STATEMENT OF WORK AND SPECIFICATIONS
C‐1 SCOPE OF WORK, PROJECT DESCRIPTION, AND LOCATION
a. Description/Scope of Work: This project involves road maintenance on the Rocky Mountain Ranger District of the Lewis and Clark National Forest. The successful Contractor shall furnish all labor, equipment (fully operated), supervision, transportation, operating supplies, and incidentals necessary to complete the work. All work shall conform to the specifications of the solicitation and any resultant contract. All equipment shall be in good mechanical operating condition and shall be operated by competent, experienced operators.
Road maintenance consists of reshaping and finish‐blading the road bed (including shoulders, turnouts and approaches) to restore the original cross section and grade. Work includes restoring drainage provisions of the road and road appurtenances, including ditches, rolling drain dips, culvert basins, and inverts of culverts and other structures. Work also includes removing ruts, washes, slough and other irregularities that prevent normal runoff from the road surface. Moisture control and mechanical roller compaction are required on all roads specified.
b. Project Location: The project is located on the Rocky Mountain Ranger District of the Lewis & Clark National Forest in Teton County, MT.
Roads to be maintained include:
North Fork of Teton Road #144 (maintenance from Forest boundary to end of road) South Fork of Teton Road #109 (maintenance from Forest boundary to end of road) Benchmark Road #235 (maintenance from Junction Road #233 to Mule Creek)
c. Subcontractors: All subcontractors must be identified by the time of the post‐award conference and must be approved prior to the issuance of the Notice to Proceed. Contractors shall submit a completed SF‐1413 form to the Contracting Officer (CO) for each subcontractor identified (an SF‐1413 form is attached in Section J‐11).
d. Price Range: Between $25,000 and $100,000
e. Pre‐bid Tour: No pre‐bid tour will be conducted. Interested parties may contact Brandon Ellis at the Lewis & Clark
National Forest, Supervisor’s Office, at 406‐791‐7724 with questions or for directions to view the project site on their own. Contractors are urged to inspect the site where the work will be performed.
Interested parties shall take reasonable steps to ascertain the nature and location of the project area and the work to be completed, as well as the general and local site conditions which can affect the work and cost of performance. Failure to take the actions described in this paragraph will not relieve the Contractor from the responsibility of properly estimating the difficulty and cost to successfully perform the work, or from successful completion of the work without additional expense to the Government.
f. Pre‐bid Conference: No pre‐bid conference will be conducted.
g. Start Work Date: Estimated start date for this project is mid to late September 2014.
h. Performance Period: All work shall be completed, including clean‐up, final inspection, and Government acceptance, no later than 31 October 2014. The Contractor shall maintain progress at a rate that will assure completion of work within the time specified above.

Method of Measurement: Road maintenance services will be measured to the nearest tenth of a mile along the road centerline, regardless of the number of passes required for a given length of road, and shall include only the sections of roads specified in the Schedule of Items. Measurement will be recorded by using the odometer of a Forest Service vehicle designated by the CO. Parking areas, turnouts, and road approach connections are considered as incidental items to the roads specified in the Schedule of Items and shall not be measured separately.
G‐3 PAYMENT
Payment shall be based on satisfactory performance of the work and on compliance with the terms and conditions specified in the contract.
a. Method of Payment: Payment shall be made for completed and accepted work, by actual quantities, at the contract unit price for the applicable Item. Payment of an Item constitutes full compensation for all labor, equipment, tools, and incidentals necessary to complete the work.
b. Unacceptable Work
1) When the Contractor delivers unacceptable work, the Government may: 1) accept the work at a reduced price; 2) require the area to be re‐worked at no additional expense to the Government; or 3) reject the work in its entirety. If the quality is unacceptable, the Contractor's right to proceed is subject to termination for default.
2) The Government will permit the Contractor to rework an area if deficiencies can be corrected. The
Government will assess the re‐work after receiving the Contractor’s inspection records which reflect that all work meets specification standards.
3) Any Government quality assurance assessment required due to the Contractor reworking an area, either at the Contractor's request or because of unacceptable work, will be at the Contractor's expense. The Government will evaluate the re‐work after receiving the Contractor’s inspection records which reflect that all work meets specifications. The Government will conduct quality assurance measurement up to one time after the initial assessment due to rework by the Contractor. The Contractor may be assessed actual damages which may include but are not limited to wages of the COR and Government Inspector(s) incurred due to the rework and costs of vehicles that are incurred while administering the contract during the rework.
4) The Government shall document unacceptable work quality in the performance evaluation.

a. Superintendence and On‐Site Representative: At all times during performance of this contract and until work is completed and accepted, the Contractor shall directly superintend the work or assign and have on the worksite a competent superintendent who is satisfactory to the CO and has authority to act for the Contractor.
H‐2 SITE INVESTIGATION
a. The Contractor acknowledges that it has taken steps reasonably necessary to ascertain the nature and location of the work, and that it has investigated and satisfied itself as to the general and local conditions which can affect the work or its cost, including but not limited to (1) conditions bearing upon transportation, disposal, handling, and storage of materials; (2) the availability of labor, water, electric power, and roads; (3) uncertainties of weather, river stages, tides, or similar physical conditions at the site; (4) the conformation and conditions of the ground; and
(5) the character of equipment and facilities needed preliminary to and during work performance. The Contractor
2014 Road Maintenance Services, Rocky Mountain Ranger District also acknowledges that it has satisfied itself as to the character, quality, and quantity of surface and subsurface materials or obstacles to be encountered insofar as this information is reasonably ascertainable from an inspection of the site, including all exploratory work done by the Government, as well as from the drawings and specifications made a part of this contract. Any failure of the Contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expense to the Government.
b. The Government assumes no responsibility for any conclusions or interpretations made by the Contractor based on the information made available by the Government. Nor does the Government assume responsibility for any understanding reached or representation made concerning conditions which can affect the work by any of its officers or agents before the execution of this contract, unless that understanding or representation is expressly stated in this contract.
H‐3 PERMITS AND RESPONSIBILITIES
a. The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any Federal, State, and municipal laws, codes, and regulations applicable to the performance of the work. The Contractor shall also be responsible for all damages to persons or property that occur as a result of the Contractor's fault or negligence. The Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract.
H‐4 NOXIOUS WEED CONTROL
a. The project area lies within a weed management district, which is any area of land identified for the purpose of weed management or control. Such an identified land area may be, but is not limited to, one of the following: 1) a project or jobsite; 2) a county; 3) two or more counties; or, 4) a National Forest.

