(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in paragraphs (e)(1) of this paragraph in a subcontract for commercial items. CONTRACT DOCUMENTS, EXHIBITS OR ATTACHMENTS
FACSIMILE PROPOSALS (FAR 52.215-5)(OCT 1997)
(a) Definition. "Facsimile proposal," as used in this provision, means a proposal, revision or modification of a proposal, or withdrawal of a proposal that is transmitted to and received by the Government via facsimile machine.
(b) Offerors may submit facsimile proposals as responses to this solicitation. Facsimile proposals are subject to the same rules as paper proposals.

(d) If any portion of a facsimile proposal received by the Contracting Officer is unreadable to the degree that conformance to the essential requirements of the solicitation cannot be ascertained from the document--
(1) The Contracting Officer immediately shall notify the offeror and permit the offeror to resubmit the proposal.
(2) The method and time for resubmission shall be prescribed by the Contracting Officer after consultation with the offeror; and
(3) The resubmission shall be considered as if it were received at the date and time of the original unreadable submission for the purpose of determining timelines, provided the offeror complies with the time and format requirements for resubmission prescribed by the Contracting Officer.
(e) The Government reserves the right to make award solely on the facsimile proposal. However, if requested to do so by the Contracting Officer, the apparently successful offeror promptly shall submit the complete original signed proposal.

POST AWARD CONFERENCE (AGAR 452.215-73)(NOV 1996)
A post award conference with the successful offeror is required. It will be scheduled and held within 15 days after the date of contract award. The conference will be held at the Headquarters of the Siuslaw National Forest, 3200 SW Jefferson Way, Corvallis, OR, or at the District Ranger Station.

