About this file

This document contains an Addendum to FAR Clause 52.212-1 and 52.212-2, which outlines the evaluation criteria for a federal contract opportunity. The key details are:

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The evaluation factors are: 1) Price - offers will be ranked by total evaluated price; 2) Technical - the Government will assign a rating of "Acceptable" or "Unacceptable" to the offeror's proposed laser etcher based on the attached specifications. If the lowest priced offer is deemed technically acceptable, that offeror will receive the award without further evaluation. The Government reserves the right to communicate with offerors, make a best value decision, or not select a contractor.

The related federal contract opportunity is for a Laser Etcher required by the Department of the Air Force Air Mobility Command. The solicitation number is FA446024Q0260, and the required Laser Etcher must meet the specifications in the attached document. Quotes are due by 4:00 PM CDT on 13 August 2024, and the Government intends to select the lowest priced technically acceptable offer.

52.212-2 Evaluation-Commercial Products and Commercial Services. (Tailored) (Nov 2021)

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

By submission of its offer, the offeror consents to all solicitation requirements, including terms and conditions, representations and certifications, in addition to those identified as evaluation factors.

Failure to meet a requirement may result in an offer being determined to be non-responsive.

The following factors shall be used to evaluate offers:

1. Price Factor: First, the Government shall rank all responsive offers by price. An offeror’s total evaluated price will include the total of all Contract Line Items as outlined in this solicitation. The Government reserves the right to deem an offeror's overall quotation to be unresponsive in the event that incomplete, unreasonable, or unbalanced pricing is submitted.

2. Technical Factor: Second, the Government will assign a rating of “Acceptable” or “Unacceptable” to the offeror’s submission of the proposed laser etcher.

An Acceptable description of the proposed Laser Etcher will meet the specifications described in the attached Spec Sheet.

An Unacceptable description of the proposed Laser Etcher will meet the specifications described in the attached Spec Sheet.

An Unacceptable description of the proposed Laser Etcher will result in the entire quotation being determined unacceptable and the offeror's proposal will not receive further consideration.

3. If the lowest priced evaluated responsive offer is determined to have an acceptable technical rating, that offer represents the best value to the Government and the evaluation process will stop at that point. Award shall be made to that offeror without further consideration of any other offers.

If the lowest priced offeror is determined not to have an acceptable technical rating, the next lowest priced evaluated responsive offeror will be evaluated, and the process will continue (in order by price) until an offeror is determined to have an acceptable technical rating. If no acceptable Technical rating is received, the Contracting Officer will make a best value award decision.

4. The Government reserves the right to communicate with all, some, or none of the offerors to address any issues, if necessary. The Government also reserves the right not to select a contractor, depending on the quality of the proposal(s) submitted and the availability of funds.

5. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

FAR 52.212-1 Addendum
