Amendment No. 01 (continued from Page 01)

1. Section B. Replace Section B with the attached.

2. Section F, Paragraph F.3.2.3

Replace the text for the double asterix at the bottom of the table with the following text:

“**Government specified requirement is stated here. Alternate numbers may be inserted here at the time of contract award if the Contractor submits a second, alternate proposal that proposes different crew size ranges and the Contracting Officer accepts that proposal.”

3. Section F, Paragraph F.3.2.1. Add the following sentence to the paragraph: “If the calculation for contract time results in less than 5 calendar days of contract time, the Contracting Officer will give the

Contractor 5 calendar days of contract time.”

4. Section F, Paragraph F.3.2.2. Add the following sentence to the paragraph: “If the calculation for contract time results in less than 5 calendar days of contract time, the Contracting Officer will give the

Contractor 5 calendar days of contract time.”

5. Section L, Paragraph L.6 is replaced with the following:

L. 6 AGAR 452.215-71 Instructions for the Preparation of Technical and Business Proposals

(SEP 1999)

(a) General Instructions. Proposals submitted in response to this solicitation shall be furnished in the following format with the numbers of copies as specified below.

(1) The proposal must include a technical and business proposal. Each of the parts shall be separate and complete so that evaluation of one may be accomplished independently from evaluation of the other. The technical proposal must not contain reference to cost; however, resource information

(such as data concerning labor hours and categories, materials, subcontracts, etc.) must be contained in the technical proposal so that the contractor's understanding of the statement of work may be evaluated.

(2) Offerors may, at their discretion, submit alternate proposals or proposals which deviate from the requirement; provided, that an offeror also submit a proposal for performance of the work as specified in the statement of work. Any "alternate" proposal may be considered if overall performance would be improved or not compromised, and if it is in the best interest of the Government. Alternate proposals, or deviations from any requirement of this RFP, must be clearly identified.

(3) The Government will evaluate proposals in accordance with the evaluation criteria set forth in Section M of this RFP.

(4) Offerors shall submit their proposal(s) in the following format and the quantities specified:

(i) 1 copy of the completed, signed offer (Sections A, B, & K of the solicitation).

(ii) 4 copies of the technical proposal (Response to Sections L and M)

(iii) 1 copy of the business/cost proposal (Section B)

(b) Technical Proposal Instructions. The technical proposal will be used to make an evaluation and arrive at a determination as to whether the proposal will meet the requirements of the Government.

Therefore, the technical proposal must present sufficient information to reflect a thorough understanding of the requirements and a detailed, description of the techniques, procedures and program for achieving the objectives of the specifications/statement of work. Proposals which merely paraphrase the requirements of the Government's specifications/statement of work, or use such phrases as "will comply" or "standard techniques will be employed" will be considered unacceptable and will not be considered further. As a minimum, the proposal must clearly provide the following:

The following is added:

(1) Past Performance.

(a) Offeror shall identify the experience that they have in same or similar work. Offeror shall demonstrate relevance of past experience to the work contemplated by this contract.

(b) For the relevant experience identified, the Offeror shall demonstrate satisfactory performance of same or similar work on previous contracts. Offeror shall provide information relevant to Offeror’s quality of service, timeliness of performance, customer satisfaction/working relationships, and management skill. At a minimum, the Offeror shall submit a list of customers and/or projects during the past 3 years, including names and phone numbers of contacts that the Government may use to obtain or verify past performance information.

(2) Capacity and Workforce. Offeror shall provide the Government with:

(a) the proposed production rates that will be inserted in Paragraph F. 3.2.1 and

F. 3.2.2 of the contract, and that will be used by the CO to determine contract time for Task

Orders issued under the contract. The Offeror shall provide the proposed production rates in

Section B of this solicitation;

(b) the proposed minimum and maximum crew size (See F. 3.2.3) for the work items identified in the Schedule of Items. The Offeror shall provide the proposed minimum and maximum crew sizes in Section B of this solicitation. The Offeror may provide explanatory comments in a narrative if desired;

(c) Paragraph F. 3.2.3. requires the Contractor to furnish at least “one crew per Task Order unless otherwise approved in writing, in advance by the Contracting Officer.” The Offeror may include a narrative with its response to this solicitation that provides supplemental information, explanatory comments, or restrictions on the maximum numbers of crews that would be available at any one time during contract performance;

(d) information regarding quantity and skill of the Offeror’s workforce that would be available for work on task orders under this contract, including a list of key personnel

(See H. 2). The Offeror may provide this information in a separate narrative.