DESIGNATION OF CONTRACTING OFFICER'S REPRESENTATIVE
The Contracting Officer designates the Contracting Officer's Representative (COR).
The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.
The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government, which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract.)
On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer.
Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.
SUPERINTENDENCE BY THE CONTRACTOR (FAR 52.236-6)(APR 1984)
At all times during performance of this contract and until the work is completed and accepted, the Contractor shall directly superintend the work or assign and have on the worksite a competent superintendent who is satisfactory to the Contracting Officer and has authority to act for the Contractor.
NOTIFICATION OF SUBCONTRACTING
The Contractor shall promptly notify the Contracting Officer upon entering into any subcontract arrangement.
The notification shall include as a minimum:
1. The name, address, and telephone number of the subcontractor.
2. The date upon which the subcontract was entered into and its duration.
3. A detailed description of the work being subcontracted including a listing of contract items, units, etc., as appropriate.
COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (FAR 52.211-10) (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 3 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than times listed below. The time stated for completion shall include final cleanup of the premises.
PERIOD OF PERFORMANCE
The period of performance of this contract is from the effective date of the Notice to Proceed through December 31, 2013.
OPTION TO EXTEND THE TERM OF THE CONTRACT (FAR 52.217-9) (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 45 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed three years.
SCHEDULES FOR SERVICE CONTRACTS
The Contractor shall provide a proposed work schedule in their proposal as described under 52.212-2 Evaluation – Commercial Items to insure completion of the work within the time set forth in the contract. If the Contractor's progress falls behind that scheduled, the Contractor shall take such action as necessary to improve progress; in addition the Contracting Officer may require the Contractor to submit a revised schedule and proposed plan of work to ensure completion of the work within the time(s) set forth in the contract.
PROSECUTION OF WORK
(a) Work shall be scheduled to provide completion of segments on a daily basis unless otherwise herein provided. Refer to the Schedule of items for seasonal restrictions that will dictate the priority of units to be completed first.
(b) A Work Schedule shall be prepared by the Contractor based on priorities provided in the contract unless superseded by the Contracting Officer in advance of work.
(c) The Contracting Officer may require the Contractor to finish the portion in progress before additional work is started on any additional portion.
(d) The Contractor shall use measures and precautions necessary to warn and protect the public and Government personnel and equipment during work at the project site. Such actions include, but are not limited to, furnishing and maintaining barricades and signs around the work site.
(e) The Contracting Officer may, in writing, require the Contractor to remove from the work any employee found to be working in an unsafe manner.
CONTRACTOR QUALITY CONTROL PLAN
A. Quality Control Plan
The Contractor shall provide a Quality Control Plan (QCP) as part of this Technical Proposal. The Plan must demonstrate how the Contractor shall assure that quality of performance meets the objectives and requirements of the contract. The QCP shall specify:
- How quality will be monitored to ensure performance standards are met.
- How the work will be supervised.
- How results of the monitoring will result in quality performance.
- Identify the personnel responsible for performing quality control.
B. Contractor Quality Control Inspection
The Contractor shall assure themselves that performance meets contract specifications, in accordance with FAR 52.212-4, Contract Terms and Conditions -- Commercial Items, paragraph (a), prior to requesting the Government to inspect for payment or acceptance. The Contractor shall contact the Contracting Officer upon completion of a unit. The Contracting Officer may observe the Contractor’s inspection at any time and shall otherwise have unlimited access to the inspection data.
GOVERNMENT QUALITY ASSURANCE SURVEILLANCE PLAN
The Government will conduct inspections of each unit to determine work quality. Initial inspections will consist of a 100 percent visual inspection and will be based on adherence to contract technical specifications.
SUSPENSIONS OF WORK FOR OTHER THAN GOVERNMENT'S CONVENIENCE
The Contracting Officer may issue orders to suspend the work wholly or in part for such period of time as deemed necessary because of: (1) weather or ground conditions when further prosecution of the work might cause environmental or resource damage to the project, access roads to the project, or adjacent property. Such action would include but not be limited to instances such as siltation of streams, damage to access roads, rutting of project roads which causes otherwise suitable soils to be muddy or unsuitable; or (2) failure of the Contractor to comply with specifications such as but not limited to placement of frozen material in fills, placing of asphalts at temperatures lower than those specified, performing work prior to prerequisite approvals, operating equipment not meeting fire requirements, or when conditions exist which do not meet safety requirements. Whether or not a suspend work notice is issued, the Contractor shall be responsible for correcting any damage caused by its operation, whether inside or outside project limits, at no cost to the Government. Such suspensions shall not be considered as suspensions for the Convenience of the Government under FAR 52.242-14, Suspension of Work, and shall not qualify for an equitable adjustment.
LANDSCAPE PRESERVATION
