About this file

This is Addendum Three to Invitation to Bid No. RFB-118-26 issued by the Commonwealth of Kentucky Department for Facilities and Support Services, Division of Engineering and Contract Administration, for the FB Russell Lease TENORM Remediation Site located in Powell County, Kentucky under the Department of Environmental Protection. The project involves the remediation of a site contaminated with Technologically Enhanced Naturally Occurring Radioactive Material (TENORM) and crude oil-impacted soils. Key project elements include excavation and disposal of TENORM-impacted soil, characterization and profiling of all waste streams, removal of four above-ground storage tanks (ASTs) ranging from 11 feet tall by 8.5 feet in diameter containing approximately 1,200 to 4,300 gallons of oil/water or water, disposal of plastic piping and recycling of steel piping in the immediate vicinity of the AST battery, backfill and seeding of approximately 4,000 square feet (with final area subject to engineer agreement), and biweekly progress reporting to the on-site engineer. The contract establishes a 90-day project completion deadline with associated financial penalties of $1,400 per day for delays, though the state acknowledges that progress must continue steadily given the 30-to-50-day timeframe required for TENORM lab analysis and waste profile approvals at disposal facilities.

The bidder Q&A and addendum clarify that the contractor bears responsibility for all waste stream characterization and profiling as required by the designated disposal facility, with additional sampling costs reimbursed on a per-unit basis by the state. Crude oil-impacted soils with TENORM levels below 5 pCi/g may be disposed of at contained Kentucky landfills rather than specialized TENORM facilities. The bid worksheet values are provided for estimation purposes only, with actual state reimbursement based on disposal receipts and final site measurements as agreed with the on-site engineer. The contractor has discretion in selecting means and methods of equipment usage, though clean backfilling with soil amendments is required to prevent ponding and promote vegetative cover. All bids must be submitted electronically through the vss.ky.gov website, and mock emergency drills are not required if a comprehensive site-specific health and safety plan is maintained with documented daily meetings.

RFB-118-26 FB Russell Lease TENORM Project – Bidder Questions & Answers

1. Can we receive a copy of the site visit meeting sign-in sheet?

we don't issue sign in sheets, you can get a list of planholders off the website

2. The bid worksheet indicates two (2) waste characterization samples, is that 1 for TENORM soil and 1 for non-TENORM soil?

a. Do you think we need to sample other materials for disposal such as the wood?

Contractor shall characterize and profile all waste streams as required by the designated disposal facility. If additional samples are required, cost will be reimbursed on a per unit basis.

3. Is all the soil expected to be disposed of as TENORM waste?

Crude oil-impacted soils are anticipated to be disposed of as non-hazardous special waste.

a. There is some soil (Tank 2, Tank 5 & Tank 7) and sludge (Tank 2) where the lab data are below 5 pCi/g. Do you want this soil to go to Wayne Disposal, or can it go to a KY Landfill?

Crude oil-impacted soils can be disposed of at a “contained landfill” in Kentucky.

4. Why is there a different volume for the “Excavation of TENORM impacted Soil” and “Disposal of TENORM Waste”?

The bid sheet has been revised. Values presented are for estimation purposes;

reimbursement by the State will be based on disposal receipts.

5. The bid worksheet indicates 125 tons of Disposal of TENORM Waste, why is the estimate 12 loads for Transportation?

a. Typically, a truck will carry ~ 20 tons per load.

b. Are we required to use ~10 yd roll-off containers?

The bid sheet has been revised. Means and methods of equipment usage are at the contractor's discretion.

6. The bid worksheet indicates 4,000 ft2 of backfill and seeding. However, based on the map, the area around the tanks is more like 14,000 ft2 - 15,000 ft2

a. Can you clarify?

Values presented are for estimation purposes; reimbursement by the State will be based on the final area of disturbance as agreed with the on-site Engineer.

