4. Statutory Authority Permitting Other than Full and Open Competition:
The statutory exception permitting other than full and open competition for this acquisition is 10 USC
2304(c)(1), One source or limited sources. Refer also to FAR 6.302-1. There is only one responsible source, and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority:
Because this effort is taking place OCONUS (Outside [the] Contiguous United States), and because highly technical expertise is needed for this requirement, competition is extremely limited. UPCH is the only known institution that has the appropriate research capability– science, technology, resources, experience, and organizational controls needed to accomplish the proposed tasks in Peru.
UPCH provides scientists that are known for cross-disciplinary technology development, scientific observations and analyses, and hands-on investigations that encompass broad areas of infectious diseases including diagnosis, treatment, and epidemiology of enteric diseases in Cusco city and its local communities (i.e. fasciolasis, helmintiosis, and travelers’ diarrhea).
Successful completion of the research protocol is highly dependent on the research expertise from UPCH field scientists. In order for results and final conclusions to be scientifically valid, the continuation and surveillance of existing subjects must be ensured with no deviations. Any change in the process to execute the protocol would hinder the comparison between previous efforts and cause the loss of integrity of the research.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable:
A Sources Sought Notice was synopsized from 23 August 2019 to 03 September 2019 on the Federal
Business Opportunities (FBO) website; thereafter, a Notice of Intent to sole source was synopsized from
03 September 2019 to 13 September 2019 on the FBO website. Neither notice resulted with any capability statements received from any other potential contractor.
7. Determination of Fair and Reasonable Cost:
The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition:
For the reasons set forth in Paragraph 5, NMLC has no plans at this time to compete future contracts for the type of services covered by this document. If another potential source emerges, NMLC will assess whether competition for future requirements is feasible.
