SECTION D--PACKAGING AND MARKING

SECTION E--INSPECTION AND ACCEPTANCE

FEDERAL ACQUISITION REGULATION (48 CFR CHAPTER 1) CLAUSES

52.246-1 Contractor Inspection Requirements (APR 1984)

PERFORMANCE-BASED SERVICE CONTRACT (PBSC) REQUIREMENTS

QUALITY ASSURANCE PLAN

Performance based incentives apply to timeliness and/or quality of contract work and the Government’s inspections for contract compliance. All work must meet contract specifications to qualify the contractor for any incentive. Any rework based on an unsatisfactory or failed inspection would disqualify the contractor from any bid incentive.

For purposes of applying incentives and disincentives the Government will track performance throughout the contract year and document the number of occurrences of deficiencies.

Definitions

Deficiency – Any initial failure to meet contract specification as determined by the Contracting Officer’s Representative.

Rework – The contractor will have one opportunity to correct any deficiency within the time period prescribed in this contract (5 days). If the rework is accepted by the Contracting Officer’s Representative, it will not be counted as a deficiency and will not affect the incentive or disincentive in this contract.

Disincentives

If six (6) or more deficiencies are noted throughout the contract year, the contract price will be decreased by 3% deduction.

The use of negative incentives does not waive any other rights of the Government in dealing with inadequate performance.

All disincentives will be calculated/paid at the time of the final payment.

Performance

The Contracting Officer’s Representative or his designee will inspect the work performed under this contract to determine that all specifications and requirements are being complied with. In the event of any noted deficiencies, the Contractor will, within five (5) calendar days after receipt of notice setting forth the specific deficiencies, correct such conditions.

The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.

On all matters that pertain to the contract terms the contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the contracting officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal for a contract claim.

G.2 GOVERNMENT-FURNISHED PROPERTY
