About this file
This is an Addendum Three document issued by the Commonwealth of Kentucky Department for Facilities and Support Services, Division of Engineering and Contract Administration, for Invitation to Bid No. RFB-04-26 regarding the 24026 AMLBAML AML Project in Knott County, Kentucky, dated July 17, 2025. The project consists of abandoned mine land (AML) reclamation work addressing a residential slide at 69 Little Mountain Drive in Littcarr, Kentucky, involving construction of reinforced concrete walls, pile and lagging retaining walls, filter fabric installation, and subsurface drainage systems. The bid schedule includes 43 line items encompassing mobilization, utility relocation, landscape allowance, traffic control, structure removal, site preparation, grout work, reinforcing steel, concrete installation, erosion control, drainage structures (including HDPE and RHDPE pipe of various diameters), junction boxes, headwalls, soil and rock drilling, steel pile installation, pre-cast concrete lagging, seeding, and roadway repairs. The contract duration is 270 calendar days from the award date, with all work to be completed within this timeframe. No specific bid opening date, site visit date, or pre-bid conference date is referenced in this addendum, which serves to direct bidders to use the revised bid schedule dated 7/17/2025 and to reference additional specifications and drawings from Lynn Imaging for all additions, deletions, and changes to project requirements.
Unit pricing for bid items ranges from $1.00 per unit for utility relocation and landscape allowance to $1,500.00 each for 36-inch diameter concrete headwalls, with plan quantities varying significantly across line items (from 1.0 acres for site preparation to 68,550 pounds of reinforcing steel). The project notes indicate that bid item quantities listed on the schedule represent best estimates based on available subsurface data and field observations, with actual quantities subject to revision during construction. Bidders must conform to Allowable Price Limits (APL) noted on the bid schedule, and unit prices significantly deviating from the APL range may be considered unbalanced bids requiring written justification if the bid is deemed the lowest responsive. Contractors are required to submit completed AML Contractor/Subcontractor Information Forms with bids and must comply with Davis-Bacon prevailing wage requirements for all workers and subcontractors. The Commonwealth of Kentucky's Division of Abandoned Mine Lands (DAML) will be responsible for obtaining KYTC encroachment permits, Kentucky Division of Water permits, and U.S. Army Corps of Engineers permits, while contractors bear responsibility for all other permits and associated fees. The project budget and funding source are not explicitly stated in this addendum document.

24026AMLBAML CONSTRUCTION NOTES
Steel Beam / Rail Steel Orders:
No beams or rail steel shall be ordered for any project until written approval has been given by the ENGINEER. The CONTRACTOR is advised that many projects do not have any subsurface data.
As such quantities listed on the bid schedule, are best estimate based on maps and topography features observed in the field. Even on projects that have subsurface data, quantities listed may still be subject to revision.
Beams (W or HP)
Beams need to be rolled, and typically it takes 4 to 8 weeks before a roll date is issued for a specified beam. AML will work with the CONTRACTOR to allow time to get the beams ordered, rolled, and on-site. During this period, the CONTRACTOR may be granted excused days or may work on different features of the project. AML expects this period as short as 21 calendar days to 75 calendar days maximum. Based on pilot hole information obtained during reclamation activities, AML will determine the lengths of each piece needed in 5-foot increments. A table will be developed by AML and submitted to the CONTRACTOR. AML does not expect any beam to be greater than 50 feet for this project.

A. STANDARD DOCUMENTS
The AML Standard Details and Technical Specifications are posted on the Division’s website at https://eec.ky.gov/aml
Once on the web page, please click “Contractor Information” tab located on the right side. AML standard technical specification and detail are located under this tab. Contractors are strongly encouraged to review the complete AML website for additional information.
B. ALLOWABLE PRICE LIMIT
The lowest Allowable Price Limit (APL) is listed on the Bid Schedule as part of the bid documents. Unit Price, Plan Quantity, and Lump Sum are all methods of payment. Significantly low or high values entered by the CONTRACTOR on the Bid Schedule may be considered an unbalanced bid and may have to be justified in writing if such bid is deemed the low responsive bid.
An example would be if a CONTRACTOR assumes there may not be a need for the entire design quantity for Roadway Stone and entered a $10 value for Roadway Stone when the cost at the quarry is significantly higher. Another example would be if the CONTRACTOR enters a value of $30 per linear foot for “SILT BARRIER - BALES & FENCE” to front load payments for work items used near the beginning of the project. The CONTRACTOR is also cautioned that other considerations for rejection may be enforced such as the low bid being higher than the budgeted dollar amount for this project.
COR & BID & BMP 2
C. CONTRACT LENGTH
All work shall be completed within Two Hundred Seventy (270) calendar days from the effective date of the Award of Contract. Within the bounds of prudent project performance, it shall be the responsibility of the CONTRACTOR to plan and implement construction sequences which follow the intent of these CONTRACT DOCUMENTS, particularly as, reflected in the Drawings and Special Conditions and to protect any portion of the contract which may be completed before others.
D. CONTRACTOR’S INFORMATION SHEET
The AML CONTRACTOR/SUBCONTRACTOR INFORMATION FORM sheet must be filled out and submitted with the bid. Failure to submit the AML Contractor/Subcontractor Information Form sheet with the bid will be the basis for declaring the bid “Non-Responsive.”
E. SPECIAL CONDITIONS & PROJECT NOTES
- When applicable, AML is responsible for payment to the Imperiled Bat Conservation Fund (IBCF). The CONTRACTOR will be responsible for adhering to the boundary for which payment was made and confirming with AML the acreage of trees removed.
- On occasion, a property owner may require a CONTRACTOR to add them on their General Liability and/or Automobile Insurance as an “Additional Insured.” AML will inform the CONTRACTOR when this requirement is being made by the property owner. In these cases, the CONTRACTOR must submit to AML copies of their certificate of insurance documenting the “Additional Insured” before they will be allowed to mobilize equipment and forces on to said properties. Any fees, rate increases, or other costs incurred by the CONTRACTOR for this requirement, if any, will be considered incidental to mobilization and as such no compensation will be made by AML. The “Additional Insured” must remain on the CONTRACTOR’s policy(s) for the full length of the contract.
- Add any special conditions, notes, exceptions to standard documents or write “None”.
- Add Bid Item descriptions that are contrary to standards notes.
F. DAVIS BACON SCALE WAGES
The CONTRACTOR and all SUBCONTRACTORS are required to pay scale wages as defined in the contract documents. If all employment categories that may be used have not been listed and specified in the contract document, then the contractor must make his best determination of what the missing wage rate will be. Subsequently after the bid is awarded, the contractor must request the specific rate from the Department of Labor. AML will not issue change orders for additional compensation if the wage rate determined by DOL is higher than the rate the contractor used to develop his bid. If wage rates are not included for a specific category, AML suggests that the contractor assume the highest operator or laborer wages that are listed when developing his bid.
G. PERMITS & FEES – AML will be responsible for obtaining any permits that are checked below.
(Check all that apply)
COR & BID & BMP 3
☒KYTC Encroachment Permit

