Bond Premiums: Payment for bond premiums in accordance with Clause 52.232-5, Payments under Fixed-Price Construction Contracts shall not be in addition to the contract price. Include bond payments under 15101 Mobilization.
A bid bond (20% of total bid price) is required for this solicitation. A performance (100%) and payment bond (100%) are required within 10 days after contract award.

SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
C-1 General Scope of Contract/Description of Work
This project consists of demolition of the existing 2 span log stringer bridge and pier, including the existing approach fill. Removal of man-made materials from the existing bridge including treated timber. Construction of new 109.5’ span steel truss bridge including the design, fabrication, delivery and installation. Construction of the geocell and precast concrete abutments, stone armor and retaining walls, and approach embankment. Cutting hazard trees in the construction area and relocating them downstream of the new bridge. The use of a helicopter to aide in the construction is anticipated.
C-2 Project Location
The project is located on the Diamond Lake Ranger District of the Umpqua National Forest.
From Roseburg, Oregon travel east on State Highway138E for 73 miles. Turn left onto Forest Service Road 2610 and travel approximately 5.5 miles to the Lemolo Falls Trailhead (left across the canal bridge). Walk NW (downriver) for approximately 2.5 miles on the North Umpqua Trail #1414 to the bridge site. The bridge site is located near Latitude 43.355, Longitude 122.2267 and Elevation 3520 feet. The Lemolo Forebay #1 Helispot is located near Latitude 43.361, Longitude 122.2194 and Elevation 4120 feet.
C-3 AGAR 452.211-73 Attachments to Statement of Work/Specifications (FEB 1988) The attachments to the Statement of Work/Specifications listed in Section J are hereby made part of this solicitation and any resultant contract.
C-4 Federal Highway Administration Standard Specification for Construction of
Roads and Bridges
The Federal Highway Administration Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects, FP-03 U.S. Customary Units are included by reference.
The requirements contained in these specifications are hereby made a part of this solicitation and any resultant contract.
Standard and Supplemental Specifications for FP-03 shown in the specification listing contained in the attachments are applicable to this contract. All specifications not included in the specification listing but referenced by listed specifications, are applicable. The Supplemental Specifications shown on the specification list are physically attached.
C-5 AIRCRAFT USE
The contractor shall advise the CO of any intent to utilize aircraft in the performance of this contract at least 30 calendar days prior to planned use. Special requirements will apply to all work associated with aircraft, including compliance with current U.S. Forest Service guidelines for aviation management.
C-5.1 Certifications and Operations
If whole or part of the work utilizes aircraft to accomplish the end product then the Contractor or the Subcontractor shall be currently certified by the FAA and operate under Federal Aviation Regulation Aircraft Operations.
The contractor will certify that:
A. Pilots and Aircraft are currently certified and licensed under the FAA and operate under Federal Aviation Administration (CFR 14) , as applicable, to perform the proposed work:
Part 133 for external load operations Part 135 for transport of personnel Part 137 for agriculture operations
B. Contractors and pilots will perform in accordance with Part 91, “for hire” standards (FAR 91.409), for work that does not require specific FAA certificates or authorizations.
C. Contractors will report any condition, observance, maintenance problem, act or circumstance which has the potential to cause an aviation-related mishap to the CO and/or COTR. The CO or COTR will notify the Local Unit Aviation Officer to confirm the need for filling a SAFECOM (Aviation Safety Communique, Form FS 5700-14, January 96).
D. Contractor's flight crews and aviation related ground personnel shall wear personal protective equipment as specified by Industry and State Occupational Safety and Helath Standards.
E. The Government shall provide the Contractor, Government-furnished property described as follows:
1. Maps of project locations including pre-approved landing location.
2. There may be special flight routes designated due to sensitive areas, water sources and identified known hazards. These will be designated and provided on project hazard maps.
3. The Contractor is responsible for all clean up of fuel, oil, and/orcontamination on airport ramps, retardant sites, parking areas, landing areas, etc., when caused by Contractor equipment or personnel.
