About this file

This document is additional contractual information from a federal contracting solicitation, likely for food service supply to the Federal Correctional Institution (FCI). The government reserves the right to make awards on an all-or-none basis using a "Best Value Continuum" evaluation approach. All quotes must be submitted on an FOB Destination basis, meaning the vendor bears all shipping costs and responsibility for delivery to the destination.

The document emphasizes strict delivery performance requirements, stating that vendors with prior delivery problems will not receive awards based on poor past performance history. Any items not delivered by the required date will be cancelled with funds de-obligated, and non-delivery will negatively impact the vendor's future past performance evaluations. The FCI has identified delivery failures as problematic due to their impact on meal planning, meal preparation, and increased procurement costs. Vendors are responsible for all shipping and restocking fees associated with their performance. This language indicates that on-time, complete delivery is a critical evaluation and contract performance factor for this procurement.

Additional Information:

The government reserves the right to award on an all or none and the “Best Value Continuum” basis.

Purchases will be awarded all or none.

All quotes are for FOB Destination.

Delivery problems have occurred for some companies that have impacted their past performance. As such, awards have not been made to those companies based on their past performance.

The FCI will continue such procedures as the inability to deliver products impacts menu planning and preparation of meals as well as increasing prices for re-procurement.

All item(s) not delivered by the date required are cancelled and the funds will be de-obligated; accordingly, the non-delivery of items, in part or in whole, will be reflected in your future past performance evaluation.

Accordingly, any/all shipping and restocking fees will be the responsibility of the vendor.
