Solicitation No. AG‐024B‐S‐15‐9004 National CWN Helicopter Services U.S. Forest Service

CONTRACTOR REQUESTS FOR CLARIFICATION (RFQ’S)

1. We would like to propose aircraft that are not currently registered or have an airworthy certificate. Would this be a possibility? Yes, provided the aircraft meets the requirements listed in the amended Section E-2 Part II Subpart I.

2. B-1 Schedule of Items: “Equipped Weight includes the weight of a fixed tank or the weight of the empty bucket and any associated suspension hardware (cables, connectors, etc.) for restricted aircraft. See Clause C4 for reference.” Section C- 45 Definitions. “Equipped Weight” “Bucket Helicopters” “Does not include the weight of the bucket and any associated suspension hardware.” Which is correct? B-1 states the weight of the bucket is included in the equipped weight for restricted category and to reference C-45 for standard category. C-45 will be revised to include an explanation for restricted category aircraft.

3. B-5 Crew Coverage. The 2011 CWN solicitation required 7 day coverage at a level “C” (fuel truck driver and mechanic). This solicitation asks the bidder to decide the coverage level and crew compliment. If this is the intent, please define how operators with different coverage levels will be evaluated against each other during the dispatch process? Asking the bidder to decide coverage level was not the intent. The intent was to require the same staffing as the 2011 CWN Agreement. A revised B-5 is included in this amendment.

4. B-10 Overnight Standard Per Diem Rate Allowance. “Rates as published in Federal Travel Regulations.” C-43 Payment for Overnight Allowance. “No payment of CWN Personnel is authorized.” Which is correct? Payment for overnight allowance is only authorized when paid under the optional flight rate. Section B-10 has been revised and section C-32 has been added.

5. C-12 (c) 10. “Pilots may function as mechanics…” C-12 (i) 1. “Mechanic (other than the pilot) shall maintain the helicopter…” C-16 (d) 9. “When pilots act as a mechanic…” Which statement is correct? All statements are correct. A revised B-5 is included requiring a full time mechanic.

6. C-16 (e) 6. “When the mechanic serves as the fuel servicing vehicle driver…” Is this allowed? If so, under what circumstances? Section C-16 (e) (6) is for Type III helicopters only. A revised B-5 has been included to clarify minimum staffing.

7. Can Type II operators receive mileage for service maintenance pickup/trailers? No.

8. C-7 (b) Avionics Specifications. Please define what helicopters are required to have the Additional Telemetry Unit, Traffic Advisory Systems, and RADAR Altimeters. Aircraft offered on this solicitation must meet C-7 (a) (1) All Helicopters. The Additional Telemetry Unit, Traffic Advisory System and Radar Altimeter are not required.

9. On B-1 Schedule of Items the Category Line is missing (no place to indicate what category is offered as). A corrected B-1 Schedule of Items, adding the category column is included in this amendment.

10. Is a Mode S transponder required? The FAA requires 135 operators to use Mode S transponders in 135.143. There’s also a grandfather clause if the transponder was installed prior to 1992. We require contractors to meet the CFRs including this. Outside of the 135 requirement, we don’t require Mode S.

11. While reviewing Solicitation AG-024B-S-15-9004, National Call When Needed Helicopter Services, we came across a point about load calculations that needs to be clarified in three places.

a. In Section B-3, at the bottom of page 5, the statement “Applicable for Type II (Medium) Helicopters Bucket Example” appears to be incorrect since there is no reference to Type I Tanked helicopters. The statement “Applicable for Type II (Medium Helicopters Bucket Example)” should have been removed prior to the solicitation being published. The performance requirements in Section B-3 are applicable to all aircraft offered. A corrected Section B-3 is included in this amendment.

b. The paragraph under this statement includes the statement “For Computed Gross Weight use Exhibit 22 for load calculation.” In the solicitation, Exhibit 22 is reserved with no table or chart to pick computed gross weight. Removed in the corrected Section B-3.

c. Exhibit 13 also contains the statement “Vendors shall use Computed Gross Weight from Exhibit 22 for load calculation purposes for submitting proposals (See Exhibit 22 Computed Gross Weight).” We believe that these two references to Exhibit 22 need to be removed. A corrected Exhibit 13 is included in this amendment.