Noxious weeds are defined as any exotic plant species established or that may be introduced in the State which may render land unfit for agriculture, forestry, livestock, wildlife, or other beneficial uses and which is designated by the State Department of Agriculture, or by the County Weed Management District, or by other appropriate agencies having jurisdiction.
c. To help stop the spread of weed seeds, this work will require the Contractor to wash his equipment and support vehicles prior to entering the weed management district. The equipment and support vehicles shall be washed with a pressure washer that is capable of producing enough water force to thoroughly remove all organic and mineral debris from the machine. Before moving the equipment to the jobsite, it shall be inspected and approved by the Contracting Officer or designated representative.
H‐5 WEED‐FREE EQUIPMENT
a. In order to prevent the potential spread of noxious weeds into the project area, the Contractor shall be required to furnish the CO with proof of weed‐free vehicles/equipment.
b. The following is considered proof of weed‐free equipment:
1) The Contractor will be required to clean all vehicles/equipment (e.g., vehicles/equipment that is operated off of existing roads) prior to entrance onto Federal lands. This cleaning shall remove all dirt and plant parts and material that may carry noxious weed seeds into the project area. Only vehicles/equipment inspected by the COR will be allowed to operate within the project area. All subsequent move‐ins of vehicles/equipment shall be treated the same as the initial move‐in.
2014 Road Maintenance Services, Rocky Mountain Ranger District

H‐6 LOSS, DAMAGE, OR DESTRUCTION
a. Equipment furnished with Operator. The Government shall not be liable for loss, damage, or destruction of equipment furnished under this contract except for such loss, damage, or destruction resulting from the negligent or wrongful act(s) of Government employee(s) while acting within the scope of their employment.
b. All claims arising under this clause will be submitted to the CO.
H‐7 EXISTING FACILITIES
a. Existing facilities such as signs, cattle guards, and drainage structures that are damaged by the Contractor shall be replaced or repaired by the Contractor at no additional cost to the Government.
H‐8 CONTROL OF EROSION, SEDIMENTATION, AND POLLUTION
a. Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.).
b. Pollutants such as fuels, lubricants, bitumens, raw sewage, and other harmful materials shall not be discharged on the ground; into or nearby rivers, streams, or impoundments; or into natural or man‐made channels. Wash water or waste from concrete or aggregate operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.
c. Mechanized equipment shall not be operated in flowing streams without written approval by the CO.
H‐9 STORAGE OF EQUIPMENT AND MATERIALS
a. Storage of equipment and materials shall take place only within areas approved by the CO.
H‐10 BARRICADES, WARNING SIGNS, AND OTHER DEVICES
a. The Contractor shall provide, erect, and maintain all necessary barricades, suitable and sufficient lights, danger signals, signs, and other traffic control devices, and shall take all necessary precautions for the protection of the work and safety of the public. Roads closed to traffic shall be protected by effective barricades, and obstructions shall be illuminated during hours of darkness. Suitable warning signs shall be provided to properly control and direct traffic.
b. The Contractor shall erect warning signs in advance to any place on the project where operations may interfere with the use of the road or trail by traffic and at all intermediate points where the new work crosses or coincides with an existing road or trail. All road barricades, warning signs, lights, temporary signals, flagmen and pilot car operators and equipment, and other protective devices, except for special devices, shall conform with Part VI of the Manual on Uniform Traffic Control Devices for Streets and Highways, published by the Federal Highway Administration and applicable safety codes.
H‐11 MAINTENANCE OF CLEAN WORKSITE CONDITIONS
a. The Contractor will maintain the project work area in a clean and orderly condition throughout the period of performance.
2014 Road Maintenance Services, Rocky Mountain Ranger District
b. Before completing the work, the Contractor shall remove from the work and premises any rubbish, tools, equipment, and materials that are not the property of the Government. Upon completing the work, the Contractor shall leave the work area in a clean, neat, and orderly condition satisfactory to the CO.
H‐12 CAMPING AND WORKSITE CONDITIONS
a. Camping shall be consistent with all applicable Lewis & Clark National Forest regulations and policies. For information regarding camping and food storage, contact the Rocky Mountain Ranger District at 406‐466‐5341.
The Contractor shall obtain a camping permit from the Rocky Mountain Ranger District prior to camping on Forest Service land.
b. The Contractor shall provide a general camping plan to the CO by the date of the post‐award conference. Final payment may be withheld until the authorized camping area has been cleaned up to the requirements of the camping permit.
c. If the Contractor does not obtain a camping permit but requires his/her employees to obtain the camping permit, the Contractor remains responsible for campsite clean‐up and his/her employees conduct while camping on National Forest land.
