About this file

This file contains two affidavits required by the Missouri Highways and Transportation Commission (MHTC) for vendors bidding on the Wash Bay Equipment project in Missouri's Southeast District. The affidavits establish compliance with state worker authorization and lawful presence requirements mandated under Missouri Revised Statutes Sections 285.530 and 208.009. Exhibit A is the Annual Worker Eligibility Verification Affidavit, which must be completed by authorized representatives of each bidding entity, including joint venture partners. This affidavit requires attestation that the business is enrolled in a federal work authorization program operated by the U.S. Department of Homeland Security and will verify employment eligibility of all newly hired employees assigned to the contract. Bidders must also affirm that they will not knowingly employ unauthorized aliens in connection with services provided to MHTC and must provide documentation of federal work authorization program enrollment as an attachment.

Exhibit B is the Affidavit of Lawful Presence for Sole-Proprietorship or Partnership, required separately from each owner and general partner. This affidavit requires the affiant to declare their immigration status as either a United States citizen or an alien lawfully admitted for permanent residence. The affiant must acknowledge understanding of Missouri's penalties for fraudulent statements regarding public benefits, which include Class C felony charges for benefits valued between $500 and $25,000 and Class B felony charges for benefits exceeding $25,000. Both affidavits must be notarized and sworn before a notary public. These documents are mandatory compliance requirements for all bidders on this MHTC contract and must accompany bid submissions.
