Version 2.0 November 2020 transition). Given these circumstances, it is necessary to increase the ceiling of the existing task order as MTSI is the only contractor in the position to continue to provide uninterrupted services required by Air and Marine Operations. The increase will provide the necessary time to conduct the follow-on competition.
5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).
Task Order HSBP1017F00069 was placed in accordance with FAR 8.404, “Use of Federal Supply Schedules.” The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates. Discounts to those GSA schedule rates were applied under the contract award.

The same negotiated unit pricing, level of effort and mix of labor that currently exists under the task order will apply to the increased ceiling amount.
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
Market Research was conducted for the previous recompete. While other vendors may be capable of performing the work, due to the short-term nature of this action and the need for cleared personnel, MTSI is the only firm in position to support the immediate requirement.
7. Any other facts supporting the limited-sources justification.

8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited sources) before any subsequent acquisition for the supplies or services is made.
No additional actions are required to remove or overcome barriers to competition. The proposed action is required to remove the circumstances from the future source selection that generated a protest on a similar contract award. This action seeks to award a ceiling modification with the incumbent contractor to continue services while a new solicitation and source selection process is completed.
9. CBP intends to post this requirement on beta.sam.gov pursuant to FAR 8.405-6(a)(2)(i).
