Periodically, the Contracting Officer may ask if the Contractors would like to reduce their unit prices on the schedule of items; the request will go to all Contractors awarded the contract.
Quoters must insert sub-unit prices on a item. If Quoters do not quote on all sub-units for an item, the Government may elect not to consider their quote.
The Government will place task orders based on funding, prescriptions and priorities of the Government. The Contractor will be paid for actual work ordered, completed and accepted per task order.
Issuance of Task Orders
Work will be ordered by Firm-Fixed Price Task Orders (TO) at the unit prices listed on the Schedule of Items through the effective period. Concurrent Task Orders may be issued. In addition, work may be done on any work area at the same time.

Additional Clauses to be added on page 20 of the solicitation.
Admininstration of Individual Project Task Orders
Wherever the term “contract” is used herein it shall be construed to apply equally to Individual Project Task Orders placed under the contract, as if each Individual Project Task Order was a separate contract. The Contractor shall refer all questions to the Contracting Officer if clarification is needed regarding the application of contract clauses to Individual Project Task Orders.
Each Individual Project Task Order is separable to the extent that it will be initiated, performed, administered, completed, and closed independently.
1. Individual Project Task Orders may have separate Contracting Officers, Contracting Officer’s
Representatives, and Inspectors.
2. Individual Project Task Orders will have unique performance terms and notices to proceed.
3. Individual Project Task Orders will have separate payments.
Process for Requesting Individual Project Quotes and Awarding Task Orders
(a) After award of the IDIQ Contract, the Individual Project Task Order awards shall follow the process established in this section.
(b) Task Order Packaging
These will be packaged with all necessary detailed requirements that supplement the basic contract, as required.
Each Task Order award may include the following:
• OF 347 (Order for Supplies or Services) or the SF 1449 (Solicitation / Contract / Order for Commercial Items):
• TASK ORDER Schedule of Items
• Statement of Work – Project Scope and Project Location
• Completion Date of Task Order
• Any Administrative Information, as required
• Special Contract Requirements – Supplements to the basic contract clauses if applicable. This will include: any use and operational period limitations, submittal requirements, and other details, as required.
• Attachments:
• Project Maps
• Road Lists
• Additional Evaluation Criteria, if required
(c) Source Selection for Award of Individual Projects
Source Selection for task orders will be based on price and past performance on previous task orders against this contract or best value or to meet work for the minimum guarantee).
Source selection on task orders may be based on price and past performance on previous task orders against this contract. Once the Government has identified the requirement and estimated quantities, the Government will calculate the price by multiplying the estimated quantities on the task order with the unit prices on the schedule of items of the contracts awarded. The Government will then determine who among the Contractors have the lowest price, verify availability with the Contractor and schedule, and award to the Contractor with the lowest price and who can meet the Government’s schedule. The Contractor does have the
Amendment 0001, AG-05G1-S-15-0023, IDIQ Presale Services, Page 10 option to propose lower unit pricing per task order. The Contractor will have three days from the notice to verify availability and if they can meet the Government’s schedule. If the Contractor does not verify availability, the Government will go to the next offeror. Since it is difficult to determine the actual work until work has been completed, the Government’s quantity will be estimated. The Government will issue a funding or not to exceed (ceiling price) task order. It is the Contractor’s responsibility not to exceed the amount without approval from the Contracting Officer. The Government is anticipating most task orders will be placed base on this method.
Source selection on other task orders may be based on the best overall value to the Government, price and other factors considered. These factors may include one or more of the following:
• Technical Capabilities relating to the specific project [including elements such as Project Sequencing, Scheduling, Resource Availability]
• Past Performance History [including elements such as quality of work, timeliness, effectiveness of Contractor Quality Control]
• Response to additional Evaluation Criteria including biobased, if required.
• The Contractor does have the option to propose lower unit pricing for the task order.
Individual Project Quote Responses
It is understood that the Contractor will be balancing their other commercial work with any proposed work under the awarded contract. Nonetheless there is a general expectation that Contractors will respond affirmatively to the majority of Individual Task Orders. Repetitive failure to respond may impact the source selection process for future Individual Project proposals.
Fair Opportunity
Each contract holder will be given fair opportunity for the Task Order issued.
If multiple awards were made for a zone and later circumstances result with only one Contractor left for that zone, fair opportunity need not be provided, if the Contracting Officer determined the fixed prices to be fair and reasonable at the time of award.
Ombudsman.
If a Contractor believes they are not being fairly considered for a particular Task Order, they may present the matter to the Contracting Officer. The Contractor may appeal the explanation or decision of the Contracting Officer to the Forest Service Ombudsman. The Ombudsman will review the Contractor’s complaint, and in coordination with the Contracting Officer, ensure that the Contractor is afforded a fair opportunity to be considered for the Task Order. Complaints to the USDA Forest Service Ombudsman must be forwarded to:
USDA Forest Service ATTN: Shawn O’Donnell Acquisition Management, Washington Office Rosslyn Plaza 1621 N Kent Street, Plaza E, Suite 707 Arlington, VA 22209 Phone (703) 605-4544
Individual Project Task Order Performance Period Requirements
The following clause FAR 52.211-10 shall apply to each individual Task Order. An estimated start work date will be included within the Task Order. The specific days/dates included under a Task Order will vary
Amendment 0001, AG-05G1-S-15-0023, IDIQ Presale Services, Page 11 considerable. The allowed performance completion period for individual projects will be dependent upon factors such as project size, complexity, available work periods limitations, dates of issuance and the Contractor’s information from his/her technical proposal.
FAR 52.211-10 Commencement Prosecution, and Completion of Work (APR 1984)
The Contractor shall be required to (a) commence work under any task orders within 3 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than performance time listed per Task Order. The time stated for completion shall include final cleanup of the premises.
Schedules for Task Orders
The Contractor shall at the post award conference meeting or within 3 days from receipt of any subsequent request from the Contracting Officer, submit a time chart or schedule of proposed progress to insure completion of the work within the time set forth in the contract. If Contractor's progress falls behind that scheduled, the Contractor shall take such action as necessary to improve his progress; in addition, the Contracting Officer may require Contractor to submit a revised schedule and proposed plan of work to ensure completion of the work within the time(s) set forth in the contract.
The Government reserves the right to prescribe the sequence of the work.
Task Order time, whether stated in terms of calendar days or a completion date, has made allowance for inclement weather, fire closure and seasonal shutdowns. Task Order time will run concurrently, if more than one task order is awarded to a Contractor, from issuance of the Notice to Proceed without suspension during periods when no work is performed. Contractor's progress will be measured against Contractor's approved progress schedule.
If the Contractor fails to meet the Government as agreed to, the Government may be charge damages for extra administration costs.
Rescheduling of Task Orders
If the Contractor cannot meet the estimated start work date, the Contractor shall notify the Contracting Officer within 72 hours. If possible, ordered work will be rescheduled with the Contractor. If rescheduling is not possible, the Government will secure the service from other sources to meet the required schedule.
If this happens more than two times, the information will be part of the past performance in determining who receives a task order.
