SECTION C - DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 Scope of Contract

This project includes removal and disposal of culverts, scarification, installation of water bars and cross ditches, fill pull back, construction of a road closure berm and re-vegetation.

C.2 Project Location

This project is located on Forest Roads 3000136, 3056 and 3056105 on Mt. Adams Ranger District on the Gifford Pinchot NF. See attached vicinity map.

C.3 Performance Work Statement

The contractor shall perform the following tasks.

(a) Water Bars and Cross Ditches

Water bars and cross ditches shall be constructed where and as SHOWN ON DRAWINGS and work list or as marked on the ground. Waterbars and cross ditches shall be sloped to drain to the outside area of the roadbed unless otherwise SHOWN ON THE DRAWINGS

(b) Road Closure - Earthen Barrier

Earthen Closures and Barriers shall be constructed as SHOWN ON THE DRAWINGS at locations shown on the work list and marked on the ground.

(c) Culvert Removal

All designated culverts and appurtenances such as cross-drains, trash racks and sub-drains shall be removed. All removed culverts and appurtenances shall become property of the Contractor and shall be removed from National Forest land.

Limits of excavation and disposal areas will be agreed to in the field by the Contracting Officer. The excavation and piles of resulting material are to conform to the dimensions and requirements of the detail drawing for culvert removals, the work list or as designated on the ground.

The final width of the stream channel after drainage structures have been removed shall equal or exceed the width SHOWN ON THE DRAWINGS, work list or staked on the ground.

The elevation of the constructed channel shall be to the grade of the original channel or the gradient of the pipe, whichever is lower. The slope or gradient line from inlet to outlet shall be straight unless excess rock is encountered in original channel. Stream banks shall be sloped to the original stream bank contours or to 2:1 (run: rise), whichever is steeper, unless otherwise SHOWN ON THE DRAWINGS. Excavation shall proceed in an orderly manner designed to keep the culvert inlet open as long as possible in live water streams, and to keep the existing embankment from failing or eroding. If water flow is present at individual sites a work plan will be required detailing procedures planned to minimize erosion and sedimentation, and shall include proposed methods for water diversion. Rocks and woody debris over 12 inches may be placed along edges of channel for erosion control, but shall not narrow the required width of the channel.

Excavated material shall be placed on cut sections of the road prism against back slopes along the roadbed unless otherwise SHOWN ON THE DRAWINGS. Excavated material shall be shaped to blend in with existing ground above back slope. Piles shall be shaped to drain.

Removal of trees, brush, and other debris necessary to facilitate culvert removal will be considered incidental to this item and disposal of such shall be accomplished by scattering of material on the excavated slopes and disposal piles resulting from culvert removals. Vegetation is to be scattered in a manner that will avoid unstable concentrations.

(d) Scarification

Scarification is the thorough decompaction of a road or landing surface. All existing road surface, including turnouts and landings shall be scarified to a depth of 18” with an excavator bucket. No mounds of material shall be placed on unexcavated ground. Scarification is not required for areas where excavated material from culvert removals, cross ditches, or embankment pullback will exceed 2’ in depth. When shown in the plans or work list a 1’ strip of ground shall remain unscarified for future use as a pathway. Allowable tolerance on this unscarified strip is + 1’. This unscarified strip shall be continuous between all other work items.

Removal of trees, brush, and other debris to facilitate scarification will be considered incidental to this item and disposal of such shall be accomplished by scattering of material upon the scarified roadway.

If equipment required for completion of other work items passes over previously scarified ground, the Contracting Officer may require re-scarification of these areas with no additional payment.

Payment will be Lump Sum for acceptable completion of scarified road bed. Scarification is not to be done where excavated material from culvert removals, cross ditches, or embankment pullback will exceed 2’ in depth.

(e) Fill Pullback

Designated roads or segments shall have fill pulled back to limits and slopes SHOWN ON THE DRAWINGS. Excavated material shall be placed at designated locations against back slopes or on flats, unless otherwise SHOWN ON THE DRAWINGS, sloped to drain, and left in an un-compacted condition.

Removal of trees, brush, and other debris necessary to facilitate fill pullback will be considered incidental to this item and disposal of such shall be accomplished by scattering of material on the completed slopes and disposal piles resulting from fill pull back. Vegetation is to be scattered in a manner that will avoid unstable concentrations.

(f) Seeding and mulching

When SHOWN ON THE DRAWINGS, place Government furnished seed mix on all disturbed areas.

Unless a specific seeding season is listed, seeding shall be done as soon as ground disturbing work has been accepted.

Seed shall be applied at approximately 60 lbs of seed per acre.

Hand operated seeding devices shall be used to apply seed.

When SHOWN ON THE DRAWINGS or listed in the Schedule of Items, furnish and place weed free straw mulch on disturbed areas. Mulch shall be hand placed where equipment or vehicle use is no longer permitted.

