PROVISION OF 3,500-GALLON WATER TRUCK BODY ON GOVERNMENT-PROVIDED CHASSIS
USDA Forest Service, Beaverhead-Deerlodge National Forest
Dillon, Montana Amendment No. 3:
NOTE-1: Amendments No. 1 and 2 were issued on the Federal Business Opportunities (FBO) website as time extension notices only (7/27 AND 7/31 respectively). No separate document exists for either of those amendments and response (signing and returning per 11.a) above) to this amendment includes necessary response to Amendments 1 and 2.
NOTE-2: Respondents who previously submitted quotation packages MUST return this Amendment No. 3 document with Block 15abc completed and MUST resubmit their pricing schedule only, either:
P a g e | 2
a) marking it “PRICING CONFIRMED” with signature and date, or
b) marking it “PRICING UPDATED”, with the new pricing and signature and date.
New respondents must submit a complete package per the solicitation’s instructions and this Amendment No. 03 document with Block 15abc completed.
Amendment No. 3 provides clarifiying answers to a number of questions. See the q’s and a’s below:
1) Chassis new or used? New, 2016 NAVISTAR 7000, 6x4 CAB AND CHASSIS, 54000-58000 GVWR.
2) Clarify the transmission type in the context of the water apparatus driver? The truck will come with a 10-speed manual transmission. PTO will not be driven with an automatic transmission.
2)a. See Page 4 of 66, Item b) and strike any reference to “automatic transmission” for the PTO bullet.
3) Chassis cab color? White.
4) “Storage Box” – please clarify location and purpose? This box will be used for truck safety items such as first aid kit, fire extinguisher, chains, and reflectors, etc. The location can be determined by the vendor. Typically, this box is located under the body and accessible by the driver. Minimum box dimension shall be 20 inches wide, 16 inches tall, 16 inches deep.
5) Cab-to-axle (CA), also “CT”, distance from the back of the cab to the center of the two rear axles, is stated at “approximately 122-inches” – can it be changed? The truck was ordered with 119 to 126-inch CA. This measurement can be changed but it would require submittal of an engineering certificate.
6) Specifications call for a “semi-elliptical tank” – can the tank be a true elliptical? Yes. The requirement is to provide a stable mounting for driving and working in rough terrain.
7) The tank specification calls for one (1) full length bottom doubler plate. Can you elaborate on what the intent of this is?
This configuration is typical in fire tender apparatus and, again, the requirement is to provide a secure attachment base for working in rough terrain.
8) The tank specifications call for a U-shaped sub-frame. Can another type sub frame be used? Yes, as long as it is documentably equivalent or better in terms of strength and durability.
9) Can a rear ladder be used? Yes, as long as it is equivalent or better in terms of access and all other characteristics, to the location listed in the specifications.
10) Can the manway lid be screen? No. The lid must be solid (not sealing) in order to keep water in and debris out when traveling in rough terrain.
11) Regarding tank mounts, can a different mount be used? The Government requires the front mounts to be flexible (spring or equivalent) to relieve twisting stresses. The rear mounts must be solid in case of an accident.
12) Regarding the front & rear spray heads, do you need “electric-over-air switch” in cab or “air switch” in cab? The Government only specifies a six-switch cab console. Operation of the air valves is up to the vendor. Typically, these units are electric-over-air actuated valves.
13) Regarding the jet valve specification, is this a discharge with NST threads? Yes.
14) Regarding the Suction Fill specification, the spec does not seem to call for a self-priming water pump. Can you elaborate on what the intent of this is? The intent was to not require the operator to manually prime the pump but to prime it with the PTO.
15) Regarding the 40-foot hose assembly, is 40 feet required? Is this hose to be carried on the tank? Yes, in order to access
P a g e | 3 water sources in remote locations, often well below the road bed, this total length of hose is required and shall be mounted on the truck. The four, 10 foot lengths will require additional storage.
16) What is the after-frame (AF) measurement on the chassis? AF = 96 inches, OK to reduce this length as needed.
17) Will this award be subject to sales tax? If so, which state? What about federal excise tax (FET)?
a) See FAR 52.212-4 (k) Taxes, on Page 9 of 66. Contract pricing is inclusive of all applicable…taxes.
b) State sales taxes do not apply per federal immunity.
c) Federal excise tax does apply; no exemption per FAR 29.202.
d) FAR Clause 52.229-3 Federal, State, and Local Taxes (FEB 2013) is hereby incorporated into this solicitation and any resultant contract via this amendment. For clarity of application, its full text is included below:

It does not include social security tax or other employment taxes.
“After-relieved Federal tax,” means any amount of Federal excise tax or duty, except social security or other employment taxes, that would otherwise have been payable on the transactions or property covered by this contract, but which the Contractor is not required to pay or bear, or for which the Contractor obtains a refund or drawback, as the result of legislative, judicial, or administrative action taking effect after the contract date.
“All applicable Federal, State, and local taxes and duties,” means all taxes and duties, in effect on the contract date, that the taxing authority is imposing and collecting on the transactions or property covered by this contract.
“Contract date,” means the date set for bid opening or, if this is a negotiated contract or a modification, the effective date of this contract or modification.
“Local taxes,” includes taxes imposed by a possession or territory of the United States, Puerto Rico, or the Northern Mariana Islands, if the contract is performed wholly or partly in any of those areas.
(b)

(2) Taxes imposed under 26 U.S.C. 5000C may not be—
(i) Included in the contract price; nor
(ii) Reimbursed.

(d) The contract price shall be decreased by the amount of any after-relieved Federal tax.
(e) The contract price shall be decreased by the amount of any Federal excise tax or duty, except social security or other employment taxes, that the Contractor is required to pay or bear, or does not obtain a refund of, through the Contractor’s fault, negligence, or failure to follow instructions of the Contracting Officer.
(f) No adjustment shall be made in the contract price under this clause unless the amount of the adjustment exceeds $250.
(g) The Contractor shall promptly notify the Contracting Officer of all matters relating to any Federal excise tax or duty that reasonably may be expected to result in either an increase or decrease in the contract price and shall take appropriate action as the Contracting Officer directs.
(h) The Government shall, without liability, furnish evidence appropriate to establish exemption from any Federal, State, or local tax when the Contractor requests such evidence and a reasonable basis exists to sustain the exemption.
18) Due-date is extended to 3:30PM Pacific Daylight Time, Weddnesday, August 5, 2015.
19) See two chassis drawings below, included as basic reference materials.
