(2) Add Provision K-7, AGAR 452.209 – 70 Representation by Corporations Regarding an Unpaid Delinquent

Tax Liability or a Felony Conviction (Deviation 2012-01) (Feb 2012), Alternate 1 (Feb 2012);

Except as provided herein, all terms and conditions of the document referenced in Item 9A or 10A, as heretofore changed, remains unchanged and in full force and effect.

I-15 AGAR 452.209 – 71 Assurance Regarding Felony Conviction or Tax Delinquent Status for

Corporate Applicants (Deviation 2012-01) (Feb 2012) Alternate 1 (Feb 2012)

(a) This award is subject to the provisions contained in the Consolidated Appropriations Act, 2012 (P.L. No.

112-74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it –

(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and

(2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government.

(b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434.

(a.) Awards made under this solicitation are subject to the provisions contained in the Consolidated

Appropriations Act, 2012 (P.L. No. 112-74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. To comply with these provisions, all offerors must complete paragraph (1) of this representation, and all corporate offerors also must complete paragraphs (2) and (3) of this representation.

(3) The following questions have been received concerning this solicitation:

1) I was not sure where the mention of fringe rate comes from, as for professionals they would not get a fringe rate, as professionals. If you would like the professionals to get fringes, we need to determine what those are and put a number to it so all can bid on the same criteria. The non professionals are SCA, so they would get the H&W rate, correct?

A. Correct. The Forest Service is not requiring any fringe benefits for professional employees. The non-professionals are covered by the Service Contract Act (SCA).

2) Rates for the non SCA people…usually the proposal would include that, somehow being basically equivalent to the GS

Scale. If this were not provided, each company would have to determine this on their own and that would not be uniform in the bidding process.

A. An amendment will be issued providing the direct labor rates for the professional and non-professional employees.

3) Levels. On this bid there are 3 levels or "steps" on previous bids there were 5 steps.

A. Yes. Based upon our experience over the past three years, three skill levels will meet Forest Service requirements.

4) Breaking out the Overhead, G&A, and Profit. Had not seen that before, but it is fine to do it this way. In the past we have done a blended rate across all the skills. If you do it this way, there will be different markups due to mostly

Workmen's Comp reasons for example one person could have 23.55% markup and another would have a 29.95% markup, depending upon the exposure to injury depending upon the environment and skill each person would have.

We have this kind of contract with some commercial accounts, but not with Gov't entities. It might be difficult to manage all those markups and be confusing, maybe creating issues down the line.

A. Program managers who utilize temporary services employees with lower markups do not want to subsidize the programs utilizing temporary services employees with higher markups.

5) Is there a place where accommodation for payrolled vs recruited rate can be made? This bid is primarily for payrolling, correct?

A. Correct. This solicitation is for payrolling services. Over the past three years recruiting by the contractor has been raised as a possibilbe course of action, but was never pursued.

6) Will this mostly be in Washington State?

A. Yes, this requirement is only for the Olympic National Forest in Washington State.
