This Addendum Two document is issued by the Commonwealth of Kentucky Department for Facilities and Support Services, Division of Engineering and Contract Administration, in conjunction with the Department for Natural Resources Division of Abandoned Mine Lands (DAML) for Invitation to Bid No. RFB-200-26 regarding the 23076 AMLBAML AML Project in Perry County, Kentucky. The project encompasses abandoned mine land reclamation and acid mine drainage abatement work at two residential sites (Whitson and Sims properties) located off Mountain Shadow Drive near Hazard, with a total project area of approximately 13 acres, of which only 2.5 acres will be disturbed. The scope includes construction of four retaining walls (Types I, II, and reinforced concrete), steel pile installations, subsurface drainage systems, site preparation and revegetation, utility relocation, structure removal, debris disposal, and erosion control measures. Forty-nine bid items are specified with quantities ranging from mobilization (lump sum of $50,000) to various unit-priced materials and labor including concrete work, steel installation, drainage components, and revegetation activities. All work must be completed within 270 calendar days from the effective date of contract award. The revised bid schedule dated March 2, 2026, must be used in lieu of previously issued schedules, and bidders are required to submit the AML Contractor/Subcontractor Information Form with their bids.
The bid pricing structure utilizes lump sum, unit price, and actual documented cost methodologies across the 49 line items, with specific Allowable Price Limit (APL) ranges to identify potentially unbalanced bids. Key unit prices include $350 per cubic yard for formed and finished concrete, $175 per cubic yard for non-formed concrete, $25 per ton for various stone backfill types, and $1,000 per acre for site preparation. The project includes provisions for utility relocation and replacement at actual documented cost, landscape allowance reimbursement, and traffic control at $500 lump sum. Davis-Bacon scale wages apply to all contractor and subcontractor personnel. AML is responsible for obtaining KYTC encroachment, Kentucky Division of Water permits, and USACE permits, while contractors must secure all other necessary permits and fees prior to mobilization. A total of $1,880 in bat in-lieu fees will be paid to the Imperiled Bat Conservation Fund, and property owners may require contractors to add them as "Additional Insured" on general liability and automobile insurance policies at the contractor's expense. The project is funded through the Division of Abandoned Mine Lands and follows AML Standard Technical Specifications and Standard Details available on the DAML website, with comprehensive erosion and sediment control best management practices required throughout construction.

Additional Construction Notes
For Addendum #2
• Foundation Wall Investigation (Whitson Site) AML conducted a field investigation and confirmed that the structure is supported by two parallel cast-in-place concrete foundation walls tied together by two levels of concrete floor slabs. Each wall is approximately 8 inches thick with the front wall being 8 feet tall and the back wall being approximately 16 feet tall. At the rear of the residence, two courses of masonry block are exposed, which Mr. Whitson indicated support the floor joists. Based on the observed conditions, the foundation system appears to be well constructed and structurally sound. A home inspection will be conducted prior to construction activities at both the Whitson and Sims residences.
• Domestic Debris Disposal Bid Item The Domestic Debris Disposal pay item has been revised from Lump Sum to Unit Price (per Ton). Disposal quantities will be paid based on documented tonnage, and certified weigh tickets must be submitted prior to payment authorization.
• Access to Slope Above Whitson Residence As shown on the plans, the bench located on Mr. Wells’ property directly upslope of the Whitson residence is within the project limits and will be utilized for access. Two access routes to the bench are available, both within project limits. All permanent construction activities will remain within the Whitson property boundary, which is delineated on the plans by a polygon with survey pin locations.
• Wall B Drilled Hole Diameter A clarification was requested regarding the drilled shaft diameter for Wall B. The original bid sheet specified only an 18-inch diameter. This has been revised to allow a diameter range of 15 to 18 inches to provide construction flexibility.
• Wall D Design Revision Due to extremely limited working space behind the Whitson residence, Wall D has been revised from a Non-Reinforced Block Wall – Type II (AML 30-20-2) to a 10-foot tall Reinforced Concrete Wall (AML 30-60-1) supported by Steel Piles – Independent Support (AML 30-30-1).
Two rows of 130 lb/yd Railroad Rails will be drilled and encased in the concrete footing using a 12–15 inch diameter drill bit. Railroad Rails is assumed to extend to 30 feet below existing grade, with a minimum of 10 feet socketed into bedrock. Earthwork will include excavation of a drill bench to a minimum depth of 3 feet below existing grade.