C-5.2 Contractor’s Obligations
The Contractor shall furnish all labor, supervision, transportation, materials, tools, supplies, and incidentals required to accomplish contract objectives, unless specified as Government responsibility elsewhere herein, including but not limited to:
A. The Contractor is responsible to retrieve any lost loads (dropped or jettisoned) during the operation of this contract and shall be responsible for any damages that occur as a result (directly or indirectly) of dropping or jettisoning of such loads.
B. Radio communications, air to ground, be maintained during flights operations.
C. Equipment move-in, move-out, moves of ground equipment as well as transportation for all Contractor –furnished materials between service areas. Contractor shall be responsible for safety precautions, dust abatement measures and fuel hazardous waste spill response.
D. Dust abatement methods and materials must meet Government approved necessary for safe operations. Material other than water will require approval by the Contracting Officer before application.
E. Identification and removal of hazard trees or snags as needed to assure safe operations within the project area prior to beginning yarding operations. Hazard tree or snag removal is subject to the Contracting Officer's approval. Directional felling of hazard trees or snags will be required.
F. Furnish adequate safety warning signs and flaggers with communication frequencies separate from air to ground when operations will be transecting roads, trails or other identified access routes.
G. The Contractor is responsible to ensure that all activities do not cause environmental damage to property or facilities. The Contractor is responsible to clean and rehabilitate areas adversely affected by Contractor activities and shall, whenever practical and possible, utilize solvents and cleaning agents that are either biodegradable or consistent with acceptable safety, health and environmental concern practices.
C-5.3 Equipment
Equipment shall be furnished on a fully-operating basis, of modern design and in good operating condition.
C-5.4 Contractor Aviation Requirements
If an aircraft is used to complete the project, the Contractor shall submit to the Contracting
Officer a report of aircraft use in the following format.

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than _October 15, 2015. The time stated for completion shall include final cleanup of the premises.
The completion date is based on the assumption that the successful offeror will receive the notice to proceed by July 15, 2014. The completion date will be extended by the number of calendar days after the above date that the Contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the Contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.
F-3 AGAR 452.236-75 Maximum Workweek – Construction Schedule
(a) Construction activity shall be limited to the hours between 7:00 a.m. and 7:00 p.m., Monday through Friday, unless other hours are approved in writing by the Contracting Officer. The Contractor shall conduct activities so that interference with the public shall be kept at a minimum. The project site shall be open to public access, except for the closure period, and free of hazards. Closure of the trail is allowed 100 feet each side of the bridge for up to 14 days. Any activities requiring closure to the public shall be scheduled with the COR at least 14 days in advance.
(b) The Contractor shall use measures and precautions necessary to warn and protect the public and
Government personnel during work at the project site. Such actions include, but are not limited to, furnishing and maintaining barricades and signs around the work site and roping off the area.
(c) During construction, streamflow at Lemolo Dam can be regulated to no more than 90 cubic feet per second (CFS) for a period of 7 days. Regulation of the flow shall be scheduled with the COR at least 14 days in advance. Additional reduction in regulated flow may be possible for a few days. Make request to the COR at least 14 days prior to the anticipated reduced flow period.
(d) Complete all on site construction activities between July 15 and October 15, 2014 and July
15 and October 15, 2015, except as otherwise approved by the CO.
SECTION G--CONTRACT ADMINISTRATION DATA
G-1 AGAR 452.215-73 Post Award Conference (NOV 1996)
A post award conference with the successful offeror is required. It will be scheduled and held within 30 days after the date of contract award. The conference will be held at a mutually agreed upon location.
G-2 Contract Release

G-4 DESIGNATION OF CONTRACTING OFFICER'S REPRESENTATIVE
The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract. The
Contracting Officer should be informed as soon as possible or any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract.)
On all matters that pertain to the contract terms the Contractor must communicate with the Contracting
Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.

SECTION H--SPECIAL CONTRACT REQUIREMENTS
H-1 FAR 52.236-4 Physical Data (APR 1984)
Data and information furnished or referred to below is for the Contractor's information. The
Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.
(a) The indications of physical conditions on the drawings and in the specifications are the result of site investigations by surveys.
(b) Weather conditions:
Discharge in July of 2012 was an emergency release. Typical discharge is between 80 CFS and 90
CFS during the month of July. This gaging station is just below the confluence of White Mule Creek and is about 2.7 miles upstream of the bridge location.
