Justification for Other than Full and Open Competition United States Department of Agriculture

Federal Acquisition Regulation (FAR) Part 6.3

1. Identification of the agency and the contracting activity.

United States Department of Agriculture, Departmental Administration, Office of Contracting and Procurement, Procurement Operations Division, 301 S. Howes Street, Suite 321, Fort Collins, CO 80521-2795.

2. The nature and/or description of the action being approved.

This is a new procurement and the contract contemplated is a firm fixed-price contract with Oregon State Chief Information Office.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

This procurement is to provide vertical, high resolution, direct digital orthorectified imagery to support various Government geographic information system (GIS) programs. National Agriculture Imagery Program (NAIP) 2018 imagery is intended to provide current information of agricultural conditions in support of USDA farm programs. For USDA Farm Service Agency (FSA), the imagery provides a base map for activities such as crop compliance, acreage reporting, environmental compliance, Conservation Reserve Program (CRP) compliance, and Farm Records maintenance. The estimated value of the award is not expected to exceed $400,000.

4. The statutory authority permitting other than full and open competition.

41 U.S.C. 3304(a)(1), as implemented by FAR 6.302-1, titled "Only one responsible source and no other supplies or services will satisfy agency requirements."

5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.

The State of Oregon is already collecting orthorectificed imagery that meets, or exceeds, NAIP 2018 requirements. Contracting with Oregon State Chief Information Office would eliminate duplication of effort required under OMB Circular A-16. Competing this effort under a Full and Open Competition would cause redundant expenditures, double the Government’s program management and quality assurance effort, increase storage cost for redundant dataset and add additional aircraft collecting imagery in controlled airspace (potential safety consideration).

6. A description of efforts made to ensure offers are solicited from as many potential sources as is practicable.

With respect to the current action the conditions have been met and there is Justification for Other than Full and Open Competition. In accordance with 41 U.S.C. 3304(a)(1), FAR Part 6.302-1, the Government intends to negotiate a sole source with Oregon State Chief Information Office. NAICS Code 541922 applies to this requirement.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

All offered pricing will be reviewed by the CO and Contracting Officer’s Representative (COR) upon receipt of the Request for Proposal, with comparison to the Independent Government Estimate (IGE) and any necessary negotiated adjustments. The IGE is based on 15 years of NAIP contract pricing with similar imagery requirements, including eight (8) different NAIP collections of Oregon. This methodology will be utilized to determine the price fair and reasonable.

8. A description of the market research conducted and the results or a statement of the reason Market Research was not conducted.

Survey of any known Government imagery collection is performed during semiannual Federal Geographic Data Committee (FGDC) National Digital Orthoimagery Program (NDOP) Subcommittee meetings, in accordance with OMB Circular A-16. The State of Oregon is currently verified as the only state entity collecting imagery with vertical, high resolution, direct digital orthorectified imagery requirements and the required timeframe. Awarding this effort to any other entity other than Oregon State Chief Information Office would be a duplication of effort, violation of the OMB Circular A-16, resulting in a forfeiture of significant cost savings to the Government.

9. Any other facts supporting the use of other than full and open competition.

Not applicable.

10. A listing of the sources, if any, that expressed a written interest in the acquisition.

Several vendors expressed a written interest when submitting their responses to the NAIP 2018 Request for Proposal, 12314418R0005.

11. A statement of actions, if any, the agency may take to remove or overcome any barriers to competition if subsequent acquisitions are anticipated.

OMB Circular A-16 requires agencies to coordinate, collaborate, and partner on geospatial data collection to eliminate duplication of effort. In future procurements the Government will take every practical step without violating the OMB Circular A-16 to remove barriers to competition.
