About this file

This is an Addendum One to an Invitation to Bid (RFB-69-26) issued by the Commonwealth of Kentucky Department for Facilities and Support Services, Division of Engineering and Contract Administration, in coordination with the Department for Natural Resources, Division of Abandoned Mine Lands (DAML), for the 25018 AMLMAML AML Project in Laurel County, Kentucky. The project involves reclamation and stabilization work on a 5-acre residential property experiencing active slope failure and drainage issues from deep mine sources. The scope of work includes installing gabion retaining walls (120 linear feet, 15-21 feet tall, plus wings), subdrain systems, non-reinforced concrete block walls, erosion control measures, pipe installation, revegetation, and related earthwork. The bid schedule contains 44 line items with unit prices and quantities, including mobilization, utility relocation, landscaping allowance, site preparation, concrete work, drainage control, wall structures, and revegetation tasks. Addendum One, issued September 16, 2025, modifies the bid schedule by increasing Erosion Control Blanket quantities by 350 square yards, clarifying Chain-Link Fence specifications, adding a new Stamped Concrete Patio lump sum item, and revising the ditch design from a 4-foot rock-ditch drain to a 2-foot Class II/III ditch. All work must be completed within 270 calendar days from the contract award date, and bidders must submit the AML Contractor/Subcontractor Information Form and properly executed authentication of bid documentation for validity.

Pricing for bid items uses unit price, lump sum, actual cost, and plan quantity payment methods, with an Allowable Price Limit (APL) established for each item to identify potentially unbalanced bids. The contractor must pay Davis-Bacon scale wages as defined in contract documents, with provisions for requesting missing wage rates from the Department of Labor after bid award. The Commonwealth of Kentucky is responsible for obtaining KYTC Encroachment Permits, Kentucky Division of Water permits, and USACE permits; the contractor is responsible for all other permits and fees necessary to mobilize and begin work. No specific funding source is identified in the addendum, though the project follows DAML Standard Details, Technical Specifications, and Best Management Practices for erosion and sediment control. Contractors bidding on this project acknowledge review of standard details and technical specifications available on the DAML website at eec.ky.gov/aml. Special conditions include restrictions on vehicle access to the concrete driveway, requirements for property owner's additional insured status on insurance policies if mandated, and compliance with stream protection and water quality standards during construction activities.

Revised 12/11/2024

COR & BID & BMP 1

LAUREL COUNTY, KENTUCKY

The project consists of one site totaling 5 acres in size. A large slide has occurred just below the home and is currently active. Drainage is seeping through the slide area and is causing the slope to stay fully saturated. The homeowner has tried to stabilize the slope by installing jersey barriers and ECB on the slope but it continues to move. In addition to this slide, drainage from a deep mine is daylighting from the slope just above the home and causing the yard and house seat to stay saturated. Reclamation plans will include stabilizing the slope below the home with a gabion retaining wall and subdrain to transport drainage to the roadside ditch. Drainage above the home will be captured in a pipe and transported to an excavated rock ditch over the slope, where the drainage is currently flowing. Subsurface drainage will be collected with a subdrain and will also daylight into the excavated rock ditch. To protect the longevity of the subdrain and other features installed from the severely eroded slope above, a concrete block wall will also be installed.

The project is located in Laurel County, within the London Quad and PU #417. Directions to the site are as follows: From the London AML office, take E Hal Rogers Parkway for 1.1 miles and turn left onto

KY-30 E. Travel for 1.8 miles and turn right onto State Hwy 1225. Travel 2.1 miles and the project is located on the right at coordinates 37°10’36.192” N, -84°3’55.64” W. To access the waste area, turn left out of the Napier driveway and travel 1.2 miles northwest on State Hwy 1225 towards Elza Road. Turn right onto Elza Road and waste area is 0.4 miles on right at coordinates 37°10’48.37” N, -84°5’8.59” W.

A. STANDARD DOCUMENTS

The AML Standard Details, Technical Specifications, and Bid Item Descriptions are posted on the

Division’s website at https://eec.ky.gov/aml

Once on the web page, please click “Contractor Information” tab located on the right side. AML standard technical specification and detail are located under this tab. Contractors are strongly encouraged to review the complete AML website for additional information.