• Formed and Non Formed Concrete Specifications
a. Class A Concrete is utilized on headwalls, non-bearing structures, and all structures where class is not specified.
b. Class AA Concrete is utilized on ALL retaining walls and load bearing structures.
2-26-26
• How is the fence mounted to the top of the Type II Wall?
AML prefers installing fencing within the backfill aggregate material. This is performed by creating a void within the backfill, installing the post, and securing the posts by grouting in place. Fences can also be attached to walls by drilling, bolting, and grouting.
• In the event that the test holes for piles comes in, for example, half of what is shown in plans, will the drilling portion be paid by the LF or the total price of what was bid. My concern is drilling per foot price goes down with more footage but goes up with less footage?
The bid item description states that the drilling will be measured to the nearest linear foot and paid for the accepted quantities.

PERRY COUNTY
PROJECT DESCRIPTION:
The project includes two sites in Perry County located just off of Mountain Shadow Drive, behind WYMT. The Sims site consists of a pre-law auger bench, whose outer slope has become unstable. Movement along the outer slope, around the foundation and inside the home have been reported. In addition, multiple auger holes along the back yard pose a threat to Mr. Sim’s young child. Lastly, drainage and sediment flow over an OSM concrete wall and towards the home.
The Whitson site consists of an augered and backfilled highwall at house level and just above the home. Drainage continues to find its way into the back of the home. In addition, the slope behind the home has become unstable and large boulders have fell and damaged the deck and pool.
The project area is located in Perry County, within the Hazard North Quad. To access the site from the AML Hazard office located at 101 Bulldog Lane, Hazard, KY 41701, turn left onto KY-15N and travel 226 feet to stop light. Turn left onto Johnny Cox All-American Drive and travel 1.3 miles. At stop light, turn left onto Black Gold Blvd and take an immediate right onto Mountain Shadow Drive. Travel 0.31 miles to Whitson driveway on right or 0.38 miles to Sims driveway on right. Coordinates to the Whitson site are 37°15'25.65"N, -83°12'15.56"W.
Coordinates to the Sims site are 37°15'22.68"N, -83°12'17.28"W.
To access the waste area from the project site, head east on Mountain Shadow Drive. Turn left on Black Gold Blvd. Take left onto Johnny Cox All-American Drive and drive 0.8 miles to light. Turn left onto KY-15 N and drive 8.8 miles. Turn left onto Trus Joist Lane and waste area is located on the right. Coordinates to the waste area are 37°21'46.62"N, -83°15'45.14"W.
In total, the project will consist of approximately thirteen (13) acres. Only two and a half (2.5) acres will be disturbed. One and a half (1.5) acres at the Sims site, one half (0.5) acre at the Whitson site and one half (0.5) acre at the waste area. Revegetation activities at the Sims and Whitson residences will utilize residential seeding, which will incorporate disturbed areas around the houses and driveways. All other seeding will utilize the General Reclamation Mixture found in the Standard Specifications on page A-5. Revegetation activities shall be completed within the recommended seeding window found on page A-4. Any seeding activities outside of this window must be approved by the Branch Manager.
Utility Relocation/Replacement, Landscape Allowance, Traffic Control and Structure Removal/Replacement are all setup to address any issues encountered during reclamation activities. It’s worth noting that just below Wall C, a large guy wire will need to be relocated to gain access into the site.
Site Preparation is included at both the Sims and Whitson sites for tree and brush removal. Only remove what is necessary for reclamation. Trees and brush will be burned onsite or hauled to waste area and burned. It will be the contractor’s responsibility to contact city officials to ensure that local and state burning guidelines are being implemented.
Domestic Debris Disposal bid item is included for the proper disposal of existing railroad tie walls, pool and pool deck, as well as any other domestic items encountered during reclamation activities. It will be paid for as actual cost by the Ton. Weigh tickets must be provided before payment can be issued to the contractor.
Wall A is a 207 L.F. 4' tall Non-Reinforced Block Wall-Type I (AML 30-20-1) with No. 2 Backfill and 8” subdrain behind the wall. Constructed wall shall follow the same path as the existing, deteriorated wall and the top of the footer should remain at the same elevation across the entire wall. The first 78' will have to be completed by hand. Reuse existing footer on this section, construct new footer on remaining footage. No equipment on the stamped concrete.
Cover stamped concrete and pool with 6 mil plastic and filter fabric to minimize damage while work is being performed. An additional 6 CY of formed and finished concrete has been added through this addendum to replace any potential damaged areas. If damage occurs near a drain, the concrete must be sawn at the drain and replaced from there to the outer edge.