12. Will a certificate of participation in an approved commercially serviced Safety Management System such as ARG/US provide and be accepted as a description and evidence for the Safety Management System Components Questionnaire (Exhibit 31)?

No, answering the questions in Exhibit 31 are proof of use and understanding of SMS.

Commercially serviced SMS programs should have the content required to answer Exhibit 31. Offerors must answer Exhibit 31 to the best of their ability.

13. Currently we are reconfiguring an aircraft to meet all exclusive use requirements. This maintenance process makes the aircraft unavailable for weighing prior to the solicitation due date. For the purpose of this solicitation can I create a “Chart C” indicating the additional items to be installed and mathematically compute the new total weight and balance? Yes, submit your Weight and Balance documents representing the most accurate aircraft configuration in accordance with the revised B-3.

14. Form 1449. Section 10 states this solicitation is UNRESTRICTED. The Call-When- Needed (CWN) solicitation issued in 2011 utilized the contract clause FAR 52.219-6, Notice of Total Small Business Set-Aside. Why has this solicitation changed from Small Business Set Aside to Unrestricted? An analysis was done regarding orders the National Interagency Coordination Center (NICC) was unable to fill during the 2014 fire season.

The report showed there were 179 instances where we were unable to provide a requested helicopter. The conclusion drawn is there are currently an insufficient number of CWN helicopters that are actually available on the existing agreements. On that basis a Waiver was submitted and approved to run an unrestricted solicitation.

15. The solicitation states the requirements for the Type II, but we haven't found the requirements for the Type I yet can you please advise on the temperature and altitude and required weight for the Type I? Amended Section B-3 included see question 11 (A).

16. Please clarify with your responses next week if, on page 165 under Sub Part 1 (a & b), you want a copy of our Operations Specifications and Operations Manual. Yes, in electronic format as instructed in Section E-2.

17. Do we have to fill out the entire load calculation for Standard Category aircraft? For evaluation purposes only the Jettisonable (HOGE-J) column needs to be completed.

18. What constitutes an STC for evaluation purposes as stated in Section E-2 (g) and (h)? A modification summary page and the cover page for each STC will meet all requirements listed in Section E-2 (g) and (h).

19. What are the appropriate charts for completing a 212 load calculation? Use the performance charts which are applicable to the aircraft as it is modified. For most 212’s Aviation Safety Alert No. 2002-13 is applicable.

20. For aircraft that require a third crewmember, what are the flight time and duty limitations? C-16 is applicable to all Flight crewmembers including the flight engineer/flying crew chief.

21. Would it be possible to see the historical pricing on the previous 2011 CWN contract solicitation? For the Exclusive-Use contracts, the Government publishes the daily availability rates for all the contracts that it awards. Can you provide me the daily availability rates for 2014 for all type 1 and type 2 CWN contracts. No, pricing that is proposed under CWN agreements is considered proprietary to each contractor. Unlike Exclusive Use Contracts, there is not actually any funding commitment when a Contractor is awarded a Basic Ordering Agreement. As such, no pricing information is posted upon an agreement award.

22. Is a hard copy of the Technical section of the proposal required, or do you prefer just electronic copies of the Technical side of the proposal? Per the instructions in section E- 2, contactors are to provide electronic copies of the technical proposal. No hard copy is required.

23. Do you require ownership information on all proposed aircraft that are currently on the company’s Operations Specifications D085 aircraft listing as approved to conduct operations including those that are leased aircraft? Yes.

24. Do you require copies of all STC’s and Field Approvals for each aircraft over its entire lifetime, or would a modification summary page be sufficient? (note: most aircraft have a large “catalog” of STC and 337s)? See Question 17.

25. Under Section C-4 Helicopter Requirements, d-General Equipment, #15 is a split Red & White strobe light mounted on top of the aircraft acceptable in lieu of either a Red or White top mounted strobe light? Yes.

26. When bidding an aircraft that is not on our certificate, does the weight balance still have to be dated within the previous 12 months? No, providing it meets the requirements in the amended solicitation (B-3 and Section E-2 Part II Subpart I).

