14. DESCRIPTION OF AMENDMENT/MODIFICATION (Organized by UCF section headings, including solicitation/contract subject matter where feasible.)

This amendment is to answer questions received and does not effect the due date of offers (12/23/2016 NTL 2 p.m. EST)

1. According to Attachment 1 - The closing services will be performed in the town office of the town in which the easement is located, unless the contractor and landowner agree to a different location. Can the closing be conducted via mail-away closing procedures wherein the landowner mails its closing documents to the contractor; which is customary/commensurate with our title insurance underwriting guidelines?

It will be fine for the closings to take place by mail. That's how most are done now.

2. With regards to Attachment 2 The Price Schedule, it states: Offerors must submit current title insurance rates with their proposals. Any necessary changes to title insurance rates during contract period of performance will be handled by modification. NRCS understands that this varies by the amount of each easement. Use the total easement value of about $4 million per year in easement value to estimate Final Title Insurance Premium rates.

As such, in Alabama the cost of title searches is considerable distinct based on the location of the easement and the value of each easement. In fact, according to my teaming partner/underwriter the title abstracter will need to go to the specific location of the easement to do a title search and depending on the location, this will further dictate the cost for doing such title searches. Additionally, the title policies for one county vice another county is very different and will be extremely difficult to estimate without having more information re: the location of the easements, estimate of each easement value (rather than an aggregate value of $4M) or even how the title being held (i.e. a corporation, trust or individual landowner). If you could please provide some additional guidance on how we can estimate the cost via the specific county or value of the easements or even the number of easements; this will be better assist us in providing our price list.

Yes it all sounds correct. Your proposal should include what you propose the cost of any Legal services including title searches in different counties in Alabama. Ownership of any easements we process could include ownership by private landowners, entities or privately held corporations. Mainly private landowners and entities.

Period of Performance: 01/02/2017 to 01/01/2021
