4. Scope of Work
a. This solicitation, and any resulting contracts, is for roadside brush cutting along Forest Service roads on the Tongass National Forest. Work includes furnishing all labor, equipment, supervision, transportation, operating supplies and incidentals necessary to perform vegetation removal on roadway surfaces and roadsides as specified in Task Orders.
b. Type & Timing of Services: Services include removal of woody debris from traveled way and shoulders of forest roads. Work occurs from late spring throughout the summer and into early fall.
c. Volume of Work: The estimated quantities stated in the Schedule of Items are for pricing purposes only for this contract. The actual volume of work included in each task order will depend upon available funding and road conditions. Each task order will include a Mobilization lump sum pay item that is specific to that task order.
5. Resources Provided by the Contractor
a. The Contractor shall assume all risk, loss, damage, or expense arising out of the prosecution of the work, except as otherwise provided in the contract.
b. Unless otherwise stated in the solicitation, the contractor shall furnish all material required for performance of the contract. All material shall comply with these specifications.
c. The Contractor shall furnish and deliver the material to the site of the work in such a manner that their quality and fitness for the work is preserved.
d. Measurement and payment for contract work will be made only for those pay items included in the Schedule of Items.
e. The Contractor shall be responsible for furnishing warning devices and complying with the safety standards and traffic management procedures as specified in Section C of this solicitation.

104.06 Use of Roads by Contractor
The Contractor is authorized to use roads under the jurisdiction of the Forest Service for all activities necessary to complete this contract, subject to the limitations and authorizations designated in the Road Order(s) or described in the contract, when such use will not damage the roads or national forest resources, and when traffic can be accommodated safely.

106.01 Conformity with Contract Requirements.
Delete Subsection 106.01 and substitute the following:
Follow the requirements of FAR Clause 52.246-12 Inspection of Construction.
References to standard test methods of AASHTO, ASTM, GSA, and other recognized standard authorities refer to the methods in effect on the date of solicitation for bids.
Perform all work to the lines, grades, cross-sections, dimensions, and processes or material requirements shown on the plans or specified in the contract.
Incorporate manufactured materials into the work according to the manufacturer’s recommendations or to these specifications, whichever is stricter.
Plan dimensions and contract specification values are the values to be strived for and complied with as the design values from which any deviations are allowed. Perform work and provide material that is uniform in character and reasonably close to the prescribed value or within the specified tolerance range. The purpose of a tolerance range is to accommodate occasional minor variations from the median zone that are unavoidable for practical reasons.
When standard manufactured items are specified (such as fence, wire, plates, rolled shapes, pipe conduits, etc., that are identified by gauge, unit mass, section dimensions, etc.), the identification will be considered to be nominal masses or dimensions. Unless specific contract tolerances are noted, established manufacturing tolerances will be accepted.
The Government may inspect, sample, or test all work at any time before final acceptance of the project. When the Government tests work, copies of test reports are furnished to the Contractor upon request. Government tests may or may not be performed at the work site. If Contractor testing and inspection is verified by the Government, the Contractor’s results may be used by the Government to evaluate work for acceptance. Do not rely on the availability of Government test results for process control.
Acceptable work conforming to the contract will be paid for at the contract unit bid price. Four methods of determining conformity and accepting work are described in Subsections 106.02 to 106.05 inclusive. The primary method of acceptance is specified in each Section of work. However, work may be rejected at any time it is found by any of the methods not to comply with the contract.
Remove and replace work that does not conform to the contract, or to prevailing industry standards where no specific contract requirements are noted, at no cost to the Government.
Disputing Government test results. If the accuracy of Government test results is disputed, promptly inform the CO. If the dispute is unresolved after reasonable steps are taken to resolve the dispute, further evaluation may be obtained by written request. Include a narrative describing the dispute and a proposed resolution protocol that addresses the following:
Sampling method;
Number of samples;
Sample transport;
Test procedures;
Testing laboratories;
Reporting;
Estimated time and costs; and Validation process.
If the evaluation requires additional sampling or testing be performed, mutually agree with the Government on witnessing procedures and on sampling and testing by a third party laboratory. Use a third party laboratory accredited by the AASHTO accreditation program. Provide proof of the laboratory’s accreditation for the test procedures to be used. Do not use the same laboratory that produced the disputed Government test results or that produced the test results used as a basis for the dispute. The CO will review the proposed resolution protocol and may modify it before final approval and execution.