Wall B is 270 L.F. of Steel Piles-Independent Support (AML 30-30-1) with Reinforced Concrete Cap (AML 30-30-2) ON W8 X 40 BEAMS 3' O.C. set inside a 15-18” hole. Steel is estimated to be 30' in length with 10' in rock, 19’ in soil and 1’ above grade. A minimum of 5 pilot holes MUST be drilled to determine rock depth prior to ordering steel. Final steel length shall be discussed with the Branch Manager and approved prior to ordering. Cap will be modified as FOOTING for Wall C. See Cross-Section 1+50 for more details.
Wall C is a 284 L.F. 6' tall Non-Reinforced Block Wall-Type II (AML 30-20-2 & 3) with 12" subdrain behind the wall. Ideally, the constructed wall shall follow the same path or similar path as the existing, deteriorated wall. The top of the constructed wall should be at the same elevation as the existing wall. The purpose of this wall will be to hold the outer edge of the yard up to existing grade. Incorporate gutter and foundation drains into the 12" subdrain. Due to limited space, a pump truck may be necessary to pour the footer. Factor in additional costs to Concrete Formed and Finished as necessary.
Wall D is a 152 L.F. of 10' tall Reinforced Concrete Wall (AML 30-60-1) on a concrete footer.
Encased in the concrete footer will be two rows of railroad steel drilled with a 12-15” bit. Steel is assumed at 30 foot depth with 10 foot into bedrock. Up to 200 L.F of 8" of retaining wall subdrain behind and up to 200 L.F of 8" subdrain in front of wall. If possible, keep wall footer at one elevation. If not, step down once in elevation and bend as necessary to follow path of existing, deteriorated wall. Incorporate down spouts into front subdrain behind the home. Hoe ram will be necessary during wall and footer excavation, along the back slope. After further investigation, the house sits on two parallel concrete walls and are tied together by two levels of concrete floors. Each of the foundation walls 8” thick with the front wall being 8 feet tall and the back wall being approximately 16 feet tall 8’ tall. On the back of the home, two rows of block are visible. These are what the floor joists sit on, according to Mr. Whitson. It's likely that some of the trees above Whitson home will have to be removed. The bench on Mr. Well’s property is located directly above Whitson home. This bench is included in the project limits and will be used to gain access to the slope above Mr. Whitson. There are two ways to access the bench and both are within the project limits.
Hoe Ram will be used to address/reduce the size any boulders too large to move with an excavator. Large overhanging boulders behind walls A & B will be reduced.
Silt control will be installed at various locations within the project limits, as directed by the onsite engineer.
Earthwork (Lump Sum) will be utilized on areas that will require excavation. These areas include but are not limited to walls A, C and D. Some material will be used to regrade the slope just below Wall C. Additional material will be transported to the designated off-site waste area.
Seeding, Seedbed Prep, Fertilizer, Mulch-Straw & Hay and Residential Seeding are included for all revegetation efforts within the site and waste area. Dense Grade and Roadway Stone are included to provide access to waste area during normal reclamation and a final coat shall be applied once reclamation is complete or otherwise directed by the Engineer.
Bituminous Repair is included to repair “in kind” all asphalt surfaces damage due to normal reclamation activities. Mr. Sims requests surface grade bituminous versus base grade. Factor in if the price will vary between the two. In addition, Mr. Sims states that as his pavement lays currently, the drainage flows away from his home perfectly. He asks that any pavement that is installed do the same instead of flowing back towards his home. If a section of pavement has to be cut out, blend the old with the new as best as possible. Mr. Whitson has no requests. Tack must be applied prior to bituminous activities, no exceptions. Additional information can be found on page 31 of the AML Standard Specifications.
Mobilization is setup to provide construction equipment to be delivered to the site.
HDPE Pipes are included to provide temporary access into the Sims site. These pipes will be removed upon project completion. In addition, an 18” HDPE pipe will be installed under the footer of Wall C to transport drainage from the Sims site to a
No permits will be needed for this project. Multiple trees (equal to or greater than 3-inch breast height) may be disturbed outside of the winter clearing season (October 15 – March 31th).
Therefore, if work is performed outside of the winter clearing season, the amount must be paid PRIOR to removing the trees. A total of $1,880.00 of bat in-lieu fees will be paid to the IBCF.
All trees will be burned onsite or hauled to the waste area and burned.
This project was previously submitted for ATP but due to issues with one landowner, the scope of the project had to be amended. Reclamation activities initially proposed on that property were removed, but AML has police powered this landowner to gain access to perform the remaining work.