Mulch shall meet the requirements of the WA State Wilderness Hay and Mulch Certification Program (WWHAM) or the North American Weed Management Standards (NAWMA)

Mulch materials shall be applied at the application rate of approximately 2 tons per acre.

C.4 Acceptable Quality Level

All work described in the statement of work shall be complete and visually pleasing, furnish all labor, materials, equipment, tools, transportation, and supplies, or as otherwise stated in this contract, needed to perform all work required to complete work.

E.2 Measurement and Payment

The intent of the contract is to provide for the completion of all work described in the contract. Unless otherwise provided, the Contractor shall furnish all labor, materials, equipment, tools, transportation, and supplies and perform all work required to complete the project in accordance with drawings, specifications, and provisions of the contract. Payment for contract work will be made only for and under those pay items included in the Schedule of Items. All other work and materials will be considered incidental to and included in the payment for items shown.

F.2 Performance Period

The Contractor shall complete all work within 45 calendar days after the effective date of the Notice to Proceed.

The allowable work window for this project is July 1 through September 30.

F.3 Prosecution of Work

The following special controls will affect the Contractor's prosecution of work:

(a) If water flow is present at individual sites a work plan will be required detailing procedures planned to minimize erosion and sedimentation. When noted on the work list provide for water by pass or diversion.

Provide 7 day notification to The Forest Service for fish capture and screening on culverts listed as major on the Schedule of Items.

SECTION G - CONTRACT ADMINISTRATION DATA

G.1 452.215-73 Postaward Conference. (NOV 1996)

A post award conference with the successful offeror is required. It will be scheduled within 10 days after the date of contract award. The conference will be held at either of the following:

Gifford Pinchot National Forest Headquarters in Vancouver, WA.

Wind River Work Center located in Hemlock, WA

G.2 Government Furnished Property

The Government will provide the following item(s) of Government property to the Contractor for use in the performance of this contract. This property shall be used and maintained by the Contractor in accordance with the provisions of the "Government Property" FAR clause contained elsewhere in the contract.

The Government will provide the seed mix for this project. Mix will be delivered to project site.

SECTION H - SPECIAL CONTRACT REQUIREMENTS

H.1 Cleaning Of Equipment

Cleaning of Off-Road Equipment used by the contractor for contract work shall be conducted outside the boundary of any National Forest Service land prior to moving each piece of equipment onto the project. The Contractor shall notify the Forest Service prior to moving each piece of equipment onto the project. Upon request from the Forest Service, arrangement will be made for the Forest Service to inspect each piece of equipment prior to it being placed in to service. The Contractor shall use cleaning methods necessary to ensure equipment is free of all attached mud, dirt, plant parts and seeds. If noxious weeds are present at a project site, cleaning may also be required before moving between locations within the same project. These measures will assist to prevent the introduction/spread of the seeds of noxious weeds onto National Forest land. The Contractor shall certify in writing, compliance with the above requirements. “Off-Road Equipment” includes all machinery other than log trucks, chip vans, pickup trucks or vehicles used to transport personnel on a daily basis

H.2 Traffic Control, Barricades, Warning Signs, And Other Devices

The Contractor shall provide, erect, and maintain all necessary barricades, suitable and sufficient lights, danger signals, signs, flaggers, pilot cars, and other traffic control devices, and shall take all necessary precautions for the protection of the work and safety of the public. Suitable warning signs shall be provided to properly control and direct traffic. All operations shall conform to the current requirements and guidelines of the Occupational Safety and Health Administration (OSHA) and the Manual of Uniform Traffic Control Devices

(MUTCD).

The Contractor shall erect warning signs in advance to any place on the project where operations may interfere with the use of the road or trail by traffic and at all intermediate points, where the new work crosses or coincides with an existing road or trail.

H.3 Landscape Preservation And Hazardous Materials

(a) The Contractor shall confine operations to within the clearing limits, immediate work area, or other areas designated in the contract documents, and prevent the depositing of rocks, excavated materials, stumps, or other debris outside of these limits. Material which falls outside of these limits shall be retrieved, disposed of, or incorporated in the work as directed by the Contracting Officer.

The Contractor shall make all reasonable attempts to preserve the scenic and natural environment within and adjacent to this project.

(b) Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, lakes, reservoirs, and other surface waters.

(1) Wash water or waste from concrete, aggregate or other operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.

(2) Mechanized equipment shall not be operated in live streams without written approval by the

Contracting Officer.

(c) No petroleum products or other hazardous substances shall be released on or into land or rivers, AG-05K3-S-10-0049 Upper Wind River Road Decommissioning Project 10 of 27 streams, impoundments or other waters, or into natural or manmade channels leading thereto or there from. Servicing of all equipment shall be done only in the areas approved by the Contracting Officer. The Contractor shall transport off government lands all waste oil, vehicle oil filters (drained of free-flowing oil), and oily rags and shall dispose of such materials in accordance with applicable State and Federal regulations.