The Government will use the approved resolution protocol test results to determine the validity of the disputed testing. If the Government test results are validated, the Contractor will be responsible for all costs associated with developing and performing the resolution protocol. If the Government test results are not validated, the Government will be responsible for all costs associated with developing and performing the resolution protocol. If the validity of the Government test results cannot be determined, the Contractor and Government will equally share all costs associated with developing and carrying out the resolution protocol.
(b) Alternatives to removing and replacing non-conforming work. As an alternative to removal and replacement, the Contractor may submit a written request to:
Have the work accepted at a reduced price; or Be given permission to perform corrective measures to bring the work into conformity.
The request must contain supporting rationale and documentation. Include references or data justifying the proposal based on an evaluation of test results, effect on service life, value of material or work, quality, aesthetics, and other tangible engineering basis. The CO will determine disposition of the nonconforming work.

Design and locate equipment repair shops, stationary refueling sites, or other facilities to minimize the potential and impacts of hazardous material spills on Government land.
Before beginning any work, submit a Hazardous Spill Plan. List actions to be taken in the event of a spill.
Incorporate preventive measures to be taken, such as the location of mobile refueling facilities, storage and handling of hazardous materials, and similar information. Immediately notify the CO of all hazardous material spills. Provide a written narrative report form no later than 24 hours after the initial report and include the following:
Description of the item spilled (including identity, quantity, manifest number, and other identifying information).
Whether amount spilled is EPA or state reportable, and if so whether it was reported, and to whom.
Exact time and location of spill including a description of the area involved.
Containment procedures.
Summary of any communications the Contractor had with news media, Federal, state and local regulatory agencies and officials, or Forest Service officials.
Description of clean-up procedures employed or to be employed at the site including final disposition and disposal location of spill residue.
When available provide copies of all spill related clean up and closure documentation and correspondence from regulatory agencies.
The Contractor is solely responsible for all spills or leaks that occur during the performance of this contract.
Clean up spills or leaks to the satisfaction of the CO and in a manner that complies with Federal, state, and local laws and regulations.

842 Roadside Brushing
842.01 Service Required Remove vegetation, including trees, on roadway surfaces and roadsides.
842.02 Performance Standard
Roadway vegetation maintenance is complete when the vegetation has been removed from the designated treatment area which interferes with traffic, obscures signs, impedes the flow of water or diverts water from drainage structures.
Method A Treatment Area: From 5’ Slope Distance Beyond Toe of Ditch to 10’ Slope Distance on Fill Slope
Method B Treatment Area: From Toe of Ditch to 5’ Slope Distance on Fill Slope
General Notes
Cut all brush within treatment area which is less than or equal to 6 inches in diameter measured 6 inches above ground.
For Method A, cut brush back 5 feet slope distance beyond bottom of ditch or 15’ slope distance from road shoulder, whichever less, and 10 feet slope distance beyond edge of road shoulder on fill slope.
For Method B, cut all brush within 5 feet of culvert inlets.
Cut brush to provide overhead clearance of 14 feet on road surface.
Remove debris from road surface, ditches, and cut slope above road. Scatter to fill slopes below road, no debris piles allowed at culvert outlets.
Clear ditches of woody debris. Clean culvert inlets and outlets of debris a minimum of 2 culvert diameters.
Cut brush to provide sufficient site distance on the inside of sharp curves to eliminate blind corners and intersections.
842.03 Location of Work As specified on roads listed on the ROAD LISTING, SHOWN ON THE PLANS, or as ordered by the Contracting Officer.
842.04 Measurement Measurement under this Section will be made by the total number of units for each item listed in the SCHEDULE OF ITEMS completed and accepted.
Mile: Work activity will be measured along the centerline of the road regardless of the number of lanes, each mile of roadway will include treatment on both sides of the road.
842.05 Payment The accepted quantities will be paid at the contract price per unit of measurement for the Section 842 pay items listed in the schedule of items. Payment will be full compensation for the work prescribed in this Section.

881 Mobilization 881.01 Service Required Mobilization of personnel, equipment, and material to the project site.

881.03 Location of Work:
As specified on roads listed on the ROAD LISTING, SHOWN ON THE PLANS, or as ordered by the Contracting Officer.
