SCOPE OF WORK

The intent of this Contract is to provide daily assistance to keep these water and wastewater systems operational within the parameters of the Oregon State Department of Environmental Quality (ODEQ) Permits as outlined in the Technical Requirements below. The ODEQ permits are attached to this solicitation for reference purposes.

The Contractor will become the DEQ Permit “Operator of Charge” during the Contract period. The United States Forest Service (USFS) will complete all maintenance (work beyond Daily Administrative Work list below), repairs, and construction as needed to keep the system operational and as identified by the “Operator of Charge”.

TECHNICAL REQUIREMENTS

The work items shall include:

I. Daily Administrative Work. Period is for one year, plus one additional year, to be exercised at the Government’s discretion. It is estimated that it will take one operator up to four hours of total work on site each day, covering all six locations. Work on site does not include driving time to, from, or between locations.

1. Daily pump meter readings and record into log at all six locations.

2. Inspect major components, clean trash grates, filters and piping (minor maintenance) as needed to ensure normal operation.

3. Record surface level in chlorine storage tanks at both sewage treatment plants and the water system control building. Add chlorine when level becomes low.

4. Complete all required onsite sampling and testing. Drop off lab samples at the Waldport Ranger Station. Lab Courier will pick up samples at the Ranger Station.

5. Review readings and test results, and make any corrective adjustments/minor maintenance (i.e. valve adjustments, pipe flushing) needed to keep plants operating normally and within parameters of the DEQ permit.

6. Notify the Contracting Officer’s Representative (COR) or his designated representative of any repairs needed, events or immediate concerns that may cause a DEQ Notice of Violation or inability to complete tasks.

7. Compile data, and then complete, certify, and submit periodic DEQ and DOL (Department of Labor for Angell Job Corps only) reports.

8. Maintain working areas clean of trash and debris. Areas include but are not limited to pump-houses and sewage treatment plants.

9. Coordinate with COR purchases of supplies and materials, and services needed for daily administrative work (e.g. chlorine solution, trash collection, repairs, etc.).

10. Provide COR with invoices of any purchase or service orders.

II. System Alarms/Critical Service Backup during non-business hours 4:30 PM to 8:00 AM. It is estimated that it may take one operator from one to four hours of work for a single event, initiated at the call, and does include driving time to and from event location.

1. Respond on-site within 30 minutes of notice of alarm.

2. Contractor (Bidder) shall designate at least one operator to make themselves available to respond during non-business hours, 7 days a week.

3. Identify location of alarm and cause.

4. Determine if cause needs immediate corrective action and notify the COR of status and/or consult for further guidance. Contact the COR, Craig Evans, at (541) 750-7083, or his designated representative directly.

5. Correct cause to make system operate normally or until USFS can do repairs. Contact Craig Evans, or his designated representative for coordination and approval of any necessary service calls or purchases, e.g. coordinating a service call by contacting a local plumber to pull a pump and clear a clog or an electrician to correct faulty wiring or breakers.

6. Log event on a Work Order form provided by the USFS and submit the Work Order by fax or email within 24 hours of event.

7. Provide COR with invoices of any purchases or service orders.

System major maintenance, repairs, or parts replacement, and improvements to the systems will be done by the USFS and are not part of this scope of work. USFS will coordinate service orders for routine tank pumping.

III. Sewage Treatment Operator Training and Certification

1. Operators shall have experience managing and operating sewage treatment plants.

2. Operators shall be familiar with Water Pollution Control Facilities Permit (WPCF) requirements described under the Oregon Department of Environmental Quality (Oregon

DEQ).

3. Sewage Treatment Plant Operator(s) shall be certified to operate Sewage Treatment Systems in the State of Oregon. Operator(s) in charge shall be certified at the minimum level required by the Treatment System Class classification corresponding to each sewage treatment plant.

4. Operator(s) shall have formal training and at least one year of experience managing and operating Orenco Advantex Treatment Systems. Operator(s) shall be prepared to provide documentation of such training and experience upon request of the Contracting Officer.

IV. Water System Operator Training and Certification

1. Water system operator(s) shall have experience managing and operating water systems. In addition, operator(s) shall take training through the Oregon Health Authority to obtain a Small Water System Operator Certification. Operator(s) shall be prepared to provide documentation of such training and experience upon request of the Contracting Officer.