The Contractor shall give attention to the effect of contract operation upon the landscape, shall take care to maintain natural surroundings undamaged, and shall conduct the work at all times in compliance with the following requirements:
a. Prevention of the Landscape Defacement. The Contractor shall not remove, deface, injure, or destroy trees, shrubs, lawns, or natural features unless specifically authorized by the Government. Unless otherwise provided, the Contractor shall confine contract operations to within the areas designated in contract documents.
Unless otherwise provided in this contract, the Contractor shall gather rock, which falls outside the roadway due to contract operations and dispose of it as directed, by the Government.
b. Protection of Streams, Lakes, and Reservoirs. The Contractor shall take sufficient precautions to prevent pollution of streams, lakes, small ponds, and reservoirs with fuels, oils, bitumen, dust palliatives, silt, or other harmful materials. Mechanical equipment shall not be operated in live streams without written approval of the Government. If a petroleum spill should take place in the water, the Contractor shall immediately notify the COR and the Oregon Emergency Response System (OERS), telephone 1-800-452-0311 or 1-503-378-4124.
PROPERTY AND PERSONAL DAMAGE
(a) The Contractor shall use every precaution necessary to prevent damage to public and private property.
Land monuments and property markers shall not be disturbed until the Contracting Officer, or his/her representative, has witnessed or otherwise referenced their location and directed their removal.
(b) The Contractor shall be responsible for all damage to property and to persons, including third parties, that occur as a result of his/her agent's or employee's fault or negligence. The term "third parties" is construed to include employees of the government.
PUBLIC OFFICIALS NOT PERSONALLY LIABLE
There shall be no personal liability upon the Contracting Officer or officer in charge, their agents or employees, for any act performed in the discharge of any duty imposed or the exercise of any power or authority conferred upon them, by, or with the scope of the contract, it being understood that in all such matters they act solely as agents and representatives of the Government.
TRASH AND REFUSE MATERIAL
Contractor shall remove all of his/her own trash and refuse from the contract area. Material to be removed includes, but is not limited to: used engine oil, oil filters, oil cans, grease cartridges, camp refuse such as tin cans, paper garbage, etc. All placement of sanitary facilities will require prior approval of the Contracting Officer.
STORAGE OF MATERIALS AND EQUIPMENT
Materials shall be stored to assure the preservation of their quality and fitness for work. Approved portions of the right-of-way or other areas on Government land may be used for storage purposes. All storage sites approved by the Government shall be restored to a satisfactory condition at the Contractor's expense.
POTENTIAL SAFETY HAZARDS
(a) Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor. This list shall not be deemed to be all inclusive. The Contractor shall bear the sole responsibility for taking all appropriate actions necessary to prevent accidents and injuries to individuals at the worksite.
(b) The following checked activities have been identified by the Government as potential safety hazards.
[ ] Confined space entry.
[ ] Temporary excavation/deep trenching/slope stability.
[ ] Tree falling.
[ ] Fall hazard from work heights exceeding six feet.
[ ] Blasting.
[ ] Traffic control on high-volume and/or high-speed and/or limited visibility roads.
[ ] Heavy equipment operation.
[ ] Tree climbing and/or tower climbing.
[ ] Fire hazards.
(X) Hazardous materials handling
[ ] Electrical hazard.
[ ] Hydraulic and/or pneumatic and/or other high pressure hazards.
[ ] Mechanical hazards such as pulleys, springs, etc.
[ ] Other: Uneven ground conditions.
KEY PERSONNEL
Key personnel are those personnel (Project Manager, supervisor, equipment operators, etc.) considered essential for successful completion of this contract. All key personnel shall be identified in the Contractor’s Technical Proposal.
The Contractor agrees that assigned key personnel shall not be removed, substituted, or reassigned to another task without the written concurrence of the Contracting Officer. The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed personnel change and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. If the Contracting Officer determines that suitable replacement of key personnel is not feasible or that the reduction of effort would be so substantial as to impair the successful performance of the work, the Contractor may be subject to default action under the affected task order(s) or the contract. Ultimate approval/disapproval to replace key personnel is the responsibility of the Contracting Officer.
EMERGENCY CONTROL (AGAR 452.236-77) (NOV 1996)
(a) Contractor's Responsibility for Fighting Fire. (1) The Contractor, under the provisions of FAR clause 52.236-9, PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES, AND IMPROVEMENTS, shall immediately extinguish, all fires on the work site other than those fires in use as part of the work. (2) The Contractor may be held liable for all damages and for all costs incurred by the Government for labor, subsistence, equipment, supplies, and transportation deemed necessary to control or suppress a fire set or caused by the Contractor or the Contractor's agents or employees.
(b) Contractor's Responsibility for Notification in Case of Fire. The Contractor shall immediately notify the Government of any fires sighted on or in the vicinity of the work site.
(c) Contractor's Responsibility for Responding to Emergencies. When directed by the Contracting Officer, the Contractor shall allow the Government to temporarily use employees and equipment from the work site for emergency work (anticipated to be restricted to fire fighting). An equitable adjustment for the temporary use of employees and equipment will be made under the CHANGES clause, FAR 52.243-1. *