881.04 Measurement:
Measurement under this Section will be made by the total number of units for each item listed in the SCHEDULE OF ITEMS completed and accepted.
881.05 Payment The accepted quantities will be paid at the contract price per unit of measurement for the Section 881 pay items listed in the schedule of items. Payment will be full compensation for the work prescribed in this Section.
Progress payments for mobilization will be reimbursed according to FAR Clause 52.232-5 Payments Under Fixed-Price Construction Contracts, after receipt of the evidence of payment.
When 5 percent of the original contract amount is earned from other bid items, 50 percent of the mobilization item, or 5 percent of the original contract amount, whichever is less, will be paid.
When 10 percent of the original contract amount is earned from other bid items, 100 percent of the mobilization item, or 10 percent of the original contract amount, whichever is less, will be paid.
Any portion of the mobilization item in excess of 10 percent of the original contract amount will be paid after final acceptance.

7. Signing and Safety
a. A reflectorized SLOW MOVING VEHICLE emblem shall be attached to any equipment not designed to maintain a safe travel rate or that will be moving at a slow rate while performing maintenance.
b. It shall be the Contractor’s responsibility to furnish black and orange reflectorized maintenance warning signs to alert motorists of maintenance operations. A minimum of one (1) sign at each end of road sections being maintained shall be kept in place at all times and shall be moved as work progresses.
c. If a berm is left in the roadway overnight or weekends due to weather conditions or breakdowns, it shall be properly signed as a hazard and visibly illuminated at night by Type B High-Intensity Flashing Warning Lights with a minimum mounting height of 36 inches to bottom of lens as required by the Manual of Uniform Traffic Control Devices.
8. Damage to Structures
The Contractor shall be held liable and is responsible for any damage caused by Contractor’s personnel or equipment to any bridges, guardrails, culverts, signs, and riprap-protecting culvert inverts. Repair to these structures shall be at the Contractor’s expense and at no additional cost the Government.
9. Activity Report
The Contractor shall maintain and furnish a Daily Activity Report reporting maintenance activity performed.
Reports shall be furnished to Contracting Officer on a weekly basis.
10. Definitions: Wherever in these specifications, or in other contract documents, the following terms, or pronouns in place of them, are used, the intent and meaning shall be interpreted as follows:
a. Agreed or Approved - Official agreement or approval by use of a written document issued by the Government. Agreements also require signature of Contractor's Representative and are dated.
b. Berm - A curb or dike which controls roadway runoff water, or delineates traffic direction. Berms commonly parallel road centerline; however, on Limited Use Roads may be placed diagonally across the roadbed.
(See Illustration of Road Maintenance Terms.)
c. Channel - A natural waterway leading into or away from a culvert or bridge.
d. Contract Amendment - A bilateral written supplemental agreement between the Government and the
Contractor, documenting a modification outside the scope of the contract and establishing an equitable adjustment therefore.
e. Contractor - The individual, partnership, joint venture, or corporation undertaking the execution of the work under the terms of the contract.
f. Culvert - Any structure which provides a passageway, drain, or waterway under a road or embankment.
g. Cross ditch - A shallow ditch placed across the roadbed to remove water from the roadbed surface which can be driven across by full-size pickups or other high clearance vehicles; usually placed diagonal to the centerline.
h. Ditch - A relatively long narrow excavation placed to collect or disperse water.
i. Drainage dip - A drainage structure which was previously constructed within the roadbed surface to form a uniform depression which allows routine passage of vehicles while diverting water from the traveled way.
j. Drainage structure - A term identifying man-made devices placed to control water movements.
k. Drawings - Illustrations showing detailed maintenance required.
l. Equipment - All machinery, operating supplies and tools necessary for the proper performance and acceptable completion of the work.
m. Fore slope - The slope of the ditch section nearest to the traveled way. (See Illustration of Road
Maintenance Terms.)
n. Government - The Contracting Officer or the duly authorized Contracting Officer's Representative (COR) with authority to sign orders.
o. Grade - The vertical alignment of the top surface of the road.
p. Inspector - The Government's authorized representative designated in writing, assigned to make detailed inspections of contract performance, but not to sign orders to the Contractor.
q. Measurement - Method of determining and expressing the quantities of work.
