Section C - Description/Specifications/Statement of Work China Camp Fence Construction-Humboldt-Toiyabe NF-Bridgeport Ranger District

March 2016

A. Scope of Contract:

The Contractor shall furnish the necessary personnel, material (not including fence material, wire, clips, Sage Grouse markers, steel posts and t-posts provided by the USFS), equipment, and services to construct approximately 4270 feet of fence around the perimeter of a meadow system in the China Camp Project on the Bridgeport Ranger District of the Humboldt-Toiyabe National Forest in Mineral County Nevada.

The fencing will be a permanent 4 strand (bottom smooth wire, 3 –barbed wire strands above) per the below specifications. Contractor shall install two drop down gates (see attached detail) within the enclosure. All gates and gate material excluding concrete will be supplied to the contractor by the U.S. Forest Service.

B. Project Location:

Mineral County, Nevada just east of Bridgeport California.

C. Project Specifications for fence: (note) All fencing materials (except concrete) provided by the USFS.

Fence Construction Specifications Standard four wire fence construction. Smooth wire will be the bottom wire. All line wire will be dead-ended at corners and line brace post. All t-posts will be placed so that the spade is completely below ground. T-posts shall be at 20’ spacing, with No.

9 twisted wire or 2” wood stays placed between t-posts, also at 20’ spacing. If in hard rock, the hole will be drilled to allow the steel post to be placed into the ground.

Bottom smooth wire is to be no less than 16 inches off the ground and the top wire no more than 42 inches off the ground with a gap between the top and second wire of no less than 12 inches. The top wire is to be marked for sage grouse using vinyl markers.

The vinyl markers are approximately 10 feet long and will need to be cut into 4 inch pieces and hung approximately every 3 to 5 feet along the fence on the top wire. The purpose of the markers is to identify the fence line to the Sage Grouse to avoid flying into the fence.

Braces- Braces will be constructed every ¼ mile of fence length, on each side of each gate, and at each change in the fence alignment (corner) according to Forest Service standards (see attached map for corner locations). Five post brace corners will be installed at all locations where a corner is formed. Three post braces will be installed at each side of each gate. Post pipe shall be buried 24 in the ground and placed in concrete. Line braces shall be constructed at a minimum distance of ¼ mile, as well as the crest of hills and the base of all drainages. In draws where the fence wire has a

Amendment #1-AG-0261-S-16-0023 tendency to pull the steel posts out of the ground, a rock or steel post anchor shall be placed at these points. Contractor will submit a rock or steel post anchor plan to the CO or COR for approval.

Gates- Build two drop down gates approximately 8 feet wide at predetermined sites as shown on the map and hang Sage Grouse Markers on gates.

Creek crossing- There is one seasonal creek crossing.

Terrain- The slope is gradual, ranging from flat ground to slightly rolling terrain.

Vegetation includes predominately brush. If vegetation clearing is required, it will be completed by the contractor with hand tools or a chainsaw. Clearing is only necessary to ensure the fence is straight between braces.

D. Avoidance and Noxious Weed Mitigation:

Access will be via existing Forest Service roads only (FS 045). Vehicles are restricted to the existing roads and not permitted to travel off the road beds. A staging area to the north of the project area and located on the map will be used for staging of materials and equipment. Any known avoidance site will be flagged and avoided during construction of the fence. Flagging for avoidance will be white with red polka dots.

Any vehicles trucks, ATV’s or UTV’s will be washed and clean prior to accessing the worksite and free of seed and soil. When work is completed all vehicles will be washed and cleaned and free of any visible seed and soil from the worksite.

E. Restrictions:

If welding or cutting material that may cause sparks, then the work area must ensure within 25 feet of work is to be clear of all flammable material.

F. Estimated Start Date & Contract Time:

Estimated start date is April 1 2016, estimated contract time is 76 days (June 15, 2016).

G. Camping and Housing:

Contractor will be permitted to camp only in specified areas on US Forest Service land as approved by the District Ranger. Camping on Forest Service land is not a right; permission may be revoked for failure to comply with the terms of the permit.

Section C - Description/Specifications/Statement of Work Weber Ivesia Fence Protection Fence Construction-Humboldt-Toiyabe NF-

Carson Ranger District March 2016

A. Scope of Contract and Specifications:

The Contractor shall furnish the necessary personnel, material, equipment, and services to construct approximately 4000 feet of fence around several key areas of a rare plant population located on the Carson Ranger District, Humboldt-Toiyabe National Forest. Project will include construction of a 2 7/8" drill stem top- rail fence with a single two-strand smooth wire under the top rail. Bottom smooth wire is to be no less than 16 inches off the ground. Line posts will require drilling for post placement. Line posts will be saddle cut for top rail placement and wire guides will be welded for smooth wire placement. Wire guides to be approved by the COR.

Concrete for pole placement is to be used as needed minimizing ground disturbance where possible. All corners should be stabilized as needed with additional line posts and all protruding sharp pieces on the fence should be filed down. Specifications for the drill stem pipe will be 2 7/8 diameter pipe cut to 6 foot length with a wall thickness of 0.362”. One end of each pipe will cut and saddled. Saddled pipe is to allow a 2 7/8 drill stem line pipe to rest on the post so that it can be assembled and welded easily in the field. Attached is an example picture of a saddled cut stem pipe.

B. Project Location:

Reno, Nevada. From Reno, take I-80 west to Virginia Street exit, turn right on Virginia and follow past the University of Nevada. Continue on Virginia crossing McCarran, continue past Bonanza Casino and take the second left onto Hoge Road.

Follow Hoge Road to the National Forest boundary and trailhead. Once at first Kiosk turn north (right) onto a road that parallels powerline. Location is at top of hill and to the east. The fence location can be driven to with a truck or ATV. Fence location:

See the attached map.

Creek crossing- There are no major creek crossings.

Terrain- The elevation is continuous, running on mostly flat terrain. The fence runs along two track roads that surround a rare plant population. The point of the fence is to prevent motorized vehicles from trammeling rare plants. Soil is very rocky in most areas. Vegetation is limited to some brush and if clearing is required will be done by the contractor with hand tools or a chainsaw. Clearing is only necessary to ensure the fence is straight between braces.

C. Restrictions:

Contractor will have a minimum 25LB ABC fire extinguisher by any work that produces sparks. On Red Flag Warning days or Fire Weather Watches no welding may occur or activities causing sparks.

D. Estimated Start Date & Contract Time:

Estimated start date is June 15 2016, estimated contract time is 77 days (August 31, 2016).

E. Camping and Housing:

Contractor will be permitted to camp only in specified areas on US Forest Service land as approved by the District Ranger. Camping on Forest Service land is not a right; permission may be revoked for failure to comply with the terms of the permit.

WELDERS - Receive rate prescribed for craft performing operation to which welding is incidental.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion

4/4/2016http://www.wdol.gov/wdol/scafiles/davisbacon/NV30.dvb?v=0 date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

4/4/2016http://www.wdol.gov/wdol/scafiles/davisbacon/NV30.dvb?v=0

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.