(1) If the total on-site oil or oil products storage exceeds 1320 gallons or if any single container exceeds a capacity of 660 gallons, the Contractor shall prepare and implement a Spill Prevention Control and Countermeasures (SPCC) Plan. Such plan shall meet applicable EPA requirements (40 CFR 112) including certification by a registered professional engineer. This plan shall include notification of appropriate state and local officials, the Contracting Officer and other appropriate agencies.

(2) At all on-site work areas (including Contractor storage, transfer, fueling, mixing sites, etc., for oil, oil products or any hazardous materials), the Contractor shall take appropriate preventive measures to insure that any release of hazardous products does not enter any stream or other waters of the United States or any of the individual States and shall conform to the federal, state and local regulations. Planned spill containment locations in stream courses shall be established prior to commencement of work activities. These locations will be reviewed by the Contracting Officer or representative. When deemed appropriate, additional planned preventive measures shall be established for review by the Contracting Officer or representative.

(3) The Contractor, acting independently, shall immediately take action to notify the appropriate agencies including the Contracting Officer, and to contain and clean up, without expense to the Government, all petroleum products or other hazardous substance releases which are on or in the vicinity of the project and which are caused by the Contractor's employees, directly or indirectly. The Contractor shall have the necessary materials on site to contain a spill which may occur on land or within live streams as appropriate for any potential flow conditions likely to occur. This may require absorbent pads and/or booms, or other containment devices. In the event the Government determines that additional resources beyond those of the Contractor's are required, the Contractor may be held liable for all damages and costs including, but not limited to additional labor, subsistence, equipment, supplies, and transportation deemed necessary by the Government for the containment and clean-up of petroleum products or other hazardous substance releases caused by Contractor's employees or resulting from or related to construction operations.

(4) The Contractor shall notify the Contracting Officer of any hazardous materials to be used on the job and shall have Material Safety Data Sheets (MSDS) for those materials available on the job.

I.2 52.204-7 Central Contractor Registration. (APR 2008)

(a) Definitions. As used in this clause--

"Central Contractor Registration (CCR) database" means the primary Government repository for Contractor information required for the conduct of business with the Government.

"Data Universal Numbering System (DUNS) number" means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.

"Data Universal Numbering System +4 (DUNS+4) number" means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional CCR records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same concern.

"Registered in the CCR database" means that--

(1) The Contractor has entered all mandatory information, including the DUNS number or the DUNS+4 number, into the CCR database; and

(2) The Government has validated all mandatory data fields, to include validation of the

Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS), and has marked the record "Active". The Contractor will be required to provide consent for TIN validation to the Government as a part of the CCR registration process.

(b)(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "DUNS" or "DUNS +4" followed by the DUNS or DUNS +4 number that identifies the offeror's name and address exactly as stated in the offer. The DUNS number will be used by the Contracting Officer to verify that the offeror is registered in the CCR database.

(c) If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.

(1) An offeror may obtain a DUNS number--

Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.

(e) Processing time, which normally takes 48 hours, should be taken into consideration when registering.

Offerors who are not registered should consider applying for registration immediately upon receipt of this solicitation.

(f) The Contractor is responsible for the accuracy and completeness of the data within the CCR database, and for any liability resulting from the Government's reliance on inaccurate or incomplete data. To remain registered in the CCR database after the initial registration, the Contractor is required to review and update on an annual basis from the date of initial registration or subsequent updates its information in the CCR database to ensure it is current, accurate and complete. Updating information in the CCR does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.

(g)(1)(i) If a Contractor has legally changed its business name, "doing business as" name, or division name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in Subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day's written notification of its intention to (A) change the name in the CCR database; (B) comply with the requirements of Subpart 42.12 of the FAR; and (C) agree in writing to the timeline and procedures specified by the responsible Contracting Officer. The Contractor must provide with the notification sufficient documentation to support the legally changed name.

(ii) If the Contractor fails to comply with the requirements of paragraph (g)(1)(i) of this clause, or fails to perform the agreement at paragraph (g)(1)(i)(C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the CCR information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the "Suspension of Payment" paragraph of the electronic funds transfer (EFT) clause of this contract.

(2) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the CCR record to reflect an assignee for the purpose of assignment of claims (see FAR Subpart 32.8, Assignment of Claims). Assignees shall be separately registered in the CCR database. Information provided to the Contractor's CCR record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the "Suspension of payment" paragraph of the EFT clause of this contract.

K.2 52.219-28 Post-Award Small Business Program Rerepresentation (APR 2009)

(a) Definitions. As used in this clause -

Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and