r. Nominal Dimensions or Weights - The numerical values shown on the drawings or in the specifications as measurements for the work.
s. Order - A written order by the Government directing fulfillment of work requirements under the terms of the contract.
t. Original Contract Quantities - Those estimated quantities shown in the Schedule of Items as awarded.
u. Paved Surface or Pavement - Denotes asphalt, concrete, or other stabilized materials excluding natural aggregates. Dust palliative treatments are not considered as pavement.
v. Reasonably Close Conformity - Means compliance with customary maintenance tolerances where working tolerances are not specified.
w. Right-of-Way - A general term denoting land, property, or interest therein acquired for or devoted to a road.
x. Roadbed - The portion of a road between the intersection of the subgrade and side slopes, excluding that portion of the ditch below the subgrade. (See Illustration of Road Maintenance Terms.)
y. Road Listing - A preliminary listing of road locations and any established work priorities.
z. Roadside - (See Illustrations of Road Maintenance Terms).
aa. Schedule of Items - Schedule containing a listing and description of maintenance items, quantities, and units of measure, methods of measurement, unit price, and amount.
bb. Slough or Slide - Material deposited on the roadway which may need to be repositioned or removed.
cc. Slump - A localized portion of the roadbed which has slipped or otherwise become lower than that of the adjacent roadbed and constitutes a hazard to traffic.
dd. Special Project Specifications - Specifications which detail conditions and requirements peculiar to the individual project.
ee. Standard Specifications - Specifications for specific divisions of work.
ff. Traveled Way - The portion of the roadway for the movement of vehicles. For purpose of this contract, traveled way includes turnouts and curve widening. (See Illustration of Road Maintenance Terms.)
gg. Turnouts - A short auxiliary lane on a one-lane road provided for passage of meeting vehicles.
hh. Unit of Measure - The unit and fractions of units shown in the Schedule of Items.
ii. Waterbar - A deeper type cross ditch which is not intended for passage of traffic. Waterbars intersect ditch flows and transport flows to the lower side of the roadway.
jj. Work Schedule - The Contractor's current schedule for work progression.
11. Abbreviations: Whenever in these specifications, or in other contract documents, the following terms, or pronouns in place of them, are used, the intent and meaning shall be interpreted as follows: (Reference to a specific standard or specification shall mean the latest addition or amendment thereto in effect on date of Invitation for Bids.)

12. Project Labeling For Official Correspondence
a. The Government singularly identifies each project with a contract number at time of Award. The contract number is a unique identifier to purposely and permanently represent an awarded project. The Government issued contract number is to be referenced on all official communication starting upon notice of award.
b. Note: The main or parent contract number of the IDIQ will have “C” for contract indicator in the number.
Task Orders will have a similar number format but will have a “D” in place of the “C”.
13. Contractor’s Quality Control Plan
a. The Contractor shall provide a quality control plan, which is mutually agreed upon with the Contracting Officer. This plan shall describe the Contractor’s method for ensuring all work meets the contract requirements.
At minimum, the Quality Control Plan shall outline how the quality of work will be monitored, how the crew will be supervised, and who will perform the quality control function. Contractor shall provide the Contracting Officer with documentation of quality control inspections.
b. The Contractor shall, within 5 days from receipt of a request from the Contracting Officer, submit a progress schedule to complete all work ordered within the time stated in the Task Order. If the Contractor falls behind schedule, the Contractor shall take such action as necessary to recover. The Contracting Officer may require the Contractor to submit a revised schedule and proposed plan of work to ensure completion of the work within the time stated in the Task Order.
14. Quantity Measurement Terms
a. Measurement under the contract shall be according to the United States standard measure.
b. The methods of measurement and computation will be those necessary to accurately determine the quantities of materials furnished and work performed.
c. Miles will, in the absence of known distances from existing plans or surveys, be determined by the
Government using a calibrated survey odometer or equal substitute operated on the traveled way at or parallel to road centerline.
d. Linear mile measurement will mean the sum of the road length parallel to the centerline.
e. Measurement will be made of each item or unit of work, as shown in the Schedule of Items, completed and accepted in accordance with the contract.

