About this file
This document is Addendum Two to Invitation to Bid No. RFB-105-26 issued by the Commonwealth of Kentucky Department for Facilities and Support Services, Division of Engineering and Contract Administration, in coordination with the Energy and Environmental Cabinet for environmental site remediation at the Former Wiley Property in Hartford, Kentucky. The project involves excavation and removal of hazardous and non-hazardous waste to various depths between 1.0 and 7.0 feet below ground surface, construction of drainage channels (approximately 120 linear feet), a construction culvert, permanent farm fencing (400 linear feet plus widening of an existing cattle gate), topsoil replacement, and seeding and landscaping. The addendum serves as a questions and answers document addressing clarifications from bidders regarding project specifications, drawings, and execution requirements outlined in the Project Manual.
Key contractual responsibilities assigned to the contractor include obtaining all required permits (NPDES, dredging/filling, 401 Water Quality Certification, and Ohio County Excess Weight Permit), managing stormwater pollution prevention, providing decontamination facilities and procedures for equipment, implementing soil erosion and sediment control measures, providing appropriate personal protective equipment (Level C for hazardous waste operations and Level D for non-hazardous waste operations), conducting compaction and fill material testing, and repairing any county roads damaged during construction. The contractor bears responsibility for classifying and managing excavated materials as directed by the field engineer, constructing and maintaining hot and cold zones to minimize equipment decontamination requirements, and completing all project closeout activities and submittals. The State has an established Hazardous Waste Generator ID (EPA ID) that contractors may operate under, and the project start date is to be determined with rough anticipated commencement in spring 2026.

QUESTION ANSWER NOTES
What permits are expected to be the responsibility of the contractor? This would include the Ohio County Fiscal Court Excess Weight Permit.
Per Section 01270.1.01.A. of the Project Manual “Contractor shall comply with all applicable relevant and appropriate Laws, Rules and Regulations governing the Work, and with all Federal, State and Local regulations and permit requirements pertaining to water, air, soils, solid waste, and noise pollution during all work.”
Local includes all Ohio County requirements / permits.
Do dumptrucks have to be washed everytime they leave the site?? What is the process for collecting, hauling, and/or treating wastewater after washing?
Per Section 02400.3.03.E.1. of the Project Manual “Excavation and related equipment having operated within contaminated areas, as shown on the Project Drawings, shall be decontaminated before relocation and reused at other areas of the site.”
Per Section 02400.3.03.E.3.ii. of the Project Manual “Decontamination wastewater shall be contained, transported, and treated/disposed off-site by Contractor in an appropriate manner at no additional cost to Owner.”
For the “hot zone” and “cold zone”: Can you elaborate on this a little more please? Can we build a road and it be designated as a cold zone and not be required to wash dumptrucks? How do we maintain this “cold zone?”
Per Section 02400.3.03.D. of the Project Manual “Where at all possible, soil transport trucks are to be loaded while staged in warm or cold zones. As an alternative, Contractor may spread “clean” fill or rock to create haul roads within hot zones. Construction and removal of all haul roads to be at Contractor’s expense.”
A road can be designated as a cold zone if it is constructed outside of the “hot zone” (i.e., the area of excavation and replacement of non-hazardous waste) as shown on Project Drawing EX-1.

QUESTION ANSWER NOTES
What is to be done with existing topsoil cap placed on-site by EPA in the past?
How is it classified if it is to be removed from the site?

CATTLE GATE TO BE WIDENED AS
WARRANTED
(GATE TO BE REPLACED)” as indicated on Project Drawing EX-2.

QUESTION ANSWER NOTES
In Section 01280 (Page 122 of 445), Modified Level D personnel protective equipment is listed as a requirement for all activities involving non-hazardous waste tasks/operations.
OSHA Modified Level D (arsenic) includes chemical-resistant gloves, Tyvek suits, and continued use of a respirator with P- 100 filters. Given that these items were explicitly required for all activities involving Hazardous waste tasks/operations, will these Modified Level D requirements still be required for non-hazardous? Since they weren’t explicitly mentioned for non-haz, we weren’t sure if the Modified Level D requirements were modified to this specific site and it was determined that such protection is not required.
Per Section 01280.3.05.C. of the Project Manual “During all Non- Hazardous waste excavation, handling, and operations the contractor shall provide: ……. all Level D Personnel Protective Equipment (PPE) in accordance with all federal, OSHA, state, and local health and safety regulations, including OSHA regulations for hazardous waste site work for the use of all onsite personnel.”
Modified Level D requirements have not been modified to this specific site.
