CONTROLLED UNCLASSIFIED INFORMATION

April 2021 CONTROLLED UNCLASSIFIED INFORMATION Page 2 of 5April 2021 CONTROLLED UNCLASSIFIED INFORMATION Page 2 of 5

I. Agency and Contracting Activity.

FA2263 - AFLCMC/WNMK

AFLCMC/WNMK, 813 Irving-Wick Dr. W, Horton Bldg, Heath, OH 43056-6116

II. Nature and/or description of the action being approved.

This J&A action is a short term modification to contract F09650-01-C-0267 (being considered a bridge action) to ensure continuation of necessary services provided under existing cost-plus-award fee contract, F09650-01-C-0267.

Under this, the Bionetics Corporation will support the Air Force Primary Standards Laboratory (AFPSL) for the duration required to accomplish re-evaluation of the new contract awarded 17 Mar 21, which was protested and sustained by the GAO. The modification will contain a CLIN structure for a base period not exceeding eight (8) months, and will include extension clause, FAR 52.217-9, Option to Extend the Term of the Contract, to allow for six

(6) one-month option periods, if necessary.

III. Description of supplies/services required to meet agency needs (including the estimated value).

The contractor shall furnish all personnel, equipment, tools, materials, supervision, and other items and services necessary to perform the AFPSL services; and the preparation, modification, editing, reproduction, storage and distribution of 33K-series calibration technical orders. The contractor shall provide maximum support to Air Force activities, other Federal agencies, contractors, and security assistance programs under the guidelines of AFI 25-201, AFMAN 21-113, and this contract. The contractor shall provide sufficient engineering support to enable successful operation of the AFPSL and technical order functions. Engineering capabilities are required to provide a technology knowledge base to accommodate new technologies entering the Air Force. This should address such items as initial implementation of new Air Force reference standards into the AFPSL, review of AFPSL historical data to determine drift or erosion of standard capabilities, substitution of equipment and/or techniques, development of uncertainty analysis for AFPSL techniques and technical orders, interface with National Institute of Standards and Technology (NIST) concerning interpretation of calibration certificates or test data, and interface with Air Force Metrology and Calibration Division engineering. The contractor must be staffed to provide customer assistance, including status of customer assets while in control of the AFPSL, questions about calibrations performed at the AFPSL, and questions concerning technical order instructions authored by the contractor.

The estimated price to continue the services for the base period of 8 months is . The cost of each one-month option period will be negotiated at the time of this modification (bridge action). The estimated cost for the total 6 one-month options is , for a total estimated contract value of utilizing 3400 O&M and FMS funding.

IV. Statutory authority permitting other than full and open competition.

10 USC 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) Part 6.302-1(a)(1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, and required by FAR 6.303-2(b)(4).

V. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires use of the authority cited above (applicability of authority).

This modification (bridge action) is required to ensure continuation of necessary services at the AFPSL due to the on-going re-evaluation and corrective action from a protest of the AFPSL follow-on contract sustained by GAO on 13 Jul 21. The timeline for completing all required re-evaluations, best-value tradeoff analysis, and award processing will exceed the available period of performance on the current extension of services for contract F09650-01-C-0267.

April 2021 CONTROLLED UNCLASSIFIED INFORMATION Page 4 of 5April 2021 CONTROLLED UNCLASSIFIED INFORMATION Page 4 of 5 contract's period of performance. This would have enabled a successful transition of operations for the AFPSL from the current contractor to the follow-on provider within the existing period of performance. The revised schedule for completion of the GAO recommended re-evaluations and analyses, award and notifications extends through

, and required transition of work will not be accomplished until . This extends the schedule outside of the current period of performance, 30 Sep 21, as well as the available extension of services option, which ends on 31 Mar 22.

An option to extend the contract, FAR 52.217-9, will be incorporated into this action as a risk mitigation measure to ensure continued operation of the AFPSL in the event of any schedule slippage. The option to extend would enable continued operation of the AFPSL while a revised schedule was prepared and executed.

Demonstration of the Contractors Unique Qualifications: This contract action ensures continued operation of the AFPSL, which requires highly specialized capabilities and qualified/trained personnel to perform calibration services and to write/edit Technical Orders on Test, Measurement, and Diagnostic Equipment (TMDE) items. The AFPSL is the highest echelon metrology and calibration laboratory in the Air Force. Additionally, the lab must be ISO 17025 accredited and the operator must possess appropriate licenses for the management and transportation of radiological materials necessary to operate the RADIAC lab at the AFPSL. The AFPSL provides a critical link between the NIST and Air Force Precision Measurement Laboratories (PMELs) and houses a measurement capability in practically every measurement discipline with a precision and accuracy unequaled in the Air Force. The AFPSL is the sole provider of Air Force measurement standards, base reference standards and other highly specialized calibration services ensuring Air Force measurements are accurate, uniform, reliable, and traceable to NIST. The Bionetics Corporation has provided these services to the Air Force for the past 20 years under contract F09650-01- C-0267 and are the current provider of the services. Therefore, The Bionetics Corporation is the only provider capable of continuing services under the existing contract without disruption to the Air Force calibration program.

Not issuing a modification (bridge action) for these services would cause unacceptable delays making the Air Force susceptible to an Air Force wide work stoppage and non-support of base level reference and calibration requirements supporting approximately 700,000 TMDE items, leaving the PMELs unable to support their war fighter customers, and impacting every MAJCOM and weapon system in the Air Force and Space Force inventory. Any interruption, delay, or degradation in these services present unacceptable risks of Air Force and Space Force system performance and accuracies, and potential liability to the Air Force and Space Force from unsuitable safety margins to system operations.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under

FAR 5.202 applies.

This contemplated action is necessary to prevent a gap in services due to the delay in the new contract caused by a sustained GAO protest. Market Research was accomplished for the recently awarded contract. As described in paragraph V, there is not adequate time to allow for competition as it would cause unacceptable delays and interruptions in highly specialized services. The newly awarded contract allowed for full and open competition.

The required sources sought notice for the bridge action was waived on 4 Feb 22 in accordance with procedures identified in DFARS PGI 206.302-1. Since there was not a sources sought posted for this action, there were no sources expressing interest in this acquisition action.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The value for this J&A was calculated based on historical data from the past three years of performance under contract F09650-01-C-0267, anticipated inflation for the effort under the bridge action, and an estimate provided from The Bionetics Corporation. Based on 20 years worth of historical data, the Contracting Officer will be able to determine the cost to the Government as fair and reasonable.
