About this file
This document is a Justification for Other Than Full and Open Competition (JOFOC) under Simplified Acquisition Procedures (SAP) FAR 13.106-1(b). It justifies awarding a sole-source contract to ADVANTEC MANUFACTURING USA, INC. for the purchase of various window assemblies and parts to support the windows installed on 45' RBM and 47' MLB vessels operated by the U.S. Coast Guard.
The key details are: The parts are proprietary to ADVANTEC, the original equipment manufacturer (OEM), and the technical data required to manufacture compatible parts is not available. ADVANTEC is the only source that can provide the required parts, which are critical for the safety and watertight integrity of the vessels. The estimated value of the contract is above the micro-purchase threshold but below the Simplified Acquisition Threshold. The contract was awarded under the authority of 10 U.S.C. 3204(a)(1) - Only One Responsible Source. The contract was awarded to ADVANTEC on 2024-09-13 for $201,585.94.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT
WILL MEET THE GOVERNMENT’S REQUIREMENT.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE. The purchase of VARIOUS WINDOW ASSEMBLIES and Parts. The parts are in support of the windows installed on 45’ RBM and 47’ MLB. Vessel: Multi. (See Enclosure 1).
The VARIOUS WINDOW ASSEMBLIES and Parts are provided by ADVANTEC MFG., the Original Equipment Manufacturer (OEM).
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED. The technical data for the VARIOUS WINDOW ASSEMBLIES and Parts required to make an accurate assessment of equal or alternate equipment meeting the Coast Guard’s performance, fit, form and function requirements for this procurement is unavailable. The proper operation of the above parts is critical for the safety of both crew and vessel alike, especially during underway operations, where watertight integrity is of the utmost importance. Failure of the VARIOUS WINDOW ASSEMBLIES and Parts would place an unit in a hazardous situation with the loss of watertight integrity, possibly placing the vessel in a flooding situation. Any attempt to manufacture this item without the proper (OEM) parts and access to OEM reproduction manufacturing drawings, spec, tolerances/parameters, test procedures and other relevant information, could lead to major mission degradation.
Therefore, all replacement parts offered shall be only “official brand” (OEM) parts.
A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE). Researched the Internet for vendors available to provide the VARIOUS WINDOW ASSEMBLIES and Parts, ADVANTEC MFG., is the suggested source that can provide the VARIOUS WINDOW ASSEMBLIES and Parts installed. Searched for other vendors capable of supplying the VARIOUS WINDOW ASSEMBLIES and Parts. While other vendors produce the VARIOUS WINDOW ASSEMBLIES and Parts, to deviate from the installed brand may require fabrication upon installation.
ADVANTEC MFG., does not have any known distributors.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.
ADVANTEC MFG., is the suggested source that can provide the VARIOUS WINDOW ASSEMBLIES and Parts to support the installed equipment. ADVANTEC MFG., is the sole possessor of the drawings and other technical information required to properly manufacture the VARIOUS WINDOW ASSEMBLIES and Parts. Another vendor’s parts may not contain the same fit, form and function. The installation of ADVANTEC MFG., parts will ensure the continuity and configuration of the VARIOUS WINDOW ASSEMBLIES and Parts installed at Coast Guard units. The Coast Guard does not have any technical information to deviate from the parts installed; another vendor’s offer may lead to fabrication being necessary for installation.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE. This is a proprietary commercial item of the proposed contractor. The reproduction of manufacturing drawings, specifications and other technical data related to this item were never purchased by the U.S. Coast Guard and therefore are controlled by and remain the sole property of the OEM.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED. COR will continue to conduct market research in the attempt to locate vendors that can satisfy the needs of the Coast Guard including a requirement for manufacturer’s engineering drawings, detailed parts lists, design or testing procedures, and other relevant information concerning this item.
