About this file
This document contains solicitation requirements excerpts for a VA contract set-aside for Service-Disabled Veteran-Owned Small Businesses (SDVOSBs). The file addresses two key areas: safety and environmental record requirements, and limitations on subcontracting with monitoring and compliance procedures.
All bidders and offerors must submit documentation certifying that they have no more than three serious OSHA violations, one repeat OSHA violation, or one willful OSHA or EPA violation within the past three years. Bidders must also provide current Experience Modification Rate (EMR) documentation equal to or less than 1.0, obtained from their insurance carrier on company letterhead. Self-insured contractors or those unable to provide EMR ratings on insurance letterhead must obtain ratings from the National Council on Compensation Insurance (NCCI) via form ERM-6, or from their respective state worker's compensation rating bureaus for CA, DE, MI, NJ, ND, OH, PA, WA, WY, and PR. The government will conduct a Determination of Responsibility for the apparent awardee prior to award using submitted information and OSHA and EPA online inspection databases. Failure to affirm compliance or submit required information results in a non-responsibility determination and ineligibility for award. Prime contractors are responsible for ensuring all subcontractors at all tiers meet these requirements. The contract will include VAAR 852.219-10 regarding the SDVOSB set-aside. The Contracting Officer may use VA-retained support contractors to assess compliance with subcontracting limitations and work performance requirements, with such support contractors required to sign information protection and non-disclosure agreements. Contractors must cooperate fully and provide all records necessary for compliance assessment.
