3. Removal of Existing Fence
1. All wire will be removed from location and properly recycled or disposed of legally.
2. Wood posts will be removed from ground, but can be left on site to decay in areas designated by the COR.
3. Metal posts will be collected and staged at the allotment entrance, a Forest Service
Representative will determine whether they can be reused or should be recycled/ disposed of by the Contractor.
4. Clearing of Fence Lines
1. Those areas to be treated may not be accessible for mechanical treatment due to terrain and/or wet conditions.
2. All vegetation less than 5 inch diameter breast height, shall be removed from a 10 foot wide area (5 ft either side of fence line) along the existing fence line or proposed fence location.
3. The 10 foot - fence corridor shall be cleared of limbs to a height of not less than 10 feet.
4. Vegetation removed under this item, will be scattered outside the area being cleared.
Material shall not be deposited on private property or within the grazed pasture area.
5. Trees greater than 5 inch DBH, and within 1 ft of the proposed fence shall be removed.
6. Any existing fences damaged during fence clearing shall be repaired immediately.
5. FURNISHING AND INSTALLING 12 ft GATES
1. Remove any existing gates and hardware. Removed gates shall remain the property of the
U.S. Forest Service, and shall be left on location near the removal site, as designated by the
COR.
2. Replace hinge side gate post and brace assembly.
• Utilize an 8 ft X 6” diameter pressure treated post (3 ft buried) as the gate post.
• Brace Post shall be 8ft X 5” diameter pressure treated post (3 ft. buried).
• Brace shall be a min of 3 ½” in diameter. Distance between Brace post and Gate post shall be no more than 8 ft.
• Brace wire – high tensile, class 3 galvanized steel, 9 gauge wire.
3. Gates shall be hinged to post using a 5/8 in galvanized J-bolt which extends through the entire gate post and is tightened using a nut and washer system. J bolts shall be tightened with two nuts on the inside and two on the outside of the post with a washer against the post on both sides. Threads shall be scarred to prevent loosening of nuts and removal of gate. Bolts shall be place with the J pointing down on the top bolt and up on the bottom bolt.
4. The gate shall be 12 ft long and made of 16-gauge, 2inch tubular steel.
• The gate shall be painted or galvanized.
• The gate height shall be between 48 and 52 inches.
• The maximum gap between horizontal cross bars shall not exceed 10 inches center to center
• The spacing of the vertical tubing shall be even and shall not exceed 6 feet center to center.
5. Each gate shall come with a piece of 3/8 inch chain for securing the gate to the off side gate post. The chain shall be a minimum of 3.5 feet long. Chain links shall be a minimum of 5/9 inch by 1 3/8 inch. The chain shall have a minimum load limit of 2650 lbs. and shall be electro-galvanized.
6. The Forest Service will supply a Forest Service lock to be used to secure each gate.
6. FURNISHING AND INSTALLING 16 ft GATES
1. Remove any existing gates and hardware. Removed gates shall remain the property of the

Types of anchor-and brace assemblies and where to locate them: (a) For fence lengths of 10 rods (165 feet) or less, use single-span end construction. (b) For fence lengths of 10 to 40 rods (165 to 660 feet), use double span end construction. (c) For fences more than 40 rods (660 feet) long use a braced-line-post assembly to divide the fence lengths. (d) On rolling land, fence stretching is easier if braced line-post assemblies are located at the foot and top of each hill. (e) Contour fences, more than 20 rods (330 feet) long, should have a braced-line-post assembly installed to keep the stretches to 20 rods (330 feet) or less. Install in straight section at least one post span away from a curve. Do not install on a curve. Note: One rod equals 16 ½ feet.

2.1.2 SAFETY MEETING
A. Prior to commencing construction, representatives of the Contractor, including the Superintendent, shall meet with the Government to review the Contract's safety and health requirements.
B. The Contractor's safety and health program shall be reviewed, and implementation of safety and health provisions pertinent to the Work shall be discussed.
2.1.3 COMPLIANCE WITH REGULATIONS
A. Contractor Responsibility: The Contractor shall assume full responsibility and liability for compliance with all applicable codes, standards and regulations pertaining to the health and safety of personnel during execution of the Work. The Contractor shall have written safety and health programs in compliance with 29 CFR Parts 1910 and 1926.
2.1.4 SUBMITTALS
A. Safety and Health Programs: The Contractor shall submit, for approval, copies of the project safety and health programs, as applicable to the work scope, or required as a result of the safety meeting, including but not necessarily limited to the following:

PART 2 - PRODUCTS
2.2.1 PERSONNEL PROTECTIVE EQUIPMENT
A. Special facilities, devices, equipment and similar items used by the Contractor in execution of the Work shall comply with 29 CFR Part 1910, Subpart I and other applicable regulations.
PART 3 - EXECUTION
2.3.1 EMERGENCY SUSPENSION OF WORK
A. In accordance with FAR 52.236-13, when the Contractor is notified by the Government, of noncompliance with safety or health provisions of the Contract, the Contractor shall immediately, correct the unsafe or unhealthy condition. In accordance with FAR 52.236-13 if the Contractor fails to comply promptly, all or part of the Work will be stopped by Government notice. The Contractor shall not be allowed any extension of time or compensation for damages in connection with a work stoppage for unsafe or unhealthy conditions.
2.3.2 PROTECTION OF PERSONNEL
A. The Contractor shall take all necessary precautions to prevent injury to the public, occupants, or damage to property of others.
2.3.3 ENVIRONMENTAL PROTECTION
A. Dispose of solid, liquid and gaseous contaminants in accordance with local codes, laws, ordinances and regulations.
B. Comply with applicable federal, state and local noise control laws, ordinances and regulations, including but not limited to 29 CFR 1910.95 and 29 CFR 1926.52.

