LIMITED SOURCE JUSTIFICATION
1. Contracting Office: United States Department of Agriculture, Procurement Operations Division, Information Technology Contracts Team
2. Nature of the Action: This justification is for the purchase of proprietary Compuware (Brand Name) Software Maintenance, Upgrades and related Technical Support of proprietary mainframe software licensed by Compuware Corporation, a large business and the only Authorized Compuware reseller available on GSA Federal Supply Schedule (FSS).
3. Description of the The Department of Agriculture’s National Information Technology Supplies or Services: Center (NITC) has a requirement for Compuware Software Maintenance, Upgrades and related Technical Support. This initiative is based on USDA’s current use of Compuware software to support the datacenter.
4. Estimated Cost and $1,459,500 Period of Performance:
Base Year $291,900 Award Date through December 31, 2013 Option Year 1: $291,900 January 1, 2014 through December 31, 2014 Option Year 2: $291,900 January 1, 2015 through December 31, 2015 Option Year 3: $291,900 January 1, 2016 through December 31, 2016 Option Year 4: $291,900 January 1, 2017 through December 31, 2017
5. Supporting Rationale
Item Peculiar to One Manufacturer (Brand Name)
a) Explain why the particular brand name, products or features of the product from one source can only satisfy the specialized nature of the Government’s requirement. Attach a list of the brand name products (Note:
Explaining the products capability or process is not adequate rationale).
Compuware Corporation is a GSA Federal Supply Schedule (FSS) vendor. Although the required Software Maintenance, Upgrades and related Technical Support are available on Compuware’s GSA FSS GS-35F-5337H, there are no authorized GSA FSS resellers of their mainframe products. Compuware is the sole developer, supporter and suppliers of the Compuware products.
No other software manufacturer is capable of maintaining or updating Compuware’s proprietary software source code.
Obtaining technical support (maintenance) for NITC staff and customers is critical for verifying existing errors and malfunctions in the software, and for obtaining existing detours, fixes, corrections, or modifications from the software developer to correct errors and malfunctions.
X
Copyrighted Compuware software products that require on-going maintenance and technical support at NITC include the following:
*Abend-AID XLS *File-AID/MVS *Strobe MVS Sysplex Cobol *AutoStrobe *Strobe for CICS *Strobe for DB2 *iStrobe *Strobe for Java and DDF *CICS Abend-AID/FX *Expediter CICS *Expediter TSO
b) If applicable, explain the contractor’s unique qualifications to provide the supplies or services.
COTS software developers are the owners of individual copyright authority for the software they develop, and no other source is authorized to license, maintain, or provide technical support of copyrighted software. As a licensed product, software from Compuware is proprietary to the developer and has various legal restrictions for its use and maintenance.
Only Compuware has the rights to the source code, which is required to make changes or corrections to the software. In addition, only the developer has the expertise to provide the required maintenance and support services.
c) List other companies’ similar products and explain why the products lacked the particular features, do not meet or cannot be modified to satisfy the Government’s requirement.
NITC and its customers have installed and operated Compuware’s software in applications for many years, throughout the Enterprise. It is not technically feasible to replace imbedded software with products from a different developer. No other products are known that can be seamlessly used to replace installed Compuware products.
6. Competition Effort: A notice of intent to purchase from Compuware Corporation on a sole-source basis will be posted to FedBizOps for 15 days in accordance with FAR 5.203(a), Publicizing and Response Time.
7. Best Value: Compuware Corporation is a GSA Federal Supply Schedule GS-35F-5337H vendor and USDA incumbent in providing the required products and services. In accordance with FAR 8.404, GSA has determined that prices are fair and reasonable. The costs, amount of time and effort required to purchase new software licenses and maintenance for a software migration/conversion effort and to train NITC and customer staff in the use of a new products would exceed any potential savings that might be realized by purchasing only maintaining existing licenses.
8. Market Research: Market Compuware is the sole developer, supporter and suppliers of the Compuware products. Compuware Corporation has not authorized Compuware products to be sold by other GSA FSS vendors or under any other federal government-wide contract vehicle such as NASA SEWP.
9. Other Supporting Facts: The Statement of Work (SOW) containing a description of products and services will be included with the Federal Business Opportunities.
10. Competition Barrier: NITC will continue to review existing requirements to determine, if the costs and the amount of time and effort required to purchase new software licenses and maintenance for a software migration/conversion effort and to train NITC and customer staff would exceed any potential savings that might be realized by maintaining existing licenses.
