About this file

This is an addendum document issued by the Commonwealth of Kentucky Department for Facilities and Support Services, Division of Engineering and Contract Administration, for Invitation to Bid No. RFB-14-27 concerning lead soil abatement at the Former Trimble County Newspaper building in Trimble County, Kentucky, under the Department for Environmental Protection. The project involves the removal and proper disposal of contaminated soil with lead concentrations exceeding EPA residential screening levels of 200 ppm. Key project specifications include excavation to building footers and foundations, TCLP RCRA Metals analysis for waste characterization, removal and replacement of affected vegetation, removal and relocation of stone retaining walls, and site restoration including reseeding and fence replacement if damaged. The project site is located at 132 Church Street, Bedford, Kentucky, with investigations conducted on December 4, 2024; February 21, 2025; March 21, 2025; and May 9, 2025. Excavation delineation is generally bounded by existing buildings and sidewalks as shown on the project site map, with contamination detected at depths ranging from surface level to 24 inches depending on location.

The addendum clarifies that contractors are responsible for all waste characterization testing and determining appropriate disposal practices, with no over-excavation required beyond EPA threshold delineation. Professional surveying is not required; a red-lined as-built drawing with owner verification is acceptable. Third-party compaction testing is not required; proof rolling or visual inspection of compaction is acceptable for this shallow excavation project. A water source for equipment decontamination and dust control is available from the Trimble County Courthouse. Tree removal and replanting of similar hardwood species (8-foot minimum height) is required for two large trees within the construction zone, while neighboring property contamination discovered during delineation may require supplemental excavation of six inches to two feet, depending on confirmatory laboratory analysis results. Temporary construction activities must be coordinated with Judge Executive John Ogburn, and replacement fencing, if damaged, must match the existing white wooden picket fence style.

Invitation to Bid No. RFB-14-27 For: Former Trimble Co. Newspaper-Lead Soil Abatement Department for Environmental Protection Trimble County, Kentucky

Susan Ward, Statewide Procurement Analyst II Division of Engineering and Contract Administration

RFB-14-27 Former Trimble Co Newspaper Lead Soil Abatement Project Bidder Questions & Answers

1. Will all material removed from the site be considered Non-Hazardous Material?

The contractor is responsible for running TCLP RCRA Metals analysis on materials removed from site and determining the best disposal practice.

2. Will there be any over-excavation if results at depth are not optimal?

No, results are to determine whether the site and clean soil cap should be managed by the state or whether the site can be closed as clean and fully restored.

3. If the fence were to be damaged upon removal, what material should be used to replace the fence?

If damaged, replacement fencing should be similar material to current fencing (white, wood picket fencing)

4. Is the stonework in front of the building being removed and disposed of?

The stone retaining wall in front of the old newspaper building is to be removed and set aside for future use by Trimble Co (Trimble Co maintenance staff will haul away). It is suggested to use the old sidewalk directly in front of the building that is to be saved, using care not to drop stones or cause damage. This must be discussed and approved in consultation with Judge Executive John Ogburn.

The stone retaining wall behind the Trimble Co building shall be removed, be placed and kept safely adjacent to the yard and sidewalk, and then reinstalled as similar to existing“as-is” condition as possible after excavation work is completed.

5. How close will excavation take place to the structures on site?

Excavation shall extend to the footers/foundations of the buildings in place.

6. Is there a water source available for use on-site?

A hose can be run from the Trimble County Courthouse for equipment decontamination, seeding and potential dust control.

7. Specification 02100-Surveying, section D.7 and Specification 02400-Excavation and Removal of Contaminated Soils, section 3.04, G.2 mentions providing an as-built drawing showing final site contours and the extent of excavation details based on survey measurements. The extent of the excavation is generally defined by the existing buildings and sidewalks as shown on Figure 1 - Site

Map. Instead of hiring a professional surveyor, is a red lined as-built drawing, along with field verification/acceptance of final graded backfill contours by the

Owner's representative acceptable?

Yes, due to the small scale of the project and shallow gradient, we feel that a professional survey is unnecessary for this project site.

8. Specification 02430 - Soil Backfilling and Compaction, section 1.03, A calls for third party compaction testing. Compaction must be accomplished by mechanical means. Since this is a shallow excavation over a small area, is proof rolling or other visual means of compaction testing acceptable if the area is compacted with a vibratory sheepsfoot roller?