(c) Transportation Facilities include paved Forest Service Road 2610 to the Trailhead and

H-2 INDUSTRIAL CAMPS
Forest Service regulations for Use of Campgrounds prohibit occupancy of developed recreation sites for other than primarily recreation purposes. No industrial camping will be authorized at these sites.
A special use permit is required on National Forest land for industrial camps. These permits are to be obtained by the Contractor through the Contracting Officer. Such permission, if granted, will be without charge to the Contractor but may include use restrictions.
One self-contained camp unit will be allowed at each staging area and equipment or supply dump for use by a watchman.
H-3 SALVAGE RIGHTS
Contractor salvage rights exist under the contract.
H-4 SPECIAL EQUIPMENT CLEANING REQUIREMENTS
All earth moving equipment (loaders, excavators, dump trucks, etc.) moved to the job site shall be cleaned of weeds and their seeds prior to each entrance onto the National Forest lands. Cleaning shall consist of the removal of all dirt, grease, debris, and materials that may harbor noxious weeds and their seeds. This may require the use of a pressure hose.
Equipment shall be made available for visual inspection by the Forest Service prior to entering Forest
Service lands. The Contractor shall advise of a proposed date for mobilization. Inspections will take place at mutually agreeable en-route locations in advance of entry onto National Forest lands.
The Contractor shall take special care under this contract to prevent contamination of water at the work sites with any petroleum residues from mechanical equipment operations. This shall include daily inspection and cleaning as appropriate.
H-5 PRODUCT SUBSTITUTION
Any modification of other items, designs, materials, products or equipment (including Government-furnished property), made necessary because of a substitution, will be the responsibility of the
Contractor without adjustment in contract price or time. The Contracting Officer's approval of any substitute will not affect the Contractor's responsibility for such modification. Any and all substitutions will be requested by the Contractor after award of the contract has been made. No approvals will be made prior to award.
H-6 CONTRACTOR’S REPRESENTATION & RESPONSIBILITY
A. In making formal request for substitution the Contractor represents he/she:
1. Have investigated proposed product and determined that it is equal to or superior in all respects to that originally specified.
2. Will provide same warranties and bond for substitute as for originally specified product.
3. Will coordinate installation of accepted substitution into the work, and will make such changes as may be required for the work to be complete in all respects.
4. Will waive claims for additional costs caused by substitution, which may subsequently become apparent.
5. Cost data is complete and includes related costs under the contract, but not:
a. Costs under separate contracts.
b. Contracting Officer costs for redesign or revision of contract documents.
B. The Contractor assumes full responsibility that the substitution and/or alternate items or procedures proposed will meet the job requirements.
C. The Contractor is solely responsible for the cost of redesign and modifications to this and other parts of the work caused by the substitutions or alternates furnished.
H-7 Submittals, Shop Drawings, Material Certifications and Testing Reports
Submittals shall include the following unless otherwise required in the specification:
1. Date and revision dates.
2. Project name and contract number.
3. Names of Contractor, subcontractor, supplier, and manufacturer.
4. Specifications section number.
5. Field dimensions and relation to adjacent structures.
6. Applicable standards such as ASTM or Federal Specifications.
7. Contractor's stamp, initial or signature, certifying the review of submittal, verification of field measurements and compliance with contract documents. Provide all submittals within 14 calendar days of contract award unless otherwise required by the specification.

H-9 Landscape Preservation
(a) Prior to excavation, the Contractor shall remove the organic surface layer of soil, including grass and small plants within the clearing limits, stockpile separately and redistribute these materials over the finished slopes on the project as directed by the Contracting Officer. The Contractor shall not remove, deface, injure, or destroy trees, shrubs, lawn, or natural features not designated for treatment. The
Contractor shall confine operations to within the clearing limits or other areas designated in the contract documents, and prevent the depositing of rocks, excavated materials, stumps, or other debris outside of these limits. Material which falls outside of these limits shall be retrieved, disposed of, or incorporated in the work as directed by the Contracting Officer. Sediment fencing and weed free straw bales will be placed to prevent sediment from entering the stream, as necessary.
