Questions and Answers from F. E. Warren EUL Industry Day, 18 April 2017
1. What is the status of jurisdiction? Will it remain federal exclusive? If it becomes concurrent, who is providing fire and police services? Is there a cost associated with those services? What construction permits are required – are they issued by the base or by others?
Answer: The legislative jurisdiction of the property is currently federal exclusive. The Air Force has taken steps to change this to concurrent jurisdiction and we expect this to be completed before lease signing. The proposal should be written for concurrent jurisdiction. Generally speaking, fire and police services will be provided by the local community, however, there is a
Memorandum of Record for mutual support for fire services. Contact the local community for any costs associated with these services. Construction permits will be issued/controlled by the local regulatory agencies having jurisdiction.
2. If it is concurrent jurisdiction, will Davis Bacon Wage rates apply?
Answer: No
3. Other than making the TCE monitoring wells available for access, is there any other requirements we should be aware of?
Answer: The Air Force is not aware of any other environmental issues associated with the property. An Environmental Baseline Survey will be accomplished and provided before lease signing.
4. Does the base/AFCEC have any soil condition reports for the parcel?
Answer: No
5. Will the offeror be allowed to tap into the groundwater for irrigation use?
Answer: Maybe, but this would require approval/coordination with the applicable State agency.
6. Are Underground Storage Tanks for fuel OK?
Answer: USTs are discouraged, but not prohibited. Any proposal that includes a UST must have a complete description of the tank (size, specifications, location), a justification of why it is needed, and a comparison to any alternatives. Any UST must be coordinated, installed and maintained according to applicable regulations (Federal, State, County, etc.).
7. Are there any Anti-Terrorism/Force Protection requirements for construction?
Answer: No, Air Force Anti-Terrorism/Force Protection construction requirements are not required for private construction on this property.
8. What is the relative weighting of the factors?
Answer: The importance of the factors and subfactors is addressed in Section 5 of the RFQ.
There is no defined percentage weighting.
9. What is the tie breaker if two bidders score the same color ratings?
Answer: This will be a Best Value Selection and the Source Selection Evaluation Board will provide a ranking of proposals.
10. If the Government can terminate at will during negotiations, will costs (for MA or EA, etc.) be covered?
Answer: No. See RFQ Section 4.1.
11. Since the EUL parcel is located outside the installation fence and across a street, does the requirement in the RFQ, Section 3.1.e in regards to direct competition with “covered entities” still apply?
Answer: At this time, yes. We asked Air Force Services Activity this question and they are unable to provide a definitive answer until such time as a specific proposal is provided.