Due to the shallow excavation over a small area, proof rolling or other visual means of compaction testing is acceptable. (3rd party testing is not required)

9. Specification 015600-Testing Laboratory Services and Section 022423-Chemical

Sampling and Analysis of Soils and Waste specify waste characterization analysis for TCLP Metals, Total VOCs, SVOCs, and Cyanide. During the site visit meeting, it was stated that previous sampling for Totals has been completed at this site. Will the contractor be provided with this analytical data thus limiting our waste characterization analysis to only TCLP 8 RCRA Metals + Mercury?

TCLP RCRA Metals sampling and analysis is the primary concern and only requirement for this project. Lead (Pb) is the only constituent of concern with actionable levels. A copy of the summary report for previous background testing, sampling and analysis showing the whole site and depth delineation will be provided in the final addendum.

10. Pay Item 3 on the Bid Form covers the cost for Waste Characterization and TCLP analysis based on a per sample unit rate. The cost to mobilize to the site to collect the sample is a relatively fixed cost. If the disposal facility requires more than 1 sample to be collected, the per sample cost will be skewed high. Can this line item be broken up into 2 parts to better reflect actual costs? (A Waste

Characterization Sample Collection cost on a per trip basis and a TCLP Analysis cost on a per sample basis)

No, the bid worksheet will remain the same. The unit per sample price for Waste

Characterization, Profiling and TCLP Analysis should all inclusive of labor, mobilization, analysis, profiling, and coordination with the waste disposal facility for acceptance and approval.

11. Where should the temporary construction field office be staged?

The recommended spot to stage any equipment and park a trailer or mobile office (if one is determined to be necessary) would be in the parking area located directly in front of the old newspaper building, or a little adjacent if getting equipment in and out would prove to be an issue.

12. Snow fence requirement (21500) states that snow fence should be no closer than

10 feet to excavation. This will put the snow fence in the street in some locations.

The snow fence may be located at the edge of the sidewalk as opposed to 10-feet out, as long as construction can occur safely within the fenced area.

Temporary, partial road or lane impacts in the immediate project area must be discussed and approved in consultation with Judge Executive John Ogburn.

13. Where is the offsite storage location for the cut trees?

The removal and off-site disposal of trees is at the discretion of the contractor (Refer also to Tree Removal and Replacement section in the Addendum below)

14. Is it acceptable to use blocks for the temporary construction fence posts, rather than installing them in the ground?

Yes, cement blocks may be used as a base for temporary construction fence posts, and the use of any additional traffic cones or safety measures that a contractor deems necessary would be supported and is encouraged.

15. Will we be able to drive rubber-tracked equipment on the sidewalk in order to load trucks?

Yes, it is understood that driving across the sidewalk is unavoidable to access the property and conduct the required site work. BMPs and common sense should be used regarding the need for any additional protective barriers. With the picket fence removed, much of the property can also be accessed via the road behind the northeast corner of the building and the Eric Cornett home.

16. Where do we take the retaining wall stones removed from the printing building area?

Refer to Question #4 answered above

Additional Addendum and Project Guidance:

Tree Removal and Replacement

• There are three (3) large trees within the construction zone southeast of the Trimble Co old newspaper building that will require removal via a tree service.

The two (2) large trees within the fenced area shall be replanted with a similar hardwood species (8’ minimum height). The large double trunk tree on the fence line is not required to be replaced. *The removal and off-site disposal of trees is at the discretion of the contractor.

• The evergreen shrub located in front of the Gwen Higgins residence (owned by

Eric Cornett) located behind the Trimble Co building will need to be removed and replaced in order to complete the planned excavation activities at the site. The evergreen shrub can be over-excavated and set aside (and kept alive via regular watering) and then reinstalled. If the tree is damaged or removal and replacement is not feasible, the owner would like to have a new similar evergreen shrub planted upon completion of the project in addition to the normal reseeding process to restore the lawn similar to “as-is” condition as possible.

Fence Removal and Replacement

• The bid specification for Fencing (Section 02840) is overly excessive and exorbitant for the project scale and scope. We apologize for this oversight.

• The white wooden picket fence located around the vacant lot adjacent to the

Former Trimble County Newspaper, if damaged upon removal, is to be replaced with a similar wooden picket fence (typically available at your local big box home improvement stores)

I. Investigation Results

Findings/Violations/Recommendations:

Arrived at the site at 11am EST with Kyle Skeese, Philip Siguenza, Thomas Murrell and Ben Applegate.

We discussed the HASP and set up the equipment (PPE, hand augers, clean sampling surfaces, and recording materials).

Soil was extracted using stainless steel hand augers to a depth of 12”, further depth was attempted. 7 of the 8 borings were taken to refusal, which was 12 to 15 inches across the property. Sampling was performed using an XRF hand scanner at a depth of 6” and 12”, soil was placed on a plastic liner for sampling.