Note: The Contracting Officer will incorporate part or all of the Offeror’s response to this evaluation criteria into the awarded contract. Key personnel, production rates, and restrictions concerning the maximum number of crews to be provided at any one time will be incorporated into the awarded contract.

(3) Work Methods. Offeror shall provide the Government with the following:

(a) Safety. Offeror shall provide the Government with information demonstrating their safety record and explaining the Offeror’s safety program and/or policies. The Offeror may provide a sample Safety Plan that demonstrates compliance with the Accident

Prevention, Safety Plan, and other safety-related requirements of this contract.

(b) Quality Control. Offeror shall provide the Government with information concerning the Offeror’s proposed Quality Control methods. The Offeror may submit a sample quality control plan. Offeror may provide the Government with information regarding how the Contractor will conduct Quality Control during performance of the work.

(b) Business Proposal.

(1) Price Schedule - Offeror shall provide this information by completing Section B of this solicitation. Offeror shall complete the entire Schedule of Items for the base and all option years.

6. Section M, Paragraph M.1 is replaced with the following:

M. 1 Evaluation Criteria

(a) Technical / Non-Price Evaluation Factors. The three non-price factors listed here will be equally considered for the purposes of evaluation. An unacceptable rating by the Government for any of these factors will preclude contract award.

(1) Past Performance: The Government will evaluate the Offeror’s past performance on same or similar work and will consider information submitted by the Offeror, obtained from references or obtained by the Government from other sources that is relevant to the following elements: (a) Quality of

Service; (b) Timeliness of Performance; (c) Customer Satisfaction/Working Relationships, and (d) management skill. In evaluating past performance, the Government will consider the quantity and relevance of the work for which past performance data is collected, the context of the data and the general trends of Offeror’s performance. In accordance with Federal Acquisition Regulations, Offerors that have no record of past performance will receive a neutral rating. (See Paragraph L. 6)

(2) Capacity and Workforce: The Government will evaluate the Offeror’s capacity, proposed production rates, proposed minimum and maximum crew size, and restrictions concerning the maximum number of crews to be provided at any one time. As part of the evaluation, the Government will also utilize the quantities identified in the Schedule of Items (Section B) when evaluating proposed production rates. The Offerors who demonstrate greater capacity/flexibility will receive a higher rating in this element. (See Paragraph L. 6).

(3) Work Methods: The two subfactors identified here are of equal importance for this criteria.

(See Paragraph L. 6.)

(a) Safety. The Government will evaluate both:

(i) The Offeror’s response to the Safety evaluation criteria, including any information provided regarding the Offeror’s safety plan, program or policies; and

(ii) Information obtained by the Government regarding the Offeror’s safety record.

(b) Quality Control. The Government will evaluate the Offeror’s proposed Quality

Control methods under this criteria. The Contractor’s record of Past Performance relevant to Quality Control will be evaluated by the Government under the separate

Past Performance evaluation criteria as a “quality of service” item.

(b) Price.

(1) Price Schedule. The Government will evaluate Offeror’s prices submitted on the Schedule of

Items found in Section B.

For the purposes of price evaluation the Government will utilize the quantity identified for evaluation purposes in the Schedule of Items for the base year and each option year. The Government will not use the estimated quantity for Year One in evaluation of pricing. This does not preclude the Government from considering prices offered for items with no identified estimated quantities. The Government will evaluate all prices for price reasonableness as well.

(c) Award Statement. The Government may make up to two contract awards from this solicitation. If more than one contact award is made, the Government will award the work under Paragraphs B.1, B.2 and B.3 under one contract, and Paragraphs B.4, B.5 and B.6 under another contract. Award(s) will be made to the Offeror(s) whose proposal(s) represents the best value to the Government, technical and price factors considered. Evalution factors other than cost or price, when combined, are approximately equal to cost or price in the award decision. The critical factor in making any price/technical trade-offs is not the spread between the technical ratings, but rather the significance of that difference. The significance of the difference in ratings will be determined on the bais of what that difference is and what it would cost the government to take advantage of it. Award may not necessarily be made for technical capabilities that would appear to exceed those needed for fulfilling the requirements of this contract. The Government reserves the right to make price/technical trade-offs that are in the best interest and advantageous to the Government.

The Government intends to evaluate proposals and award a contract without dicussions with Offerors.

Proposals should be submitted initially on the most favorable terms, from a price and technical standpoint, which the Offeror can submit to the Government. However, the Government may, after evaluation of proposals, conduct further oral or written discussions as appropriate, with all offerors whose proposals are within a competitive range.

The Government may reject any or all offers if such action is determined to be in the best interest of the

Government.