INSURANCE COVERAGE (AGAR 452.228-71)(NOV 1996)
Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:
(a) Workers Compensation and Employer’s Liability. The Contractor is required to comply with applicable Federal and State workers’ compensation and occupational disease statues. If occupational diseases are not compensable under those statutes, they shall be covered under the employer’s liability section of the insurance policy, except when contract operations are so commingled with the Contactor’s commercial operations that it would not be practical to require this coverage. Employer’s liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker’s compensation to be written by private carriers.
(b) General Liability. The Contractor shall have bodily injury liability insurance coverage written on a comprehensive form of policy of at least $500,000 per occurrence.
(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.
(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for

passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

ATTACHMENT 1 – DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
Section 1-General
The purpose of this contract is to procure a contractor to manage all aspects of the Beaver Creek Seed Orchard with the primary emphasis being the care, maintenance, as needed watering, fertilizing, cone pesticide spraying, and weeding of the planted Western Red Cedar and Douglas Fir trees. Other duties include, but are not limited to: ability to work with minimal supervision; maintenance, operation, and repair of the existing drip irrigation system; seedling measurement exams; vegetation management using herbicides and manual techniques; grafting and graft maintenance; topping selected cedar trees for cone production; pruning; slash disposal; performing work needed in the all of the tree blocks; mowing; maintenance of the buildings, big game fence, toilets, and water systems; other minor repairs and maintenance; coordination with other agencies, public and private;
ability to work a flexible schedule
This job is basically a one-person operation that may require the contractor to be on the site up to 7 days a week to care for the seed orchard. The contractor must have a commercial pesticide operator and applicators license from the state of Oregon.
The Orchard is a 65-acre facility and includes 13 different blocks of seedlings/trees, ranging in age from 2 years to 35 years. An office/warehouse and 3 other buildings on the site are in need of varying degrees of maintenance.
The selected contractor shall, considering given resource objectives, develop a Project Work Plan that describes how the objectives will be accomplished. Based on the approved Project Work Plan, the contractor’s performance will be evaluated monthly by the designated official. In general, this is considered to be a one-person operation, with approval to use subcontractors to accomplish up to 30% of the required work.
This is a contract for services, with the Forest Service providing some of the materials/supplies/equipment. The list of the FS provided items can be found in Section 3.
LOCATION AND DIRECTIONS
The Beaver Creek Seed Orchard, a 65-acre Forest Service Administrative Site, is located approximately 15 miles southwest of Corvallis, Oregon.
-From Corvallis, OR, follow Highway20/34 westerly approximately 2 miles to 53rd street (traffic signal), turn left;
-Drive south on 53rd for approx. 1 mile to Plymouth road, turn right;
-Drive west on Plymouth road approx. 1.5 miles until reaching Bellfountain Rd (stop sign), turn left;
-Drive south on Bellfountain road for 5.2 miles until reaching Decker road (Inavale School is on the right); turn right;
-Drive west on Decker road for approx. 3 miles until reaching Beaver Creek road, turn left;
-Drive on Beaver Creek road for approx 1.4 miles until reaching the Beaver Creek Seed Orchard sign, turn right; this is the entrance to the Orchard.
-Drive on this paved road for approx. ¼ mile until encountering a locked gate.
Accessibility: Except for the final ¼ mile, the Orchard is accessible via state and county maintained roads.
Deliveries or Performance
Work Schedule
250 hours: Monthly hours may vary by 30%, but 250 hours of work must be completed within the contract time period.
1. January 1st through April 30th: 48 hours (12 hours/month)
2. May 1st through October 31: 178 hours (30 hours/month)
3. November 1st through December 31st: 24 hours (12 hours/month)
Hours worked per month may vary up to 30%, but a minimum of 250 hours of work must be completed by December 31st, 2013 and any option year period exercised.
Work to be accomplished during specific time periods will be identified in the approved Project Work Plan
Basis of Payment
Following satisfactory inspection results, payments will be made on a monthly basis as shown on the Schedule of Items.
Section 2- Definitions
Block: A designated area of trees/seedlings, measuring approximately 4 acres. There are 13 blocks in the Orchard.
DFR: Douglas Fir Rootstock, located in block #5.
Drip Irrigation System: A system for delivering 1-2 gallons of water an hour directly to individual trees/seedlings. The system includes: A well pump, a water holding tank, a pump and a 2 inch “mainline” pipe to deliver the water to the desired blocks, ½ inch and ¾ inch delivery lines, gate valves to control the flow of water to different areas, and “drip emitters” at each tree/seedling.
Emitters: Small fittings that emit water to individual seedlings at a rate of 1-2 gallons per minute.
FS: United States Forest Service
Mainline: 2-inch diameter pipe that supplies water to the WRC and DFR blocks.
Project Work Plan: A Plan submitted by the selected contractor and approved by the FS Zone Geneticist.
SNC: Swiss Needle Cast
WRC: Western Red Cedar, located in block #4.
Section 3-Government Furnished Property and Services
3.1 Equipment Repair Services: None provided.
3.2 Pesticides: The Forest Service will provide the needed pesticides. Pesticides must be applied by an Oregon state certified applicator. The contractor must also be a certified commercial applicator.
3.3 Pump, pump repairs and pump replacement: The Forest Service will schedule and provide any needed repairs/replacement of well/pump related equipment.
3.4: Small engine powered equipment: No equipment provided.
3.5: Hand tools: None provided except those already on site.
Section 4 - Tasks and Critical Subtasks
Maintenance of the Western Red Cedar (Block #4) – less than 400 trees.
-Evaluation and implementation of cone collections -Control weedy vegetation using herbicides.
-Perform an annual exam and record the information on a Spreadsheet -Apply 20-20-20 fertilizer once per growing season -Re-top annually all of the trees designated as females, to the height of 7 feet.
-Prune lower limbs, as needed to allow for mowing and herbicide applications -Remove limbs/slash to a designated burn pile location -Mow twice annually: Late Spring and early Summer. Weather permitting.
-Perform animal control procedures, as needed. This work may involve a combination of either adding tubes;
filling in rodent holes; and effectively placing bamboo sticks as a deterrent to deer browsing.
-Perform tube maintenance -Perform number tag maintenance. (Replace missing ones.)
-Irrigate, as needed.
-Maintain drip irrigation system, as needed.
-Maintain 2 inch mainline, which is the water source to this block.
-Document all activities and keep the COR informed.
Block #5: Doug Fir, which was planted in 2002 – less than 400 trees -Perform an annual exam and record information on a Spreadsheet -Mow once during the grass growing season, either in late Spring or early Summer, whenever it is most effective.
-Apply 20-20-20 fertilizer once per growing season

-Continue to prune one whirl of “rootstock” limbs per season until only grafted material remains. Also, prune “rootstock” leaders that are competing with the grafted leaders.