(b) Prevention of Oil Spills. If the Contractor maintains storage facilities for oil or oil products on site, appropriate preventive measures shall be taken to insure that any spill of such oil or oil products does not enter any stream or other waters of the United States or any of the individual states. If a spill of petroleum product should occur in water, the Contractor shall take immediate action to clean up or contain the spill, then immediately notify the Engineer/COR and the Oregon Emergency Response
System (OERS), telephone 1-800-452-0311 or 1-503-378-4124, and then immediately notify the
Contracting Officer.
Contractor shall have a SPILL RESPONSE KIT on the project whenever equipment is operating. The spill kit shall be sufficient to absorb 34 gallons of oil, designed to float on the surface, while absorbing oil and repelling water. The KIT shall meet or exceed the physical properties of “New Pig Products
Spill Kit #408”. A spill response kit is required at the project site location and at the helispot (when in use).
Oil absorbing mats are required under all stationary equipment, or equipment being serviced within the
Forest Boundary to prevent leaking or spilled petroleum base products from contaminating soil and water resources. Such material will be furnished by Contactor and approved by Contracting Officer.
Servicing of all equipment shall be done only in the areas approved by the Contracting Officer. If the total oil or oil products storage exceeds 1320 gallons or if any single container exceeds a capacity of 660 gallons, the Contractor shall prepare a Spill Prevention Control and Countermeasures (SPCC) Plan.
Such plan shall meet applicable EPA requirements (40 CFR 112) including certification by a registered professional engineer.
Equipment shall be furnished on a fully operational basis, of modern design and in good operating condition with no fuel or oil leaks. Repairs and move-in/move-out are the Contractor’s responsibility.
All equipment shall be power washed and shall be clean prior to entering Forest Service Land.
Maintenance and refueling of the equipment shall take place a minimum of 75 feet away from the stream and within an impervious retention basin having 150% of the containers capacity. Small trail building equipment for use within the stream or channel shall have vegetable based hydraulic fluid.
(c) No objectionable material shall be allowed to enter any stream, river, lake, or other body of water.
Material which falls in these areas shall be retrieved and disposed of, or incorporated in the work as directed by the Contracting Officer, and damage to vegetation or structures outside the project limits shall be repaired as directed by the Contracting Officer. Monitor the turbidity of the stream and take immediate action to mitigate the turbidity.
(d) The Contractor shall not operate equipment or otherwise disturb the natural vegetation and soil beyond the areas flagged on the ground or beyond two feet from edge of walkways, top of cuts, or toe of fills.
(e) The Contractor will make every reasonable attempt to preserve the scenic and natural environment along this construction project.
(f) Prior to the start of construction the Contractor shall submit to the Engineer for review a schedule and plan for temporary pollution control measures for the following phases of work:
(i) Item 15713 – Soil Erosion and Pollution Control, prior to excavation.
(ii) Item 15101 – Maintenace and refueling equipment
H-10 Construction Stakes, Lines, and Grades
(a) Survey monuments have been set and are shown on the plans. The survey control monuments constitute the field control from which the Contractor shall execute the work, and shall be left in place until the Engineer approves their removal.
(b) The Contractor shall do all further surveying, staking, and engineering to establish the horizontal and vertical control necessary to result in having the finished work comply with the lines and grades shown on the Plans or stated in the specifications.
(c) If any construction control points have been destroyed or displaced, or are erroneous, the Contractor shall promptly notify the Engineer. If these points are destroyed or displaced due to Contractor's negligence or operation, the cost for replacing them will be charged to the Contractor.
(d) In case of any construction changes, the Contractor shall cooperate with the Engineer and facilitate the prompt reestablishment of the field control for the adjusted work.
H-11 Contractor’s Use of Existing Roads
The Contractor is authorized to use roads in the immediate construction project area for performance of work under this contract. The authorization is limited to roads necessary for direct access between the construction area and storage sites, disposal areas, and other work areas designated in the contract.
The roads authorized for use will be subject to the following general conditions:
(1) State laws governing traffic rules and equipment requirements on State and County Highways.
(2) Federal Regulations contained in 36 CFR 261.12. These regulations prohibit use in excess of
State Codes for weight and size, damaging a road while using it, and blocking a road open to use by others.
