Replace Clause 6, with the following:
6. 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 15 calendar days after receipt of Notice to Proceed for specific work items, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than two years from the date of contract award. The time stated for completion shall include final cleanup of the premises.
It is estimated that work will begin November 1, 2008. Actual date is negotiable based upon actual award date, prospective work and weather conditions.
Scheduling of Work may be restricted based on the following: felling and yarding of material may be restricted from April 15 to July 1 to protect leave trees during the bark slippage season. Contractor must take great care to protect leave trees during this time period.

K-G.8.4 - USE OF PAINT BY CONTRACTOR (OPTION 1). (6/06) Notwithstanding G.8.4.2, use of paint by the Contractor within the Contract Area in the same color(s) used by the Forest Service in the preparation and administration of the contract will be by written approval of the Forest Service.

PRE-PROPOSAL CONFERENCE NOTES
Attendees:
Government – Marianne Klingler and Steve Nelson Contractors – Dave Monett, Monett Logging, Inc., Sutherlin, OR
Marianne Klingler, Contracting Officer, led the discussion on the parts of the contract and explained the following acronyms: FAR – Federal Acquisition Regulations, AGAR – Department of Agriculture Acquisition Regulations, and FSAR – Forest Service Acquisition Regulations.
| Offerors must complete Blocks 17a, 23, 24, 26, and 30a-c on the Standard Form 1449. and the price for the sawtimber. |
| The Schedule of Items lists the services and prices. Offerors must submit a unit price and total price for Line Items 1-3, and a price which they will pay for the timber. |
The project objectives and location were discussed. All supplies, equipment, labor and supervision shall be provided by the Contractor.
The Contractor shall identify the quality control system and the Government will use their quality assurance surveillance plan to monitor Contractor performance.
Clause 52.211-10, all work must be completed within two years of contract award.
| The clauses that are unique to stewardship were briefly discussed. Although the Government is trading goods for services, based on our information, we know we will not have sufficient goods to cover the cost of the services, therefore the Government will make payments to the Contractor. Stewardship credits are accrued when service work activities are completed and accepted. A timber payment guarantee in the form of an acceptable surety payment bond, cash, or a deposit in a Federal Depository negotiable securities of the United States. Any earned Stewardship Credits and Timber Payment Guarantee together will maintain a minimum unobligated balance equal to the applicable charges for timber that the Forest Service estimates will be cut in not less than 30 days and not more than 60 days. |
| Generally discussed the other contract clauses commonly seen in service contracts. Fire requirements are the same from most service/construction contracts. Safety is very important. Contractor will be required to submit a safety plan prior to start work. |
| Many clauses are incorporated by reference. Full text is available at the websites listed. Bond premiums will be reimbursed after the cost has been incurred by the contractor. This is considered an incidental item, so it is considered within the prices paid for the line items. Statement of Equivalent Rates is what the Forest Service would pay our employees. It is not a wage determination. The Contractor must pay employees based on the attached wage determination 1977-0079. Requirement of paying fringe benefits was discussed. |
| Offerors must register in CCR. If already registered in ORCA, you do not need to complete the certifications and representations. |
Offers must provide information on Past Performance, Technical Approach, and Utilization of Local Workforce. Follow the instructions carefully and provide the information that is requested in each of the factors.
FAR Clause 52.212-2 Evaluation – Commercial Items describes how the Government will evaluate. All technical factors when combined are significantly more important than price. Offerors Technical Approach and Utilization of Local Workforce will be incorporated into any resultant contract. The accepted proposal will take precedence if there is any inconsistency between the accepted proposal and the Government’s solicitation requirements.
Steve Nelson discussed the technical requirements.
Appendix A – standard specifications for this Forest regarding precommercial thinning and release.
| Spacing and species preference. |
| Release is required if brush encroaches within a four foot radius of the tree. If the tree height is already above the brush, no release is necessary. |
Contractor Quality Control Plan must be similar to Government inspection so results can be compared.
The Forest Service will go out at beginning of project to ensure everyone understands the requirements in the same manner.
18 X 18 foot spacing.
Do not cut pacific yew.
Blister rust – if half the crown is infected, cut the tree.
| Tell us in your proposal what precommercial thinning slash you will utilize as biomass. What we are trying to determine is how much precommercial thinning slash can be used as biomass and the cost. |
| Sporax – there is no requirement to use Sporax on any stumps. |

| Always select the largest tree, then cut all other trees over 8 inches DBH within the spacing requirement. Your proposal can include cutting and yarding smaller diameter trees for biomass. Based on the stand composition, this comes out to about a 20 foot spacing. |
Unit 8 – If your proposed logging method allows you to reach farther, we could increase the unit size (acreage & volume) through a modification.
Felling plan is required. Directional felling is required. Locate skid trails before commencing work and Government will approve.
No equipment in riparian reserves.
Full suspension is not required.
Ground-based equipment cannot exceed 30% slope.
Intermediate suspension may be required depending upon how you log.
75 foot lateral yarding.
It was mentioned that it takes about 12 MBF per acre to meet costs for using a yarder. A rough estimate of 7 MBF for this project is understood and that’s why we need to pay to have the work completed. The forest products will not cover the costs to perform all the work.
| Restrictions may apply during bark slippage season 4/1-7/1. |
| Can work in winter. |
No restrictions for owls or marbled murrelet.
Tops and limbs are potential biomass and should go to landing.
Roads and landings must be clean when work is completed. If biomass is not hauled, it must be piled and covered.
No slash treatment within units.
Appendix C
| Deposit for asphalt paved Road 28 is required at $1.30 per TON for all material hauled. See K-F.3.2# in Appendix B. |
| Prehaul Maintenance – this will be where most of the road maintenance cost is found. Offerors should visit the site. |
838 – Main roads 839 – Secondary roads. You just need to get these roads open for your use.
Safety trees – cut but do not remove unless Forest Service adds this in as included timber.
Keep all roads clean while operating Post haul – put water bars back but do not decommission.
No pipe replacement.
Any slash generated should be removed as biomass or piled at landing.
If you think you need to replace a culvert for safety purposes, put it in your proposal.
Appendix B – additional information This project is 100% weight scaled.
If we can get a good estimate on average load weight, we could modify and change to load count for the biomass material.
Minimum specification for sawtimber is 6” top, 12’ log, the rest is nonsawtimber (biomass).
Trees smaller than 8” DBH are biomass.
There are some small markets for Douglas-fir flooring boards and teepee poles.
Scaling must be done by a certified, third party scaling organization.
Product Identification – brand & paint both ends if >7”. Biomass does not need to be branded.
Use of timber – all timber must be domestically processed.
Overall, give us a price to log and protect stand, and still get out the biomass.