Mowing, other than Blocks #4 and #5 -Mow the upper half of Block #1 (approx. 2 acres) -Mow a strip on each side of the access road, once per season, from the gate to Block #5
Fireline Maintenance (A cleared dirt strip, 3 feet wide.)
-Annually, prior to July 1, or otherwise agreed, reconstruct the fireline from the entrance gate, clockwise, to the NW upper corner of Block #5. Estimated distance: 4500 feet.
-Annually, prior to July 1, or otherwise agreed, reconstruct the additional fireline along the bottom of Blocks #4 and #5, along the east side of Block #4, and the west side of Block #5. Estimated distance: 1600 feet.
Facilities -Inspect and maintain the 8 feet high game fence that surrounds the entire Orchard.
-Maintain the Orchard office building. Keep the office area neat and orderly and keep the bathroom clean.
Notify COR when repairs to the water or electrical systems are needed.
-Keep the access road cleared adequately to allow for passenger car vehicle passage.
Coordination with other agencies, public or private -Coordinate and make contact with other organizations that have activities on the site -Be the coordinator/laison for all activities on the site
Communication with Forest Silviculturist monthly, or more often is needed
Pruning established Orchard trees -Prune trees in other Blocks, as directed, and as time permits. This is a low priority.
Other duties as assigned Perform these duties as directed as long as they are within the scope of the contract and do not require the contractor to exceed the total of 250 hours of work per year.
Section 5 - Inspection and Acceptance
Procedures: Based on the approved Project Work Plan, on the last day of each month the contractor will submit documentation of work accomplished to the COR for inspection. Results of this inspection will be provided to the contractor within 10 calendar days. In addition, periodic inspections may occur while work is in progress.

Due to the nature of this project, a quantitative evaluation is not always possible. Therefore, the inspection results may include a combination of specific work accomplished in conjunction with a quality evaluation from the COR or his designated representative.
Unsatisfactory work: Work found to be unsatisfactory shall be reworked or corrected within 10 days of the contractor receiving written notice of unsatisfactory work.

FIRE PROTECTION AND SUPPRESSION
1. Fire Period and Closed Season
Specific fire prevention measures are listed below and shall be effective for the period April 1 to October 31 of each year. The Forest Service may change the dates of said period by advance written notice if justified by unusual weather or other conditions. Required tools and equipment shall be kept currently in serviceable condition and immediately available for initial attack on fires.
2. Fire Plan
Before starting any operations on the project, the Contractor, Permittee, Licensee, or Purchaser, hereinafter referred to as the "Contractor," shall prepare a fire plan in cooperation with the Contracting Officer providing for the prevention and control of fires in the project area.
The Contractor shall certify compliance with fire protection and suppression requirements before beginning operations during the fire period and closed season, and shall update such certification when operations change.
3. Substitute Measures
The Contracting Officer may by written notice authorize substitute measures or equipment or may waive specific requirements during periods of low fire danger.
4. Emergency Measures
The Forest Service may require emergency measures, including the necessary shutting down of equipment or portions of operations in the project area during periods of fire emergency created by hazardous climatic conditions.
5. Fire Control
The Contractor shall, independently and in cooperation with the Forest Service, take all reasonable action to prevent and suppress fires in the project area. Independent initial action shall be prompt and shall include the use of all personnel and equipment available in the project area.
For the purpose of fighting forest fires on or in the vicinity of the project which are not caused by the Contractor's operations, the Contractor shall place employees and equipment temporarily at the disposal of the Forest Service. Any individual hired by the Forest Service will be employed in accordance with the Interagency Pay Plan for Emergency Firefighters. The Forest Service will compensate the Contractor for equipment rented at fire fighting equipment rates common in the area, or at prior agreed to rates.

6. Compliance with State Forest Laws
Listing of specific fire precautionary measures herein is not intended to relieve the Contractor in any way from compliance with the State Fire Laws covering fire prevention and suppression equipment, applicable to operations under this contract, permit or license.
7. Fire Precautions
Specific fire precautionary measures are as follows:
a. Smoking and Open Fires
Smoking and fires shall be permitted only at the option of the Contractor. The Contractor shall not allow open fires on the project area without advance permission in writing from Forest Service.
Unless restricted by State Law or Federal Regulation, smoking shall be permitted only in such portions of the project area that are free of flammable material.
