AN EQUAL OPPORTUNITY EMPLOYER
Attachment 1
OTHER THAN FULL AND OPEN COMPETITION JUSTIFICATION
(Pursuant to FAR 6.303-2, the justification must contain sufficient facts and rationale to justify the use of this authority)
1. Contracting Office: U.S. Department of Agriculture
DM/OPPM/Procurement Operations Division Acquisition Management Branch – Fort Collins 2150 Centre Ave, Bldg A, Ste 145 Fort Collins, CO. 80526 (e.g., POD IT Contracting Branch; NITC RMS; NFC CS Team)
2. Nature of the Action: The USDA, OCIO, NITC on behalf of NRCS has a requirement for renewal of software maintenance and technical support of commercial-off-the-shelf (COTS) Alfresco software products. A subscription renewal with genuine support from the publisher is required (brand name).
(Briefly in one or two line describe the action to be approved)
3. Description of the Supplies or Services:
Annual Alfresco Software Maintenance Renewal NRCS –Alfresco One-Enterprise Base License (up to 8 cores, 1,000 users)

5. Statutory Authority and Supporting Rationale:
(Check all authorities that may apply and provide the details to support the authority)
Item Peculiar to One Manufacturer; Brand name, exclusive licensing agreements (FAR 13.106- 1(b)(1)).
(A brand name item, product or feature of the product peculiar to one manufacturer, whether available from one or more FSS is an item peculiar to only one manufacturer)
a) Explain why the particular brand name, products or features of the product from one source can only satisfy the specialized nature of the Government’s requirement. Attach a list of the brand name products (Note:
Explaining the products capability or process is not adequate rationale).
Alfresco was purchased in 2010 for a successful pilot project that rolled out in 2012 and is currently running in NRCS’s production environment. Alfresco maintenance has been purchased annually to keep the product licensed for continued use. Purchasing any other product than Alfresco would result in significant additional costs to the Agency that could not be recouped through competition. Without Alfresco, NRCS would need to re-tool a number of production applications that are currently integrated with Alfresco.
In addition, Alfresco is now used as the ‘official; record’ for all NRCS conservation contracts.
Alfresco is now integrated with Conservation Client Gateway (CCG), the first NRCS public facing web application and Alfresco is the document management system utilized by CCG. Producers are now able to download and sign forms and documents, which are then stored in Alfresco. With the national announcement in May 2015, we must maintain Alfresco in the NRCS portfolio.
b) If applicable, explain the contractor’s unique qualifications to provide the supplies or services.
Alfresco updates and support are only available from Alfresco, and only Alfresco possesses the proprietary software code and the ability to provide new versions/releases of the software, software revisions, and software updates and corrections to the proprietary code, directly and via authorized resellers.
c) List other companies’ similar products and explain why the products lacked the particular features, do not meet or cannot be modified to satisfy the Government’s requirement.
NRCS has recently completed a multiyear effort of exploring multiple enterprise content management (ECM) solutions which includes the IBM suite of products as one enterprise content management (ECM) solution. Currently, the IBM suite does not provide the necessary document storage components that Alfresco provides to meet the agencies business requirements.
6. Competition Effort: Opportunity will be posted as a small business set aside to
FedBizOpps, and best value vendor will be determined by USDA and selected. Past experience procuring this requirement, as well as current market research, indicates this is approach will provide for best value.
(The Contracting Officer (CO) will describe efforts made to solicit offers from potential sources as practicable to ensure no other sources are available, including whether a Notice was or will be publicized in the Federal Business Opportunities (FAR 5.2) and, if not, which FAR 5.202 exception applies)
7. Nature of the Action: Renewal of software maintenance and technical support of commercial-off-the-shelf (COTS) Alfresco software products.
(Briefly in one or two line describe the action to be approved)
8. Fair & Reasonable Cost:
Opportunity will be posted to FedBizOpps. As multiple commercial vendors can resell maintenance subscription, competition should provide fair and reasonable pricing.
(The CO will explain how cost/price will be determined to be fair and reasonable FAR 15.4)
9. Market Research: Market research confirms multiple commercial vendors as authorized resellers.
(Explain market research conducted and the findings or why market research was not conducted, FAR 10)
10. Other Supporting Facts:
• Specification/SOW Modified for Competition:
• Major System or Highly Specialized Equipment:
N/A
(If applicable, explain why the specifications, descriptions or statement of work have not been developed, are not available or cannot be modified to permit competition)
(If this is a follow-on for continued development or production of a major system or highly specialized equipment or comp cost of duplication if an award was made to any other source; 2) explain how the costs were derived; and 3) explain any potential unacceptable delays)
• Additional Information: (Explain or attached additional data or documentation)
11. Interested Sources: N/A (Provide the name and address of sources that expressed (in writing) an interest in the Acquisition and explain why the sources were determined to be ineligible)
12. Competition Barrier: NRCS’s technical staff continually monitors new and existing technology to ensure that optimal solutions are identified, and that the competitive procurement of new technology is maximized to the greatest extent possible. However, compatibility in augmenting and upgrading existing infrastructure cannot be overcome in all instances. Competition for this product appears limited to Alfresco and authorized resellers through the life of the product. The purchase of this software subscription / support is proprietary software and is only available from the publisher (Alfresco) and its authorized resellers.
(Explain actions taken or to be taken to increase competition for future acquisitions of the same supplies or services, such as, will the Government revise overly technical specifications/SOWs, acquire data rights and drawings, etc. to remove or overcome barriers to competition)

I certify that the information for this requirement meets the Government’s minimum and the justification is accurate and complete to support the acquisition for the justification.
