b. The Aggregate Degradation Factor is hereby changed to “8 Minimum”

c. Add the following Weed-Free Aggregate Source Requirements:

WEED-FREE AGGREGATE SOURCE REQUIREMENTS

Only weed-free aggregate sources will be used. Weed-free means the source has no population or seed disbursal of any listed invasive plants of concern. Contact the following for a detailed list of weed species: USDA Forest Service, Guadalupe Cisneros, 360-956-2353

Certification that aggregate sources are weed-free shall not be requested and will not be provided by the Forest Service prior to award of the contract.

Acceptable aggregate sources must have received prior weed-free approval within the past twelve (12) months by the Forest Service, the National Park Service, or the applicable county weed board. Any such aggregate source will still have to be inspected and approved in accordance with the requirements under AGGREGATE SOURCES under the Specification Section. No aggregate development work shall begin until Forest Service supplemental inspection is completed and final source approval is received.

Any source that has previously been inspected and been rejected by any of the above cited agencies would not meet the requirement above, unless it can be shown that it was subsequently treated and accepted as “weed-free”.

Alternate sources can be proposed by submission of supporting documentation demonstrating how the proposed aggregate source would meet the “weed-free” status of listed agencies.

If a contract is awarded, but thereafter it is determined through USFS inspection to contain unacceptable weeds, the Contractor shall discuss with the Contracting Officer possible remediation steps to make the source usable. If mutual agreement is not reached, and the source cannot be accepted by the Forest Service, the contract will be terminated for the convenience of the Government under the clause FAR 52.212-4 Contract Terms and Conditions – Commercial Items, paragraph (l) “Termination for the Government’s convenience.” Failure to come to a termination settlement under this clause is subject to the Disputes clause, FAR 52.233-1.

If an Offeror’s proposal for aggregate sources is not deemed acceptable, the Forest Service hereby attests that any such rejection shall not be used as any negative factor for any future consideration under any other proposed Forest Service acquisition.
