SECTION C - STATEMENT OF WORK

STATEMENT OF WORK

INTRODUCTION

The sale of real estate owned property (REO) is required by Rural Development Instruction 3550 (Chapter 16). Rural Development has acquired these real properties through foreclosure.

OBJECTIVE

The objective of this contract is to retain the services of an auctioneer to perform the sale of REO single family house(s). The work shall be performed by a firm/individual who is licensed to perform real estate auctions and sales by the State of Maine.

SCOPE

Rural Development requires auctioneering services for Single Family Housing REO properties. This service is to provide for the sale of approximately 10 USDA Rural Development REO properties in Maine. The vendor shall provide live, as well as an online sale capability. The auction will be open to the public and be conducted at an agreed upon central location. The vendor shall provide all necessary services to conduct the sale within all appropriate regulatory and statutory requirements. The sale of each property must be completed in accordance with Maine State Law.

Award of this contract does not guarantee the contractor any minimum number of cases during the term of the contract.

REQUIREMENTS

Each property shall be advertised for sale for a minimum of three (3) consecutive weeks in newspapers that are widely circulated in Maine and in the county that the property is located. Advertising shall also be made available online nationwide.

The selling conditions of USDA Rural Development REO shall be “as is, where is” and may include decent, safe and sanitary deed restrictions, in compliance with USDA Rural Development regulations.

The Vendor/Auctioneer shall provide an overall marketing and advertising strategy. This may include, but is not limited to, open houses, minor repairs, and any other appropriate property enhancements. The cost of minor repairs will be the responsibility of the Vendor/Auctioneer, and will not be paid by Rural Development.

Within 30 days, the successful vendor shall provide an overall written assessment of each property, which will include a best price opinion and a recommended opening bid.

The Auctioneer will conduct the auction sale to the best of their ability. It is understood by the parties hereto, that the Auctioneer does not guarantee a sale and Auctioneer is not responsible in the event the buyer and the seller fail to live up to their agreement, or in the event of non-delivery of the property by the seller to the buyer.

The Auctioneer will comply with all applicable Federal, State, local laws, ordinances, and regulations. The Auctioneer shall be responsible for securing their own auctioneer’s license for the purpose of carrying out the terms of this agreement, from the appropriate City, County or State agency or department.

All properties will be sold with an agreed upon minimum/opening bid. All properties will be sold for cash. Private financing is acceptable. Bid deposit of 10 percent is required. All bid deposits must be deposited in escrow within 72 hours. All sales must be closed within 30 days of the acceptance of the contract. Auctioneer fees and seller (Rural Development) closing costs will be paid at close of escrow from proceeds of the cash sale. Rural Development also reserves the right to review and approve the seller’s closing costs.

The Auctioneer shall be responsible for, and incur and pay all costs associated or in any way connected with, the administration and conduct of the auction event. USDA Rural Development shall not be responsible for any other costs incurred in conjunction with the auction other than those as specified in this agreement.

The Auctioneer shall maintain all records as may be required by USDA Rural Development with respect to the auction.

Auctioneer is to provide adequate public liability insurance. The Auctioneer shall furnish evidence of required liability insurance to USDA Rural Development.

The Auctioneer shall coordinate the dates and times of sales with USDA Rural Development.

Upon receipt of certified funds, USDA Rural Development will issue Quit Claim deeds. Deed restrictions may be attached to some dwellings regarding the decent, safe and sanitary requirements. These restrictions may be lifted upon completion of repairs and acceptance of the work by USDA Rural Development.

PERIOD OF PERFORMANCE

The period of performance for this agreement is 1 year from the date of issuance of any agreement. This agreement can be terminated upon 30 days’ written notice by either party.