Erosion and Sediment Control Best Management Practices (BMP) Plan
January 2017
OVERVIEW
This Best Management Practices (BMP) plan is a guide for Kentucky Division of Abandoned Mine Lands (DAML) projects. It contains information regarding preventing, reducing and controlling erosion, sediment, and pollutant runoff from Abandoned Mine Land (AML) Reclamation and Acid Mine Drainage (AMD) Abatement project construction sites. The information in this BMP will aid DAML staff and contractors in selecting, installing, and maintaining erosion prevention and sediment control measures during the different stages of construction. This BMP plan, in accordance with DAML Technical Specifications and Standard Drawings, is intended to protect Kentucky’s streams from potential water quality impacts resulting from DAML projects.
This general BMP document is to outline the various pollution prevention measures used on AML Reclamation or AMD Abatement Projects. The primary sources of pollutants are solids mobilized during storm events and precipitants from mineralized mine drainage. Other sources of pollutants include oil/fuel/grease from servicing and operating construction equipment, concrete washout water, sanitary wastes, and trash/debris.
EROSION PREVENTION AND SEDIMENT CONTROL MEASURES
Plans for Reclamation and AMD abatement construction projects will include erosion control measures on the planview sheets when possible, and will depict Disturbed Drainage Areas (DDAs) and related information. The construction notes and project description may describe other control measures. The Contractor and Engineer may select an additional BMP for the project as the project changes and construction progresses. Projects that do not have DDAs annotated in the plans will employ the same concepts selecting and implementing this general BMP plan.
Address disturbed areas or sources of sediments by the most effective means in the specific work area. Direct non-storm water discharges to sediment basins/traps or to a filter fence enclosure in a flat vegetated infiltration area or filtered via another approved commercial product. All deep mine and surface impoundment water will be tested and treated, when as necessary, to meet the DAML Water-Treatment and Disposal Technical Specification unless stricter limitations are listed in an existing Total Daily Maximum Load (TMDL) limit.
PERMITS
COR & BID & BMP 22
The DAML shall review each project during project development to determine whether any permits are required to implement the project work. When a permit is required, DAML will make every effort to obtain the permit prior to letting the project for bidding. Permit specific conditions shall trump any standard conditions and/or practices. All permits must be maintained onsite and produced when requested by regulatory authorizes inducing representative of the permitting authority.
Common permits types for DAML projects:
401 Water Quality Certification (WQC) o Issued by the KY Division of Water
402 KY Pollution Discharge Elimination System (KPDES) o DAML activities are covered under the AML KPDES General Permit
404 US Army Corps of Engineers (USACE) o Issued by the US Army Corps of Engineers- Nashville District, Louisville District, or Huntington District (Depending upon major drainage basin) KY Stream Construction (Floodplain) o Issued by the KY Division of Water Local Floodplain Permit o Issued by the County/Municipality Local Storm Water Construction o Issued by the County/Municipality
A) Field Review Walk-Thru:
The DAML will conduct a project review between the Project Engineer, Construction Branch Personnel, Project Design Technician, and Field Office Staff, to review the construction plans and identify any changes needed prior to letting the project for bidding. The group will evaluate the locations and types of site specific BMP and any other erosion prevention and sediment control measures chosen for incorporation into the final design plans.
B) Site Visit Meeting
DAML will present the project specific BMP and permit requirements/conditions to the potential contractors during the site visit meeting.
C) Pre-Construction Conference
Prior to the actual beginning of the project, DAML will hold a pre-construction conference between representatives of the DAML, the Contractor, including any Subcontractors, as well as other interested agencies and parties. Items discussed will include the time and sequence for construction, planned methods of operation, payment, and other relevant questions including any permit requirements and the erosion and sediment control plan.
D) Construction Access
COR & BID & BMP 23
This is the first land-disturbing activity. Construction entrances shall be a minimum of twenty
(20) feet wide by fifty (50) feet long, measured from the shoulder of the public road, and consist of No. 2 aggregate over a heavy weight non-woven filter fabric base. As soon as construction begins, stabilize bare areas with gravel and temporary mulch and/or vegetation.
E) Clearing and Grubbing
Use the following techniques for clearing and grubbing activities:
1) Leave areas undisturbed when possible.
2) Construct silt basins to provide…