27. Also, does the letter just have to have make, model, and serial number and the FAA's intention to add it to our certificate? The letter must meet the minimum requirement listed in Section E-2 Part II Subpart I.

28. We are still working with the FAA to get the Type Certificate completed on aircraft we’ve recently purchases. We expect this to be completed within the next 60 days. All aircraft have a FAA N number assigned. Are you able to except our bid on the four aircraft?

Yes, providing the offer can meet the requirements in the amended solicitation (B-3 and Section E-2 Part II Subpart I).

29. B-1 Schedule of Items on Page 3 of the solicitation states that “Equipped Weight includes the weight of the empty bucket”, which conflicts with the definition of Equipped Weight found on Page 67, which states not to include the weight of the bucket with the aircraft. Could you please clarify which is the appropriate methodology? See question 2.

30. B-1 Schedule of Items on Page 3 references Clause C-4 when defining Equipped Weight but clause C-4 does not appear to provide any guidance on equipped weight.

Clause C-5 does provide some guidance on weighing aircraft. Can you please clarify the reference? Reference removed, corrected B-1 included in this amendment.

31. Clause C-4 (15) provides a requirement for a strobe light – will a strobe light with a white & red lens, or an LED strobe light with a white & red color output comply with this requirement? Yes.

32. Clause C-4 (18) is titled “variable capacity collapsible bucket(s)” and states” (For bucket and tank-equipped helicopters)”. It goes on to provide the altitude, temperature and minimum fuel criteria. Should we assume that load calculations should be performed with this criteria for all aircraft being submitted? Load calculations will be done in accordance with the performance requirements in the amended B-3.

33. Page 5 states that for Type II helicopters, we are to use the Computed Gross Weight table on Exhibit 22. This table (present in prior solicitations) was removed from Exhibit

22. Please clarify. There was no intent to use Exhibit 22 for this CWN solicitation, all reference has been removed with this amendment.

34. What exactly is a copy of a "self-validated" SMS audit? Do you have an example? Complete Exhibit 31 in its entirety that will provide the safety SMEs enough information regarding your companies SMS program.

35. I do understand that the actual weighing of the aircraft cannot be more than 12 months prior to the submission date; does the certification of the scales have to fall into that same 12 month period or within 12 months at the time of the weighing? Within 12 months at the time of weighing.

36. Section B-5 Crew Coverage, Pg. 6. Can the government please specify which crew coverage is required or does the vendor choose? A revised B-5 is included in this amendment.

37. Section B-7 Acceptable Work Schedules. We desire a 12/2 work schedule. However, it is nearly impossible to maintain this schedule throughout the fire season on CWN contracts. Will contractors be penalized if crew change outs are made more often? No, providing flight time/duty limits are met and notice is provided to the helicopter manager.

38. Section C-4 Helicopter Requirements. Are restricted category aircraft required to have floor protection within the cargo area? No.

39. Section C-7 Avionics Requirements. Are restricted category aircraft required to have a PA system? No, PA is required for Standard Category Exclusive Use only.

40. Section C-19 Personal Protective Equipment. What type or specification of fire shelter does the USFS require onboard an aircraft? Fire shelters must meet spec.5100-606 as stated in C-19.

a. Where and when can pilots obtain the required fire shelter training? NFES2710 provides guidance on fire shelter use. Hands on training should be conducted with the helicopter manager when a practice shelter is available.

41. Section C-20 Inspection and Acceptance. Are pilots required to complete the Grand Canyon training annually or every 36 months as indicated in the solicitation? The Grand Canyon Certificate of Waiver or Authorization expires annually and must be current for a pilot to be carded.

42. Would the FS prefer the technical proposal be saved as one document for the electronic copy or in sections? Either is acceptable, saving the document in sections should speed up review.

43. B-3 (b) (1) (iii) (A) 1. and C-5 (a) (15) (i) both specify that “For aircraft on the companies operating certificate that are currently operating outside of the US, the current operating weight and balance will be submitted…” However, E-2 Part II Technical Proposal Instructions state “Helicopters proposed in this solicitation that are physically outside of the United States shall have been on the contractor’s certificate prior to leaving the United States.” See Question 44.