7. Given the location, a rural wooded area, is the imported topsoil and fertilizer required at this site?

Yes, clean backfilling or grading of site soils is needed to prevent ponding. The use of soil amendments is required to promote the growth of vegetative cover.

a. The specs say backfill material from “on-site borrow”. This would suggest soil from the site can be re-graded to provide proper drainage.

Yes, if sufficient soil is present, this is acceptable.

b. Can you clarify?

See above comments.

8. Does the Department have a TENORM training course they would recommend or require?

No, several online training courses are available.

9. Are “mock drills” for emergency scenarios actual required, if a site-specific health & safety plan outlines spill response and daily meetings are conducted?

No, mock drills are not required. The Contractor should be prepared for a release event.

10. Is air monitoring required for this project? If so, do you have specific information on what type of monitor you require to be used?

Air monitoring is not required for the project. The contractor shall develop their own Health and Safety Plan based on the anticipated project.

11. Is “flame-resistant” clothing required if air monitoring and other safety equipment is used?

This is up to the individual Contractor's Health and Safety Plan.

12. Is the only lab testing being required for waste characterization of the TENORM soil/sludge? Or is other testing being requested?

Contractor shall characterize and profile all waste streams as required by the designated disposal facility. If additional samples are required, cost will be reimbursed on a per-unit basis.

13. Is Portland cement the only approved material for sludge solidification?

a. Can the contractor use other materials, such as sawdust?

No, Cementitious materials such as Portland cement, fly ash, or similar agents are specifically designed for soil solidification.

14. Please confirm, the “biweekly” progress meeting will be conducted every two (2) weeks?

Contractor shall provide a status update of the project to the Engineer every two weeks.

An email providing the status of the project is sufficient.

15. The timeline for project completion states 90 days, however, the TENORM lab analysis which is required for disposal at Wayne Disposal Facility takes 30 days to receive results, followed by waste profile approval from Wayne-which typically takes another estimated 15-20 days. Considering these factors, is the 90 day deadline a “hard” deadline? And will the $1,400/per day fine be waived due to these circumstances?

No, as long as the project moves progressively forward. This is why the 2-week notifications are needed to document the progress of the project.

16. The RFB states that the bid should be submitted electronically through the vss.ky.gov website-however, it also states in other sections that a hard copy should also be submitted. Can you clarify?

Bids are to be submitted electronically through the web-site.

17. Item #3 - I understand the successful contractor will be responsible for profiling each waste stream for approval. But, do you want us to re-sample & analyze or should we use your analytical results previously done?

Contractor shall characterize and profile all waste streams as required by the designated disposal facility. If additional samples are required, cost will be reimbursed on a per-unit basis.

18. Item #5 - Same question as above or do we assume this is oily water, non-hazardous?

Contractor shall characterize and profile all waste streams as required by the designated disposal facility. If additional samples are required, cost will be reimbursed on a per-unit basis.

19. Item #7 & 7A - LFI identifies 2 waste streams & disposal sites in the specs. 1 is TENORM to be taken to a subtitle c disposal site in MI & the other is non-haz to be taken to a local subtitle d facility. However, you only have 1 volume of waste (125 tons) & 12 roll-off loads.

The transportation & disposal rates for the 2 facilities are drastically different. Do you want http://vss.ky.gov/ us to assume all waste is hazardous or add another line item & clarify volumes for each waste stream?

The bid sheet has been revised. Values presented are for estimation purposes.

20. What are the sizes of the AST and volumes of materials:

AST – 4, 5, 6, 7 are 11 ft tall x 8.5 ft diameter. AST 4 – oil/water – approximately 1200 gallons, AST 5 – oil/water – approximately 150 gallons, AST 6 – water – 4,300 gallons, AST 7 – oil/water – 300 gallons

21. Are we to remove piping? How far back do we chase the pipes?

Contractor to dispose of any plastic pipe and recycle steel pipe in the immediate vicinity of the AST battery. Plugging of the pipes is not required.

22. Is gravel placed on the haul road required to be removed?

No gravel or any improvements can be left in place.