The first 6 inches of soil appeared to be visually impacted. It was dark in color and had a foul odor.

There were two exceptions, after about 4 inches, borings SS 3 and SS 4 contained what appeared to be fill material. It was sandy in nature and had a lighter color to it.

The table below provides the results of each XRF scan.

Arrived at the site at 11am EST with Kyle Skeese and Thomas Murrell. We discussed the HASP and set up the equipment (PPE, hand augers, clean sampling surfaces, and recording materials).

The surface of the soil was lightly scraped using a stainless-steel spoon, no deeper than 2”. A total of 6 surface samples were taken across the lawn (approx. 15ft apart) to better delineate the area of contamination and to determine if deeper sampling was necessary.

One surface scan, SS 1 had a reading of 288ppm for lead, which prompted deeper sampling. 6” and 12” borings were taken and scanned using the XRF. The first 6 inches of soil appeared to be visually impacted as it was very dark in color. The second 6 inches of soil was very light, sandy and full of glass;

Arrived at the site at 10am EST with Kyle Skeese, Thomas Murrell, Benjamin Applegate and Philip Siguenza.

Upon arrival, Michael Eads spoke with a member of OnTheSpot, who was finishing his process marking the property.

Then the HASP was reviewed, PPE donned, XRF, clean sampling surfaces, and recording materials all prepped, before preparing the Geoprobe® for sampling.

A total of five soil borings were advanced to a depth of 10 feet utilizing a track mounted Geoprobe® Model 5400 with direct push technology. The direct-push rig utilized dual tube tooling which consisted of five-foot sections.

All five of the 0’-5’ soil borings exhibited what appeared to be visual impact to the top 1-2ft of soil, depicted below.

Pictured: SS-5 (0’-5’) Visual impact circled in red *Representative of all 0’-5’ samples.

All five of the 5’-10’ soil borings exhibited even color, consistency and did not visually appear impacted. No odors were observed during the visit.

Michael Eads and Kyle Skeese arrived at the site at 10:00am EST to complete site delineation. Michael

Eads covered the information in the HASP, then Michael and Kyle set up a clean sampling space, donned PPE and prepared the sampling equipment. Sampling began at the fence line in the northeast most corner of the East adjacent property. Michael Eads completed surface scans using the XRF. Clear plastic bags were used to protect the XRF from contamination and damage. The top of the soil was cleared of organic growth and debris before each scan. The initial scan at the fence line, showed 362ppm for Pb, this prompted additional scanning further into the property. A scan was taken at 5ft from the fence line, resulting in 97ppm for Pb. Michael Eads then moved to 3ft from the fence line, resulting in 212ppm for Pb. The final scan was at 4ft from the fence line, resulting in 176ppm for Pb. This directed the rest of the scanning process for the property. Remaining scans began at 3ft from the fence line and were extended East (toward the building) if necessary.

Findings showed that the fence line adjacent to the property is contaminated. Scans were consistently higher than EPA residential RSLs out to 4ft beyond the fence line. Michael Eads hand augured to 6” at SS-

14/SS-47(lab sample labeled SG-47) to find the extent of contamination. Pb levels dropped to 174ppm at 6”.

This leads SFB to believe that the neighboring property has surficial contamination and that a 6-inch scrape and haul would be sufficient, depending on confirmatory sampling results.

However, the southernmost 8 feet of the property, along the sidewalk, showed heavy contamination to the adjacent building. The contamination in this area reached over 1000ppm. This area was hand augured to 2ft by Michael Eads. XRF and lab samples were taken every 6 inches and showed Pb contamination down to

18’’(530ppm). At 2ft Pb was found to be 192ppm. This area would need to be excavated 2ft, the same as 132

Church Street.

A total of 42 scans were taken with the XRF and 7 confirmatory lab samples were taken in 4oz amber jars, placed on ice and delivered to the Kentucky Environmental Laboratory on Sower Boulevard in Frankfort, Ky at 3:44pm EST.

II. Comments Including Remedial Measures and Expected Correction Dates

III. Environmental/Human Health Impact

The neighboring property will likely require a 6” scrape and haul 4ft out from the fence line. The 8ft closest to the sidewalk will likely need 2ft of soil to be excavated, the same as 132 Church Street, as Pb contamination at 18” is 530ppm and 24” is 192ppm.

Rough Image of the future excavation. Red is 2ft. Yellow is ten feet wide and 6” deep. Blue are structures(sidewalks, fences).