44. Can we bid an aircraft that is currently outside the US and is not now on our 133 op specs (but was until it was exported) using the current weight and balance? Yes, providing the offer meets the requirements listed in the revised E-2 Part II Subpart I.

45. Section B-10 references an “Overnight Standard Per Diem Allowance” and the Federal Travel Regulations (“FTR”). It also references Exhibit C, which does not appear to contain any references to the FTR. Are contractors required to pay the FTR per diem rates, or does the reference to Section C mean that no such rates are required? An amended B-10 has been included in this amendment for clarification (See question 4).

46. C-4 (d) (17) (i) (A) specifies keeperless cargo hook. This previously excluded Type I helicopters. Can this exclusion be reinstated? Yes, an updated C-4 (d) (17) 91) (A) is included in this amendment.

47. C-4 (d) (17) (ii) (A) specifies minimum of 150’ long line with no segment shorter than 50’.

Can the 50’ segment restriction be eliminated for aircraft without tail rotors? No.

48. C-4 (d) (24) specifies locking caps on fuel filler ports. Will fuel fillers protected by an FAA approved locking compartment door or other locking cover be acceptable? Yes.

49. C-4 (d) (25) and Exhibit 5 (b) (16) specify wire cutters for standard category personnel transport helicopters. Are helicopters not contracted for personnel transport required to have wire cutters? No.

50. C-4 (d) (26) specifies FAA approved floor protection. Does this requirement apply to helicopters not contracted to carry passengers or internal cargo? No.

51. C-5 (a) (8) specifies notification to CO 16hrs prior to any maintenance inspection. This is a daily occurrence under progressive maintenance systems. Does the 16hr requirement apply to aircraft on progressive maintenance systems? No.

52. C-5 (c) specifies functional maintenance flights shall be at contractor’s expense.

Maintenance flights directed by USFS that are not required by the operator’s FAA approved maintenance program should be at government expense? The contractor is responsible for maintenance flight time costs.

53. C-7 (a) (4) specifies required avionics for Air Tactical Operations. Are water delivery helicopters on this contract considered Air Tactical? No.

54. C-7 (b) (4) (v) specifies altimeter maintenance to IFR requirements of 14CFR91.411.

Does this apply to aircraft not contracted to perform passenger missions? Yes, it applies to all helicopters.

55. C-7 (b) (4) (vi) specifies TAS. Is this applicable to NVG aircraft only per C-7(a) (3)? Yes.

56. C-7 (b) (5) (i) specifies Radar Altimeter. Is this applicable to NVG aircraft only per C-7 (a) (3)? Yes.

57. C-7 (b) (5) (iv) specifies VHF-FM programming ports. Are programming ports required for aircraft contracted for water delivery only? No.

58. C-7 (b) (5) (v) specifies GPS data connectors. Are data connectors required for Type I aircraft? No.

59. The Department of Labor concluded in 2014 that certain mechanics need to be paid at the “Mechanic II” rate. The solicitation acknowledges this in Section D-5, but the Wage Determination (Exhibit 16) does not include a rate for the Mechanic II position. Does USFS intend to seek the current Mechanic II pay rate from DOL and issue a modification including a revised Wage Determination? Wage Determination 1995-0221 has just been updated to include Aircraft Mechanic II & III. It is hereby incorporated into Exhibit 16 and included in the amendment.

60. Exhibit 28, PAO states “contractor/company is responsible for providing the following information to the FAA” regarding PAO. In discussions with Art Hinaman at the USFS WO on 28 Jan 15 we understand that the request from the contractor for a PAO declaration is not a requirement but an option for the contractor. If the request for a PAO declaration is not made, the contractor may continue operations as a civil aircraft in compliance with the FAR’s. Is this interpretation correct? Yes.

61. Section D-10 is Clause FAR 52.212-5 (OCT 2014). The most current version is (DEC 2014). Should this be updated?

Note: The DEC 2014 version of this clause adds under subparagraph (a)(1) FAR 52.209-10 dated DEC 2014; and removes under subparagraph (b)(10) FAR 52.209010 dated MAY 2012 and leaves the text marked RESERVED. There will be no update to this clause (FAR 52.209-10 had originally been marked as applicable).

