All documentation required by the solicitation must be submitted with the offeror's quote or the offer will not be considered. Late submissions will not be accepted.

AG-2B46-S-17-0023 TITLE SERVICES QUESTIONS AND ANSWERS

Note: Questions are in bold print and answers are in navy blue print

1. Attachment 2 states that “ for all services, please bid a TOTAL amount for all easements. How many are you anticipating? What is the scope of each search in terms of document requirements etc? I can’t possibly bid on a title search, when I do not know if you require full copies of all docs, how many years the search is to cover etc.

Documents required specific to this question are under V. Description of Services in the “Closing services scope of work ACEP”:

a) Copies of all instruments that created rights, interests, or encumbrances on the proposed easement property.

b) A chain of title, including all deeds referenced in the chain of title

c) Preliminary title commitment, which must cover both the easement area and access for ingress and egress, and must commit to issuing the final title policy to the “United States of America” on the ALTA U.S. Policy Form 9-28-91 (Revised 12/3/2012).

The title search will be for a sufficient period of time for the title company to insure the title without objectionable exceptions and will determine all owners of record, outstanding mortgages, liens, judgments or pending suits, outstanding tax claims, easements, or rights-of-way of any type, including oil, gas, and mineral interests that have been severed, and any other exceptions that may cloud the title of the easement to be purchased.

2. Also, Evaluation Factor #2 wants 3 samples of a commitment and policy. We are ONLY bidding on providing the title searches to whomever you choose as a closing agent as we cannot provide a commitment, however your closing agent would provide the commitment based off of the searches we provide to them. See question 2 under Evaluation Factor 2.

The quote should include all items listed under III. SCOPE within the “Closing services scope of work ACEP.pdf”. They include providing the title searches, commitments, draft Warranty Easement Deeds from template, closing services, and recording.

The contractor must coordinate and facilitate the following services:

1. Obtaining and updating chain of title, including copies of all instruments that created rights, interests, or encumbrances on the property.

2. Providing easement boundary and ingress and egress descriptions.

3. Providing preliminary title commitments and issuing final title insurance policies.

4. Obtaining signatures on warranty easement deeds provided by NRCS.

5. Obtaining signatures on subordination agreements and limited lien waivers.

6. Working with landowners to clear exceptions on title to the property.

7. Other services, as necessary, to finalize the easement transaction.

The contractor will perform the same services as in a commercial transaction, including obtaining and recording deeds, and any necessary curative instruments to ensure merchantable, insurable title to the easement area in the name of the United States of America.

3. If we cannot provide a commitment, does that mean we are ineligible to bid for strictly and solely the title search portion?

The requirement under this solicitation is for all title and closing services. Award will be made to the successful firm who can provide all services described in the statement of work"

4. I may be blind, but I could not find an Attachment 1, Statement of Work. I found

Attachments 2-5. Please let me know if Attachment 1, Statement of work is labeled with a different name.
