Questions and Answers from Site Showing for solicitation # AG02B46-S-16-0054 Massey Cronch Cummins WRP Restoration

1. Q: What are the liquidated damages if the project is not finished within the 46 days of performance time?

A: The Liquidated Damages Clause does not apply to this contract. Actual Damages apply. See the clause 52.249-10 Default (Fixed-Price Construction) for guidance.

2. Q: If work has to stop for weather and resume next year, how much time will they have to finish the job?

A: See the clause 4I-52.249-70 Time Extensions for Unusually Severe Weather. (Nov 2013) in accordance with the clause clause 52.249-10 Default (Fixed-Price Construction) for guidance. If we justify that weather days delayed them enough to be unable to finish the job, those extra weather days could be added on next year. For example if they lost 10 extra weather days before we decide work can’t continue those can be added next year when they resume work.

If they decide to do one job at a time it would help to just give them an idea of how many days each site will take out of the total 46 total calendar days: Cronch = 14 days, Cummins = 7 days, Massey = 25 days