16. Performance Standards
a. For all tasks, the penalties for poor performance are:
(1) Contractor may be required to re-work the unacceptable portion of the work, at the Contractor’s expense;
(2) Contractor may receive a poor performance rating for this contract;
(3) Government may withhold partial, or full, compensation;
(4) Contractor may be required to replace lost, or damaged Government property; and
(5) Contract may be terminated for the contractor’s default.
b. For all tasks, the incentives for high quality performance are:
(1) Contractor will receive a superior performance rating; and
(2) The Government is more likely to select the Contractor for future Task Orders.
17. Contracting Officer’s Representative
The Contracting Officer will designate a representative, hereinafter referred to as the Contracting Officer’s Representative (COR) or, alternatively, as the Engineer, who will provide on-the-ground administration for the Government. The COR will be designated in writing and a copy of the designation will be furnished to the Contractor before or at the pre-work conference. The Contractor is cautioned to read the COR designation because certain authority under the contract is reserved solely for the Contracting Officer. The term “Contracting Officer” as used throughout the contract shall be interpreted to include the Contracting Officer’s designated representative(s) acting within the limits of their delegation of authority.
18. Contractor’s Representative
Any representative of the Contractor shall be designated in writing. The designation shall clearly indicate the name and limitations of authority, if any, of the representative.
19. Contract Prices and Task Order Prices
a. The Government may use the prices in this contract, within any conditions specified, for task orders issued under this contract. However, whenever the Government issues a task order with a contractor or provides an opportunity to more than one contractor to compete for a task order, the contractor may offer discounts to this contract's prices or other concessions which might enhance its likelihood to be selected for award of the task order.
b. Any discounts or concessions offered by a contractor for a task order apply only to that particular task order, and do not modify this contract or affect already-completed, on-going, or future task orders.
c. For the purpose of this clause, discount means a reduction to the contract prices.
d. For the purpose of this clause, concession means any benefit, enhancement or privilege (other than a discount), which either reduces the overall cost of the Government's acquisition or encourages the Government to select the contractor offering the concession.
20. Task Ordering Procedures
a. To order services under this contract, a task order announcement will be forwarded to the Contractor(s) identifying the specific requirements of the individual order on a Standard Form (SF)-1449 Solicitation/Contract/Order for Commercial Items. The Contractor(s) shall prepare and submit a response to the task announcement by the due date stated on the announcement. Upon award of a task announcement, the Contracting Officer will issue a written task order for work on a SF-1449.
b. Any warranted Contracting Officer within the USFS Alaska Region may issue a task order exceeding $500 for this contract. If a Fair Opportunity exception applies, the task order announcement will be issued to one contractor. The task order announcement will include a due date for proposal submission and a Statement of Work (SOW) which includes a detailed description of work to be accomplished, a listing of the deliverables required, and additional data as appropriate.
21. Task Order Announcement Media
a. As Government needs are identified, Task Announcements detailing the specific services to be provided will be issued in writing and transmitted by email. Thus participating contractors must provide the government with an active email address and are responsible to notify the government if the email address is changed.
b. The Government will make every effort to provide adequate time for contractors to make informed responses to task announcements. Typical announcement times will be from 14 to 21 days between issuance and closure. Shorter times may be necessary to fill more urgent requirements.
c. Offerors are urged and expected to inspect the site where the work will be performed on resulting task orders.
22. Award of Task Orders & Fair Opportunity
a. Contractors are bound to accept task orders within the ordering limitations defined in the ordering clauses.
b. If a contractor is awarded multiple task orders, work shall be completed concurrently unless otherwise specified in a task order.
c. Competitive task order awards will be made to the Contractor(s) who provide the best value to the
Government, including:
(1) Past performance on earlier task orders under this contract including quality and timeliness.
(2) Potential impact on other orders placed with the contractor.
(3) Price including price realism and price reasonableness.
d. The Contracting Officer will give every contractor a fair opportunity to be considered for a task order unless one of the following exceptions applies:
(1) The Governments need for the service is so urgent that providing a fair opportunity would result in unacceptable delays.
(2) The order must be issued on a sole source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.
(3) It is necessary to place an order to satisfy a minimum guarantee.
23. Minimum Guarantee Each contractor selected as a multiple award contractor under this IDIQ is guaranteed a minimum award of $500.00 at the end of the contract period including the two option years if the contractor has not been awarded any task orders within any area. The government will pay this amount, upon receipt of an acceptable invoice, if the contractor has responded to and submitted competitive prices on at least fifty percent (50%) of the task order announcements they are eligible to compete. The Contracting Officer will notify the unsuccessful contractors if their prices were considered outside the competitive range based upon the competitive prices received from other IDIQ contractors and the government estimate.