The Contractor shall be required to (a) commence work under this contract within 14 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than the date(s) identified in each individual task order. The time stated for completion shall include final cleanup of the premises.

A post award conference with the successful offeror is required. It will be scheduled and held within 10 days after the date of contract award. The conference will be held at place and time to be determined.
G.1 DESIGNATION OF CONTRACTING OFFICER'S REPRESENTATIVE
The contracting Officer will designate a Contracting Officer's Representative(COR) at the time of award.
The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.
On all matters that pertain to the contract terms the contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the contracting officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal for a contract claim.
G.2 GOVERNMENT-FURNISHED PROPERTY
The Government will provide the following item(s) of Government property to the Contractor for use in the performance of this contract. This property shall be used and maintained by the Contractor in accordance with the provisions of the "Government Property" FAR clause contained elsewhere in the contract.

G.3 INVOICING
The "Submit Invoice-to" address for USDA orders is the Department of Treasury's Invoice Processing Platform (IPP). All invoices are to be submitted online via the electronic Invoice Processing Platform. This is a mandatory requirement initiated by the U.S. Department of Treasury and you can find more information at this website https://www.ipp.gov/index.htm.
Your company must register at https://www.ipp.gov/vendors/enrollment-vendors.htm to establish an account in order to submit an invoice on this project.
Invoicing for task orders having a performance period greater than 30 days may be submitted bi-weekly for construction projects. For construction projects, all invoices shall be supported by the applicable certified payrools for the period of work invoiced. Invoices for task orders having performance periods under 30 days in duration shall be submitted after completion and acceptance of work by the Government.
G. 4. ORDERING PROCEDURES - Issuance of Task Orders
Task Orders will be issued in accordance with FAR 52.216-18, FAR 52.216-19, FAR 52.216-22 and AGAR 452.216-73.
All warranted Contracting Officers assigned to the USDA Forest Service, Eastern Region are authorized to place task orders against this contract within their delegated warrant authority. All task orders are subject to the terms and conditions of this contract.
The Task Order Issuance process will begin with a Task Order Pricing Request. This request will address specific requirements of a project, schedule of items, specific supplemental specifications within the Scope of the Work, specific site locations, etc. The Task Order Pricing Request:
a) will be issued by email. The Contractor is responsible for checking their email for task order issuances as no other notice will be provided.
b) will be issued during the performance period of this contract.
c) will be issued to those individuals awarded a contract under this program of work.
d) will include the required due date, specific instructions for the submission for quotes, and other information deemed appropriate.
e) will be competitive in nature. All contractors who are awarded a contract will be required to submit a quote on every task order. If a contractor cannot meet the “Desired Start Date” and the “Contract Completion Time” identified by number of calendar days referenced on the task order, an alternate schedule can be submitted by the contractor and will be considered for award.
f) The Contractor is encouraged to visit the site prior to quoting on the project.
The following procedures will be utilized to provide awardees a fair opportunity in accordance with FAR Part 16.505(b). Method for selecting a contractor for task order award will be as shown in “a” through “c” below.
a) Exceptions to the fair opportunity process as provided by FAR 16.505(b)(2). If a Fair Opportunity Exception applies, the task order quote request will be issued to one contractor.
b) The Government will determine the best value based on price, timeframe, and past performance. Single or multiple awards may be made for individual task orders, as specified on the task order. The Contracting Officer selects contractor based upon the following:
1. Price – Prices from the Request for Task Order Pricing will be evaluated for reasonableness. Contractors cannot exceed the maximum price quoted as shown in their master IDIQ contract awarded schedule, however, the Contractor may provide lower pricing. The Task Order pricing should include all associated costs for requested work. Award may be made to other than the lowest price offer based on timeframes and past performance.
2. Timeframe – Each Request for Task Order Pricing will include a government requested period of performance. Alternate timeframes for each individual task order may be suggested by the Contractor if unable to meet the government requested period of performance.
3. Past Performance - Performance on earlier task orders will be evaluated for quality and timeliness. This is a critical factor not only for each task order but also as consideration to exercise the option periods. Positive past performance will assure continued ability to receive task orders.
c. Once an award decision is made, the Contracting Officer will email the awarded task order to the successful Contractor and the COR. Work shall not begin until a pre-work meeting is held and a Notice to Proceed is issued. Each task order will include:
1. The Contract Number
2. The Task Order Number.
3. Authorized signature of warranted Contracting Officer
4. Detailed description of the task or service to be performed.
5. Firm fixed price of the project.
6. Detailed description of required submittals.
7. Map or other descriptions of the project location.
8. Designation of the Contracting Officer’s Representative.
9. Government furnished property, if provided.
10. Applicable Davis Bacon Wage Determination.
d. The Contracting Officer will notify unsuccessful contractors of the final award decision.
e. Vendors must be awarded a task order (versus receiving a payout of the minimum guarantee) during the base period in order to be eligible to have options exercised.
G.5 FINAL PAYMENT - RELEASE OF CLAIMS
The Government shall pay the final amount due the Contractor under this contract after—
(1) Completion and acceptance of all work;
(2) Presentation of a properly executed invoice; and
(3) Presentation of release of all claims against the Government arising by virtue of this contract, other than claims, in stated amounts, that the Contractor has specifically excepted from the operation of the release.
