JUSTIFICATION FOR OTHER THAN FULL AND OPEN
COMPETITION
1. Contracting Activity USDA, Agricultural Research Service, Eastern Business Service Center 141 Experiment Station Road, Stoneville, MS 38776 Randal Barnett, Contract Specialist Joshua J. Dobereiner, Contracting Officer
2. Nature/Description of Action:
The proposed action is award of a short term IDQ contract for operations and maintenance services for the Southeast Area, (SEA), laboratories not covered by basic services O&M contract AG-32SC-C-16-0018. The IDQ will run as a companion to and concurrent with the basic O&M contract. Both carry period of performance end dates of September 30, 2016. The task order work attachment, made a part of the contract file, describes the needed labor categories, estimated hours, and fully burdened labor rates. Also included are the current DOL wage determinations for the applicable labor categories. This IDQ will provide task order services until the end of the 30 day transition period after award of the long-term contract, currently scheduled to end September 30, 2016.
IDQ contract AG-32SC-C-16-0030 was awarded with the intent of satisfying the task order needs of the SEA laboratories through September 30, 2016. Its value was $169,476.75.
Unfortunately, the maximum ordering value was reached on August 16, 2016. In providing an estimate of anticipated task order work, consideration was not given to the fact that the period of performance in question encompassed time leading to fiscal year end. Upon doing an historical analysis, the centers have re-evaluated the dollar value of task order work to be completed by the end of the fiscal year. Correspondence in which that analysis is discussed is included as a part of the contract file. The labs best estimate of remaining task order work is $351,408.00, and is very much in line with the historical norm for the time period immediately before fiscal year end. Completion of this task order work is critical to mission performance of the laboratories. Due to the delay that has been caused by the maximum task order limit of AG-32SC-C-16-0030 being prematurely reached, it is imperative that the new award be made promptly to get work completed by September 30, 2016.
3. Description of Supplies/Service:
The Contractor shall provide facilities operation and maintenance support services to the SEA in three locations. These locations are the Russell Research Center and Southeast Poultry Research Laboratory in Athens, Georgia and the US Horticulture Research Laboratory in Ft.
Pierce, Florida.
Services to be performed include, but are not limited to, any and all operations and maintenance work for the labs that are not covered by basic O&M contract AG-32SC-C-16- 0018. This IDQ has a maximum value of $351,408.00.
4. Statutory Authority:
FAR 6.302-1 and 41 U.S.C. 3304(a) (1), there is only one responsible source and no other source will satisfy the agency’s requirements.
5. Demonstration of Contractor’s Unique Qualifications:
Four Seasons Environmental Inc., (FSE), has satisfactorily performed the necessary services since the last long term contract, AG-3K06-11-0016, expired on April 1, 2011. It has the familiarity with the SEA locations and their daily operation to maintain the necessary continuity of these critical services. The current short-term IDQ contract, AG-32SC-C-16-0030, reached its maximum task order limit on August 16, 2016. Due to the short procurement lead time, no other source has the knowledge and skills needed to immediately begin performance of the required service while meeting the standards and quality required at the SEA locations.
If awarded to any other firm, the SEA facilities would experience unacceptable delays and degradation of services. It is therefore necessary to award a sole-source Contract to the incumbent contractor FSE. It is the only contractor that could provide the necessary continuity of services without interruption. It is imperative that continuity of services be maintained without disruption to the research mission. No other offeror could immediately perform all of the facilities operations and maintenance services for the Research Location within the required time frame and maintain quality support without disruption or degradation of services, loss of research, or incurring substantial cost. Any other firm would not have the relationship as the incumbent with the research groups and the local business community which could impair their ability to adequately support the research mission for such a short period of time. FSE’s experience and knowledge will permit them to continue to support the SEA’s Location effectively and efficiently, at the least cost to the Government. Any other contractor would incur extensive expenses, including mobilization costs, pose a risk to site performance, and result in duplication of work/costs to the Government.
6. FedBizOps Announcement/Potential Sources:
It is the intent of the Contracting Officer to post a notice of this sole source award of the contract to FSE.
7. Determination of Fair and Reasonable Costs:
The proposal will be compared to the current contract, historical pricing, and current Davis Bacon wage determinations to determine fair and reasonable pricing.
8. Market Survey: N/A (See Item 9 for explanation)
9. Additional Support: Solicitation AG-32SC-S-15-0003 for a new follow on O&M contract is now at APOB award review stage. Award full performance is anticipated to begin on October 1, 2016. Continuity of the task order O&M services to the SEA facilities is critical to the day to day operations of the facility as these services support key functions such as utility and facility repairs, janitorial & grounds maintenance, boiler room operation, receiving, mail room, etc.
10. Other Interested Sources: N/A
11. Actions Taken to Remove Barriers to Future Competition: Contract end dates will be tracked through ATS, internal spreadsheets, and team meetings. By tracking contract completion dates more closely, there will be time for greater competition.