24. Fair Opportunity Ombudsman
Ombudsman Description. In accordance with FAR 16.505(a)(6), no protest under FAR subpart 33.1 is authorized in connection with CO decisions regarding fair opportunity or the issuance of a TO under this contract, except for a protest on the grounds that a TO increases the scope, period, or maximum value of the contract. The Ombudsman will review complaints from the contractors and ensure that all contractors are afforded a fair opportunity to be considered consistent with the procedures in the contract. 25. Email and Telephone Communications
For the life of this contract, the contractor shall monitor the email address and telephone number provided to the government. The government requires response to email or telephone inquiries within three days. Not responding within three days is an un-satisfactory business practice and will reflect unfavorably on the performance evaluation and subsequent source selections. Email sent by the government to the contractor shall be considered received the same day they are sent.
26. Work’s Compensation Laws
Alaska state law requires that all employers have Worker’s Compensation Insurance for their employees. The Forest Service furnishes contract award information to the Alaska Department of Labor. Failure to comply with the state worker’s compensation laws can be a felony offense in Alaska. The Alaska Workers’ Compensation Division can also fine employers up to $1,000 per employee for each day they are conducting business with employee labor without the required insurance. 28. Final Payment
Contractor is required to send a completed Contract Release, Form 6300-16, to the CO when the final invoice is submitted.
29. Landscape Preservation
a. Confine operations to within the clearing limits or other areas designated in contract documents, and prevent the depositing of rocks, excavated materials, stumps, or other debris outside of these limits. Unless otherwise agreed to by the CO, retrieve material which falls outside of these limits and either incorporate the material in the work or dispose of the material as directed by the CO.
b. Schedule and conduct operations to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.). Install silt fencing around areas immediately next to streams and ponds to mitigate suspended sediments when designated on the drawings.
c. Do not discharge pollutants such as raw sewage, and other harmful materials into or near rivers, streams, and impoundments or into natural or manmade channels leading thereto. Do not allow wash water or waste water from concrete or aggregate operations to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.
d. Collect and return waste motor oils, fuels, lubricants, bitumens and similar hydrocarbons to the supplier.
Comply with the requirements of 40 CFR 279, Standards for the Management of Used Oil. Do not discharge hydrocarbon products on the ground, use them for road oiling, or bury them in a landfill.
e. Do not operate mechanized equipment in live streams without written approval of the Contracting Officer.
f. CREEK CROSSINGS: Schedule and conduct bridge and instream work to minimize disturbance to streams.
(1) Do not cross streams without Contracting Officer approval.
(2) Submit a written equipment crossing plan to the Contracting Officer for approval 14 calendar days before creek crossing is planned. Two machine crossings will be permitted in the designated window for all streams designated on the drawings as fish streams. Outside of this time period, no machine crossings will be permitted if fish eggs are present in the gravel or adult fish are present in the stream; otherwise two machine crossings will be permitted.
(3) Limit machine crossings to two times for all live streams not designated on the drawings as fish streams with pipes 48” and larger to be installed.
(4) Do not leave temporary bridges in place between September 15 and March 15, unless approved in advance in writing by the Contracting Officer.
g. Obtain necessary permits for floating camps, floats, shore ramps, and other appurtenances associated with project operations from the following State of Alaska and Federal Agencies:
(1) ADNR - Alaska Department of Natural Resources.
(2) ADEC - Alaska Department of Environmental Conservation.
(3) ADGC – Alaska Department of Governmental Coordination.
(4) EPA – US Environmental Protection Agency.
(5) DA, COE – US Army Corps of Engineers.
(6) USCG – US Coast Guard.
30. Use Of Premises
a. Obtain written approval from the Contracting Officer before opening or operating on National Forest land or lands administered by the Forest Service any camp, quarry, borrow pit, storage area, detour, or bypass site, other than SHOWN ON THE DRAWINGS. A camp is interpreted to include the camp site or trailer parking area of any employee working on the project for the Contractor. Such approval, if granted, will be without charge to the Contractor.
b. Sanitation Facilities: Provide and maintain the following facilities for the work force at the camp, unless provided otherwise.