(3) The Road Rules in the current Umpqua National Forest Road Rules Document are applicable to all commercial road users. This document is available for inspection at the office of the Forest
Supervisor and shall be applicable except when modified by provisions of the contract.
The Contractor shall be responsible for and perform road maintenance commensurate with his use of
Forest Service roads in the construction area.
H-12 Traffic Control
The Contractor shall provide, erect and maintain all necessary barricades, suitable and sufficient lights, danger signals, signs, and other traffic control devices, and shall take all necessary precautions for the protection of the work and safety of the public. Roads closed to traffic shall be protected by effective barricades, and obstructions shall be illuminated during the hours of darkness. Suitable warning signs shall be provided to properly control and direct traffic.
The Contractor shall erect warning signs in advance to any place on the project where operations may interfere with the use of the road or trail by traffic and at all intermediate points where the new work crosses or coincides with an existing road or trail. All road barricades, warning signs, lights, temporary signals, flagman and pilot car operators and equipment, and other protective devices, except for special devices, shall conform with Part VI of the Manual on Uniform Traffic Control Devices for Streets and
Highways, published by the Federal Highway Administration and applicable safety codes.
H-13 Control of Material
Excavation:
(a) Excavation is unclassified.
Material Sources
(a) Designated Sources - Sources of local materials are designated on the drawings. The
Government assumes responsibility for the quality and quantity of material in the source. The
Contractor shall determine the equipment and work required to produce the specified product.
The Contractor shall utilize all suitable material in the source. The designation of source will include the rights of the Contractor to use certain area(s) for plant site, stockpiles, and haul roads.
When materials are subject to weight measurement, the weight/volume relationship used for determination of designed quantities will be shown on the Drawings.
Should the designated source, due to causes beyond the control of the Contractor, contain insufficient suitable material, the Government will provide another source with an equitable adjustment in accordance with Clauses 52.243-5, Changes and Changed Conditions or Clause
52.236-2, Differing Site Conditions.
(b) Contractor Furnished Sources - When the material sources are not designated as provided above or the Contractor elects not to use designated sources, the Contractor shall be responsible for providing the specified product with no adjustment in contract price, unless weight/volume relationship differences between designated source material and Contractor furnished source material result in financial disadvantage to the Government. Quality Testing shall be the responsibility of the Contractor. Test results shall be furnished to the Contracting Officer.
Storage Stockpiling of Materials
(a) Materials shall be stored to assure the preservation of quality and fitness for the work. Stored materials shall be located to facilitate their prompt inspection. Sites on Forest Service administered land, approved by the Forest Service, may be used for storage purposes and for the placing of Contractor's plant equipment. All storage sites provided by the Forest Service shall be restored at Contractor's expense. Contractor shall be responsible for making arrangements for storage on other than Forest Service administered lands.
Earthwork Tolerance
(a) Changes within specified tolerances (such as adjustment of horizontal or vertical alignment) shall be made as necessary to maintain earthwork quantities substantially as designed within balance points. Such adjustments shall not be considered as "Changes" under Clause 52.243-5.
(b) Unless working tolerances are specified, all work performed and materials furnished shall be in reasonably close conformity with lines, grades, cross sections, dimensions, and material requirements shown on the Plans, indicated in the specifications, or designated on the ground.
"Reasonably close conformity" is in compliance with reasonable and customary manufacturing and construction tolerances.
H-14 POTENTIAL SAFETY HAZARDS /HAZARDOUS CONIDITIONS SAFETY PLAN
CERTIFICATION
(a) Data and information furnished or referred to below is for the Contractor's information. The
Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor. The Contractor shall bear the sole responsibility for taking all appropriate actions necessary to prevent accidents and injuries to individuals at the worksite.
(b) The following conditions have been identified as inherently hazardous to a degree that failure to take the proper precautions could lead to serious injury or loss of life. This listing shall not be construed as all inclusive. The Contractor shall certify that his/her Safety Plan conforms to the requirements of 29 CFR 1910 and 1926 and the clause entititled Accident Prevention (FAR
52.236.13) included herein. . The Safety Plan certification shall be submitted prior to commencing work on the project. Appropriate actions shall be taken by the Contractor to implement this plan during performance and to take any and all other necessary steps to mitigate the dangers from hazard.