COMMON IDENTIFICATION STANDARD FOR CONTRACTORS

All applicable contractor employees requiring routine physical access to Federally-controlled facilities or routine access to Federally-controlled information systems must go through the identity proofing and registration process, and must have been successfully identity proofed, and have a successfully adjudicated National Agency Check with (Written) Inquiries (NACI) or Office of Personnel Management (OPM)/National Security (NS) Background Investigation (BI) to serve on the contract. In addition, contractor employees must complete the spreadsheet for Non-Employee Indentify System (NEIS).

The Contracting Officer designates the Contracting Officer's Representative (COR).

The COR is responsible for administering the performance of work under this contract. The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government, which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract.)

On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.

I-2 SYSTEM FOR AWARD MANAGEMENT MAINTENANCE (FAR 52.204-13) (JUL 2013)

(a) Definition. As used in this clause--

“Data Universal Numbering System (DUNS) number” means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities, which is used as the identification number for Federal Contractors.

“Data Universal Numbering System+4 (DUNS+4) number” means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at subpart 32.11) for the same concern.

“Registered in the System for Award Management (SAM) database” means that—

(1) The Contractor has entered all mandatory information, including the DUNS number or the DUNS+4 number, the Contractor and government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14), into the SAM database;

(2) The Contractor has completed the Core, Assertions, Representations and Certifications, and Points of Contact sections of the registration in the SAM database;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The Contractor will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record “Active”.

“System for Award Management (SAM)” means the primary Government repository for prospective Federal awardee and Federal awardee information and the centralized Government system for certain contracting, grants, and other assistance-related processes. It includes—

(1) Data collected from prospective Federal awardees required for the conduct of business with the Government;

(2) Prospective contractor-submitted annual representations and certifications in accordance with FAR subpart 4.12; and

(3) Identification of those parties excluded from receiving Federal contracts, certain subcontracts, and certain types of Federal financial and non-financial assistance and benefits.

(b) The Contractor is responsible for the accuracy and completeness of the data within the SAM database, and for any liability resulting from the Government’s reliance on inaccurate or incomplete data. To remain registered in the SAM database after the initial registration, the Contractor is required to review and update on an annual basis, from the date of initial registration or subsequent updates, its information in the SAM database to ensure it is current, accurate and complete. Updating information in the SAM does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.

(c)

(1)

(i) If a Contractor has legally changed its business name, doing business as name, or division name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day’s written notification of its intention to—

(A) Change the name in the SAM database;

(B) Comply with the requirements of subpart 42.12 of the FAR; and

(C) Agree in writing to the timeline and procedures specified by the responsible Contracting Officer. The Contractor shall provide with the notification sufficient documentation to support he legally changed name.

(ii) If the Contractor fails to comply with the requirements of paragraph (c)(1)(i) of this clause, or fails to perform the agreement at paragraph (c)(1)(i)(C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the SAM information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the “Suspension of Payment” paragraph of the electronic funds transfer (EFT) clause of this contract.

(2) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the SAM record to reflect an assignee for the purpose of assignment of claims (see FAR subpart 32.8, Assignment of Claims). Assignees shall be separately registered in the SAM. Information provided to the Contractor’s SAM record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the “Suspension of Payment” paragraph of the EFT clause of this contract.

(3) The Contractor shall ensure that the DUNS number is maintained with Dun & Bradstreet throughout the life of the contract. The Contractor shall communicate any change to the DUNS number to the Contracting Officer within 30 days after the change, so an appropriate modification can be issued to update the data on the contract. A change in the DUNS number does not necessarily require a novation be accomplished. Dun & Bradstreet may be contacted—

(i) Via the internet at http://fedgov.dnb.com/webform or if the Contractor does not have internet access, it may call Dun and Bradstreet at 1-866-705-5711 if located within the United States; or

(ii) If located outside the United States, by contacting the local Dun and Bradstreet office.

(d) Contractors may obtain additional information on registration and annual confirmation requirements at https://www.acquisition.gov.

(End of Clause)

I-3 FAR 52.217-8 -- OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor at any time during contract performance.

(End of Clause)

I-4 FAR 52.217-9 -- OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within the time specified in the Schedule; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 2 years.

(End of Clause) http://fedgov.dnb.com/webform https://www.acquisition.gov/

I-5 FAR 52.219-28 POST-AWARD SMALL BUSINESS PROGRAM

REREPRESENTATION (JUL 2013)

(a) Definitions. As used in this clause--

Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is “not dominant in its field of operation” when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