A. STANDARD DOCUMENTS
The AML Standard Details and Technical Specifications are posted on the Division’s website at https://eec.ky.gov/aml
Once on the web page, please click “Contractor Information” tab located on the right side. AML standard technical specification and detail are located under this tab. Contractors are strongly encouraged to review the complete AML website for additional information.
B. ALLOWABLE PRICE LIMIT
The lowest Allowable Price Limit (APL) is listed on the Bid Schedule as part of the bid documents. Unit Price, Plan Quantity, and Lump Sum are all methods of payment. Significantly low or high values entered by the CONTRACTOR on the Bid Schedule may be considered an unbalanced bid and may have to be justified in writing if such bid is deemed the low responsive bid.
An example would be if a CONTRACTOR assumes there may not be a need for the entire design quantity for Roadway Stone and entered a $10 value for Roadway Stone when the cost at the quarry is significantly higher. Another example would be if the CONTRACTOR enters a value of $30 per linear foot for “SILT BARRIER - BALES & FENCE” to front load payments for work items used near the beginning of the project. The CONTRACTOR is also cautioned that other considerations for rejection may be enforced such as the low bid being higher than the budgeted dollar amount for this project.
C. CONTRACT LENGTH
All work shall be completed within TWO HUNDRED SEVENTY (270) calendar days from the effective date of the Award of Contract. Within the bounds of prudent project performance, it shall be the responsibility of the CONTRACTOR to plan and implement construction sequences which follow the intent of these CONTRACT DOCUMENTS, particularly as, reflected in the Drawings and Special Conditions and to protect any portion of the contract which may be completed before others.
https://eec.ky.gov/aml
COR & BID & BMP 2
D. CONTRACTOR’S INFORMATION SHEET
The AML CONTRACTOR/SUBCONTRACTOR INFORMATION FORM sheet must be filled out and submitted with the bid. Failure to submit the AML Contractor/Subcontractor Information Form sheet with the bid will be the basis for declaring the bid “Non-Responsive.”
E. SPECIAL CONDITIONS & PROJECT NOTES
- When applicable, AML is responsible for payment to the Imperiled Bat Conservation Fund (IBCF). The CONTRACTOR will be responsible for adhering to the boundary for which payment was made and confirming with AML the acreage of trees removed.
- On occasion, a property owner may require a CONTRACTOR to add them on their General Liability and/or Automobile Insurance as an “Additional Insured.” AML will inform the CONTRACTOR when this requirement is being made by the property owner. In these cases, the CONTRACTOR must submit to AML copies of their certificate of insurance documenting the “Additional Insured” before they will be allowed to mobilize equipment and forces on to said properties. Any fees, rate increases, or other costs incurred by the CONTRACTOR for this requirement, if any, will be considered incidental to mobilization and as such no compensation will be made by AML. The “Additional Insured” must remain on the CONTRACTOR’s policy(s) for the full length of the contract.
- Mr. Sims has requests that surface grade bituminous be used on his driveway if it must be repaired.”
- Mr. Sims requests that his gates along the outer slope be replaced “in kind” because this is where he blows all his leaves through the fence and over the slope.
F. DAVIS BACON SCALE WAGES
The CONTRACTOR and all SUBCONTRACTORS are required to pay scale wages as defined in the contract documents. If all employment categories that may be used have not been listed and specified in the contract document, then the contractor must make his best determination of what the missing wage rate will be. Subsequently after the bid is awarded, the contractor must request the specific rate from the Department of Labor. AML will not issue change orders for additional compensation if the wage rate determined by DOL is higher than the rate the contractor used to develop his bid. If wage rates are not included for a specific category, AML suggests that the contractor assume the highest operator or laborer wages that are listed when developing his bid.
G. PERMITS & FEES – AML will be responsible for obtaining any permits that are checked below.
(Check all that apply)
☐KYTC Encroachment Permit ☐KY DOW Water Permits ☐USACE Permit
COR & BID & BMP 3
The CONTRACTOR is responsible for all other permits and/or fees necessary to begin the project. The CONTRACTOR is advised that on occasion, other permits and/or fees may be required by federal, state, and local government(s). Other types of permits and/or fees are not the responsibility of AML and as such, these will be the complete and total responsibility of the CONTRACTOR to obtain. These must be obtained before AML will allow mobilization of equipment and forces on to said properties. All costs associated with other permits or fees will be the responsibility of the CONTRACTOR. Please refer to “General Provisions” in the AML Technical Specifications.