H-15 Suspensions for Other Than Government’s Convenience
The Contracting Officer may issue orders to suspend the work wholly or in part for such period of time as deemed necessary because of: (1) Weather or ground conditions when further prosecution of the work might cause environmental or resource damage to the project, access roads to the project, or adjacent property. Such action would include but not be limited to instances such as siltation of streams, damage to access roads, rutting of project roads which causes otherwise suitable soils to become muddy or unsuitable; or (2) Failure of the Contractor to comply with Specifications such as but not limited to placement of frozen material in fills, placing of asphalts at temperatures lower than those specified, performing work prior to prerequisite approvals, operating equipment not meeting fire requirements, or when conditions exist which do not meet safety requirements. Whether or not a suspend work notice is issued, the Contractor shall be responsible for correcting any damage caused by his/her operation, whether inside or outside project limits, at no cost to the Government. Such suspensions shall not be considered as suspensions for the Convenience of the Government under FAR 52.242-14, Suspension of Work, and shall not qualify for equitable adjustment.
H-16 VALUE ENGINEERING
Value engineering change proposals which change the service or function of a facility or produce irreconcilable conflicts with management objectives will not be considered.
The following work is excluded from consideration under the Value Engineering clause: "NONE."
H-17 AVAILABILITY AND USE OF UTILITY SERVICES
(a) Government-furnished utilities are not available to the Contractor on the project. Sites are remote and electricity and potable water is not available.
H-18 PERMITS AND RESPONSIBILITIES – See FAR 52-236-7 (NOV 1991)
Contractor is responsible to comply with all codes, laws and regulations applicable to this work.
H-19 PAYMENT FOR MATERIALS DELIVERED OFF THE SITE
As provided in FAR 52.232-5, Payments Under Fixed-Price Construction Contracts, material acquired for incorporation into the project, and stored off site by the Contractor, may, at the option of the
Contracting Officer, be included in progress payments. Prior to payment, such material will be subject to Government inspection and must be stored separately from other materials, and be identified as, "PROPERTY OF THE UNITED STATES, Project Name and Contract Number." In addition, the
Contractor shall furnish the Government with a right of ingress and egress to the property together with right of removal.
H-20 PAYMENTS FOR INCIDENTAL ITEMS
The intent of the contract is to provide for the complete construction of the project described in the contract. Unless otherwise provided, the Contractor shall furnish all labor, materials, equipment, tools, transportation, and supplies and perform all work required to complete the project in accordance with plans, specifications, and provisions of the contract. Payment for contract work will be made only for and under those pay items included in the Schedule of Items. All other work and materials will be considered indirect to and included in the payment for items shown.
H-21 PERFORMANCE AND PAYMENT BOND AMOUNTS WITH OPTION ITEMS
The Contracting Officer, based on the contract clause entitled “Additional Bond Security (FAR 52.228-
2) may require an increase in the penal sum of the bond if the option item(s) is (are) exercised after the initial award. The increase, if any, will be based on an amount no greater than the total contract price, as modified. The Contracting Officer reserves the right to maintain the penal sums based on the original contract amounts if Option Item additions are minimal, or if Base item performance completion is substantial.
H-22 RELEASE OF PERFORMANCE AND PAYMENT BONDS
Performance and payment security furnished under this contract must be retained by the Government for a minimum of one year after acceptance of all work under the contract including any applicable warranty period. Performance and payment security other than corporate or individual surety bonds will be returned to the Contractor one year after completion of work if no claims against these bonds have been filed at that time.
H-24 AGAR 452.228-71 INSURANCE COVERAGE (NOV 1996)
Pursuant to FAR clause 52.228-5, Insurance – Work on a government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:
(a) Workers Compensation and Employer’s Liability. The Contractor is required to comply with applicable Federal and State worker’s compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer’s liability section of the insurance policy, except when contract operations are so commingled with a Contractor’s commercial operations that it would not be practical to require this coverage. Employer’s liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker’s compensation to be written by private carriers.
(b) General Liability. The Contractor shall have bodily injury liability insurance coverage written on a comprehensive form of policy of at least $500,000 per occurrence.
(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract.
Policies covering automobiles operated in the United States shall provide coverage of at least
$200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.
(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury.
