About this file
This document contains affidavit requirements established by the Missouri Highways and Transportation Commission (MHTC) and the Missouri Department of Transportation (MoDOT) for contractors seeking to provide grounds maintenance services to the MoDOT St. Louis District Office and Transportation Management Center. The solicitation covers services for the contract period of April 1, 2026, through March 31, 2027, with options to renew for two additional one-year periods.
The affidavits consist of two exhibits. Exhibit A requires an Annual Worker Eligibility Verification Affidavit, in which an authorized representative of the contracting business entity must certify enrollment in a federal work authorization program operated by the United States Department of Homeland Security and affirm that the entity will not knowingly employ unauthorized aliens in connection with the contracted services. The entity must provide documentation of enrollment in the federal work authorization program. Exhibit B requires an Affidavit of Lawful Presence for Sole-Proprietorship or Partnership, wherein each owner and general partner must attest to being either a United States citizen or an alien lawfully admitted for permanent residence. Both affidavits must be notarized and comply with Missouri Revised Statutes Section 285.530 and Section 208.009, respectively. Contractors should be aware that false statements on these affidavits constitute felony theft of public benefits under Missouri law, with penalties ranging from Class C to Class B felonies depending on the value of benefits obtained fraudulently.