B. ALLOWABLE PRICE LIMIT

The lowest Allowable Price Limit (APL) is listed on the Bid Schedule as part of the bid documents. Unit

Price, Plan Quantity, and Lump Sum are all methods of payment. Significantly low or high values entered by the CONTRACTOR on the Bid Schedule may be considered an unbalanced bid and may have to be justified in writing if such bid is deemed the low responsive bid.

An example would be if a CONTRACTOR assumes there may not be a need for the entire design quantity for Roadway Stone and entered a $10 value for Roadway Stone when the cost at the quarry is significantly higher. Another example would be if the CONTRACTOR enters a value of $30 per linear foot for “SILT BARRIER - BALES & FENCE” to front load payments for work items used near the beginning of the project. The CONTRACTOR is also cautioned that other considerations for rejection may be enforced such as the low bid being higher than the budgeted dollar amount for this project.

C. CONTRACT LENGTH

All work shall be completed within TWO HUNDRED SEVENTY (270) calendar days from the effective date of the Award of Contract. Within the bounds of prudent project performance, it shall be the responsibility of the CONTRACTOR to plan and implement construction sequences which follow the https://eec.ky.gov/aml

COR & BID & BMP 2

intent of these CONTRACT DOCUMENTS, particularly as, reflected in the Drawings and Special

Conditions and to protect any portion of the contract which may be completed before others.

D. CONTRACTOR’S INFORMATION SHEET

The AML CONTRACTOR/SUBCONTRACTOR INFORMATION FORM sheet must be filled out and submitted with the bid. Failure to submit the AML Contractor/Subcontractor Information Form sheet with the bid will be the basis for declaring the bid “Non-Responsive.”

E. SPECIAL CONDITIONS & PROJECT NOTES

- When applicable, AML is responsible for payment to the Imperiled Bat Conservation Fund

(ICBF). The CONTRACTOR will be responsible for adhering to the boundary for which payment was made and confirming with AML the acreage of trees removed.

- On occasion, a property owner may require a CONTRACTOR to add them on their General

Liability and/or Automobile Insurance as an “Additional Insured.” AML will inform the

CONTRACTOR when this requirement is being made by the property owner. In these cases, the

CONTRACTOR must submit to AML copies of their certificate of insurance documenting the

“Additional Insured” before they will be allowed to mobilize equipment and forces on to said properties. Any fees, rate increases, or other costs incurred by the CONTRACTOR for this requirement, if any, will be considered incidental to mobilization and as such no compensation will be made by AML. The “Additional Insured” must remain on the CONTRACTOR’s policy(s) for the full length of the contract.

- NONE

F. DAVIS BACON SCALE WAGES

The CONTRACTOR and all SUBCONTRACTORS are required to pay scale wages as defined in the contract documents. If all employment categories that may be used have not been listed and specified in the contract document, then the contractor must make his best determination of what the missing wage rate will be. Subsequently after the bid is awarded, the contractor must request the specific rate from the

Department of Labor. AML will not issue change orders for additional compensation if the wage rate determined by DOL is higher than the rate the contractor used to develop his bid. If wage rates are not included for a specific category, AML suggests that the contractor assume the highest operator or laborer wages that are listed when developing his bid.

G. PERMITS & FEES – AML will be responsible for obtaining any permits that are checked below.

(Check all that apply)

☐KYTC Encroachment Permit

☐KY DOW Water Permits

☐USACE Permit

COR & BID & BMP 3

The CONTRACTOR is responsible for all other permits and/or fees necessary to begin the project. The

CONTRACTOR is advised that on occasion, other permits and/or fees may be required by federal, state, and local government(s). Other types of permits and/or fees are not the responsibility of AML and as such, these will be the complete and total responsibility of the CONTRACTOR to obtain. These must be obtained before AML will allow mobilization of equipment and forces on to said properties. All costs associated with other permits or fees will be the responsibility of the CONTRACTOR. Please refer to

“General Provisions” in the AML Technical Specifications.
