About this file
This is an Affirmation and Disclosure Form (Rev. 3/22) used by a state agency as a required compliance document for contractors entering into state contracts. The form requires contractors to affirm that they have read and understand applicable Executive Orders prohibiting the performance of offshore services, locating state data offshore, or purchasing from Russian institutions or companies. Contractors must disclose their principal business location, all locations where services will be performed, and all locations where state data will be located. If subcontractors are used, their names and locations for both business operations and service performance must be provided. Contractors with no subcontractors must indicate "Not Applicable" in the relevant sections.
The form imposes ongoing disclosure obligations on contractors, requiring them to notify the state immediately of any changes or shifts in service locations before, during, or after contract execution. The state reserves the right to immediately terminate any contract if services are performed outside the United States without a duly signed waiver from the state. The form must be executed by a duly authorized representative of the contractor who certifies understanding that the affirmation and disclosure form becomes an incorporated part of any resulting state contract. No pricing, funding, or contract term information is addressed in this compliance document.