(1) Meet State of Alaska drinking water regulations 18 AAC 80 regarding potable water supplies for drinking, washing and cooking.
(2) Comply with State of Alaska wastewater disposal regulations 18 AAC 72 for domestic sewage.
(3) Ensure that the design, operation, and maintenance of all solid waste systems under Forest Service jurisdiction meet all Federal, State, and local requirements. Meet State of Alaska solid waste management regulations (18 AAC 60) and Federal regulations contained in 40 CFR 243, 40 CFR 245, 40 CFR 257, and 40 CFR 258. Remove solid wastes and/or residues and dispose of in approved commercial landfills.
(4) Meet the requirements of 40 CFR 112 (Oil Pollution Prevention) for fuel storage. Meet the requirements of 33 CFR 150 and 33 CFR 154 for facilities transferrring oil or hazardous materials in bulk.
c. Do not begin any camp development, either land based or floating, until a plan for development, occupation, and cleanup is submitted and approved by the Contracting Officer. Include the following informationon this plan:
(1) Location and size of the proposed camp development, including a map.
(2) Wastewater system.
(3) Number of people who will use the site and proposed dates of occupancy.
(4) Power supply system and Water supply system.
(5) Building layout, shop area, living quarters.
(6) Road and trail layout.
(7) Clearing limits and slash disposal locations.
(8) Borrow areas.
(9) Dock and access location.
(10) Equipment and fuel storage area and Spill Prevention Control and Countermeasure (SPCC) plan.
(11) Incinerator location and ash disposal plan.
d. Forest Service will review plan as submitted for completeness and applicability. Proposed modifications of Contractor's plans will be discussed with the Contractor prior to approval. Any modifications agreed upon will be incorporated in a revised set of plans.
31. Contractor's Use And Maintenance Of Existing Roads
a. The Contractor is authorized to use roads in the immediate construction project area for performance of work under this contract. Such roads are those which are necessary for direct access to designated borrow sites, quarries, stockpile sites, waste areas, campsites, equipment unloading ramps, and other approved work areas. The roads authorized for use will be subject to the following general conditions:
b. Federal Regulations contained in 36 CFR 261.12; except vehicle weight will not exceed that of AASHTO HS20-44 and/or U80 Loading. Submit written requests to the CO for approval to use L90 and U102 overload Loadings on roads authorized for use. Regulations prohibit damaging a road or blocking a road open to use by others, except as otherwise provided in Special Project Specification 104.
c. The Government will not snowplow roads for the Contractor's use. The Contractor may snowplow any road designated for his use. A permit defining snowplowing requirements is required and will be issued by the District Ranger, upon request by the Contractor. Repair any damage to the road structure caused by snow removal operations. Vehicles, other than conventional over-the-snow vehicles (snowmobiles), will not be permitted to use roads when there is an average of more than 4” of snow unless the road has been snowplowed.
d. The Contractor is responsible for and will perform road maintenance on Forest Service roads in the construction area commensurate with his use. Perform road maintenance at such intervals that prevent deterioration of the roadway, or as directed by the Contracting Officer.
32. Other Contracts
The Government may undertake or award other contracts for additional work at or near the site of the work under this contract. The Contractor shall fully cooperate with the other contractors and with Government employees and shall carefully adapt scheduling and performing the work under this contract to accommodate the additional work, heeding any direction that may be provided by the Contracting Officer. The Contractor shall not commit or permit any act that will interfere with the performance of work by any other contractor or by Government employees.
33. Emergency Fire Precautions
a. Contractor shall restrict operations in accordance with the Emergency Fire Precautions Schedule.
b. It shall be the Contractors responsibility to monitor and obtain the predicted Fire Precautions Class from the appropriate Forest Service Office. If predictions made after 1800 local time are significantly different than originally estimated, Forest service will inform the Contractor when a change in restrictions or fire precautions are indicated.
EMERGENCY FIRE PRECAUTIONS SCHEDULE
c. Forest Service may change the fire danger values to other essentially equivalent values, when the Fire
Danger Rating Systems is revised. In this event a new Emergency Fire Precaution Schedule will be prepared.
When sent to the Contractor it will supersede the schedule here.
d. During periods of high fire danger, the Forest Service may suspend operation until danger is passed. An adjustment in contract time may be made for this period.