62. Section D-10 subparagraph (e) (1) (vi) is FAR citation of 52.222-17 Employment Records on Veterans (JUL 2014). Should this be FAR 52.222-37? FAR 52.222-37 is actually the correct citation. This clause is checked as applicable (31) under section (b) of D-10.

63. Note: Section E header (contract #) is from the 2011 CWN Solicitation. Corrected and included in amendment.

64. E-2 Sub-Part 1 (g) specifies copies of STC’s or Field Approvals for aircraft. Are the full STC or 337 packages required, or are the approval pages for each sufficient? See question 18.

65. E-2 Sub-Part 1 (g) and (h) both specify a summary table of STC’s. Do these tables need to be provided twice or should this be item (h) only? Once will meet the requirement.

66. E-2 Sub-Part 1 (i) specifies Helicopter Load Calculation. Is this a duplicate of the Interagency Helicopter Load Calculation specified in Sub-Part 2 (a) or something else?

The intent was to list mandatory documentation (pass/fail) and Aircraft performance evaluation separately. One load calculation will meet both requirements.

67. E-7 Helicopter Performance Questionnaire is not listed as part of the bid package in E-2.

Is the E-7 chart required in bid submission? If so, where? It is requested under E-3 (2) Aircraft Performance, intended for planning purposes and not a part of “required documents”.

68. Paragraph B-1 states: The weighing shall be accomplished prior to submission of the proposal. The weighing must take place within 12 months prior to award of any agreements under this agreement. All other references to weighing refer to 12 months prior to the Submission of Bids. Will Schedule B-1 be modified to be consistent with the other references? Yes, a new section B-1 is included in this amendment.

69. The B-1 Instructions refer to “Category” however, there is not a column for Category in the Table. Will the Category Column be added to the table? Yes, a new section B-1 is included in this amendment.

70. Then the paragraph states the Minimum Capability of a 1600 pound payload for Hovering out of ground effect at 5,000 ft and 30C. Is the Capability requirement the same for Type I and Type II? Yes, anew section B-3 is included in this amendment.

71. Paragraph C-4 (17) references Cargo Hooks, keeperless cargo hooks are not available for our helicopters, can the requirement be changed? Yes, an updated C-4 (d) (17) (1)

(A) is included in this amendment.

72. This requires the SIC’s to have a minimum of 500 hours in helicopters. This language was removed from the last CWN solicitation can this requirement be removed? Yes, updated language is included in this amendment.

73. Paragraph C-19 (f) Contractor will provide USFS approved personal fire shelters (spec.

5100-606) for all contractor personnel covered under this contract. Instruction in the use of shelter deployment shall be provided by the contractor and be verified by the Helicopter Manager. Shelter deployment training shall be completed yearly. The condition and care of the shelter will meet USFS standards. Fire shelter shall be on-board the helicopter at all times while under contract and included in the equipped weight. Ground crews shall have fire shelters readily available for use if needed. This paragraph Requires Fire Shelters for all contractor personnel. Are fire shelters required for mechanics and fuel truck drivers that work only at the heli-base? Yes.

74. Exhibit 13 refers to Exhibit 22, Exhibit 22 is RESERVED and is not Computed Gross Weight. What is the correct reference? Exhibit 22 was not intended to be used for this solicitation. All reference has been removed with this amendment. Use actual aircraft Computed Gross Weight for load calc.

75. Section E – The header for section E refers to Solicitation AG-024B-S-11-9006; this was a previous CWN Solicitation. Should this be changed? See Question 63.

76. Can we offer a Medium Type II Standard category Helicopter in a Limited Capacity, operating under part 133 rules and not part 135 (carrying passengers)? Yes

77. On page 3, B-1 Schedule of Items there is not a column to indicate the category of the aircraft; where would you like us to acknowledge the Category? A corrected B-1 is included in this amendment.

78. On Exhibit 8 - Fuel Servicing Equipment Requirements, page 89 section (a) General (1), who provides the USFS or USDI-AMD inspection sticker? Does this replace the Hard Card that has been required in previous years? Approved inspectors from either agency will approve the fuel servicing vehicle. The sticker or card is acceptable.
