KCNA Wholesale Services Re-Bid Summary

This is Addendum One to a Request for Proposal (RFP) issued by the Commonwealth of Kentucky Finance and Administration Cabinet on behalf of the Kentucky Communications Network Authority (KCNA) for wholesale telecommunications services. The RFP seeks a qualified vendor experienced in leasing middle-mile fiber optic cable to operate as a wholesale services partner for KentuckyWired, the state's 3,400-mile open-access fiber network connecting all 120 Kentucky counties. The selected vendor will be responsible for marketing and leasing dark fiber and lit fiber services to Internet Service Providers (ISPs) and other broadband providers on a non-discriminatory, open-access basis, with an emphasis on dark fiber leasing. The vendor will not provide last-mile retail services. The RFP was released on March 4, 2026, with proposals due by 3:30 PM ET on April 24, 2026. No vendor questions were submitted by the first deadline of March 16, 2026, and the second question deadline is April 6, 2026. This is a re-solicitation of a previous RFP that closed on December 17, 2025 without award. The contract term is ten years from the effective award date, with two optional five-year renewal periods available upon mutual agreement.

Vendors must submit proposals in three parts: technical proposal, cost proposal, and proprietary information. The technical proposal will be evaluated on a maximum of 1,700 points across six criteria, including executive summary, company background, technical approach, implementation plan, timeline with milestones, and project management plan. The cost proposal is worth a maximum of 1,000 points based on proposed revenue generation for KCNA. Oral presentations and demonstrations may be required for the top three vendors and are worth up to 500 points. Proposals scoring less than 50 percent of maximum technical points will be deemed non-responsive. The Commonwealth reserves the right to negotiate with the highest-ranked vendor and proceed to lower-ranked vendors if negotiations fail. Mandatory submission requirements include the transmittal letter, mandatory requirements checklist, tax registration documentation, proof of authorization from the Secretary of State if applicable, and required affidavits. The vendor must maintain Commercial General Liability Insurance of at least $1,000,000 per occurrence and $2,000,000 aggregate, with the Commonwealth listed as an additional insured. Price adjustments are not permitted during the first twelve months; thereafter, increases require industry-wide justification and 30 days' notice. All prices must be firm fixed unit prices, not cost-plus arrangements.

The Finance and Administration Cabinet is the only office authorized to change, modify, amend, alter, or clarify the specifications, terms and conditions of this RFP.

A contract, based on this RFP, may or may not be awarded. Any contract award from this RFP is invalid until properly approved and executed by the Finance and Administration Cabinet.

1.3 Agencies to Be Served

This contract shall be for use by the Kentucky Communications Network Authority (KCNA). No shipments shall be made except upon receipt by vendor of an official delivery order from the using agency.

SECTION 2 - INTRODUCTION

2.1 Purpose

The purpose of this Request for Proposal (RFP) is to solicit proposals for competitive negotiations pursuant to 200 KAR 5:307. Kentucky Communications Network Authority (KCNA) seeks a vendor experienced in the leasing of middle-mile fiber optic cable. The successful vendor will leverage the excess fiber capacity on the Next Generation Kentucky Information Highway (commonly referred to herein as KentuckyWired) to expand broadband in the Commonwealth by leasing dark and/or lit fiber services to Internet Service Providers (ISP) in the Commonwealth on an open access basis.

To expand broadband statewide, the Commonwealth seeks to partner with a qualified, experienced telecommunications wholesaler. The selected wholesaler will be responsible for marketing and leasing available capacity on the network to public and private broadband providers but will not provide last mile retail service to businesses and citizens. The goal of this procurement is to secure a partner committed to meeting the public purpose of KentuckyWired through private sector partnerships with entities such as ISPs, regional carriers, and network operators who utilize middle mile capacity to deliver broadband services to last-mile customers. The procurement also seeks a partner capable of maximizing the value and utilization of KentuckyWired in alignment with statutory mandates and the Commonwealth’s public policy objectives related to broadband access and digital equity.

This RFP invites responses from vendors with a demonstrated history of successful middle-mile commercialization, open-access network management, and wholesale telecommunications service delivery. The successful respondent will enter into a Wholesaler Agreement with KCNA, and must operate in full compliance with applicable laws, regulations, and KentuckyWired system requirements. The Wholesaler Agreement will be negotiated with the highest ranking vendor.

2.2 Background

The Commonwealth of Kentucky developed and deployed KentuckyWired, a state-owned, open-access, middle-mile fiber optic network, to serve as a strategic infrastructure investment to support statewide broadband access, enhance connectivity for public agencies, and promote economic development across the Commonwealth.

KentuckyWired is a high capacity 3,400-mile fiber project which connects all 120 Kentucky counties. It currently serves Kentucky executive branch government agencies, public universities, community colleges, and the Administrative Office of the Courts. KCNA can serve other public institutions, such as health departments and city and county governments. The network includes excess or unlit capacity which can be made available to the private sector for commercial use under the Commonwealth’s open-access model. This model ensures fair, non-discriminatory access to KentuckyWired’s infrastructure by multiple service providers and promotes competition in the last-mile broadband market.

2.2.1 Contracts related to KentuckyWired

The Commonwealth utilized the Public-Private Partnership model to design, construct, operate, and maintain KentuckyWired through 2045. To achieve this goal, on December 22, 2014, the Commonwealth awarded a contract to Macquarie Infrastructure Developments, LLC (Macquarie) to design, construct, operate and maintain the network. Macquarie led a team comprised of Ledcor and Black & Veatch, who would oversee the design, construction, operation, and maintenance of KentuckyWired.

The Commonwealth established KentuckyWired Infrastructure Corp (KWIC), a 501(c)(4) non-profit entity to purchase tax exempt bonds. The Commonwealth and KWIC entered into the Project Agreement for the design, construction, operation and maintenance of the network.

KWIC entered into the Project Implementation Agreement with KentuckyWired Operations Co. (KWOC), a limited liability company created by Macquarie. In this agreement, KWOC undertook full responsibility for the design, construction, operation, and maintenance of KentuckyWired.

KWOC passed its obligations to operate and maintain the network to LTS Kentucky Managed Technical Services through the Services Contract. That contract is in effect and ongoing. However, KWOC is not relieved of its obligations under the PIA although it has entered into a contract with the Service Provider.

KCNA entered into agreements with Cincinnati Bell Inc., d/b/a Altafiber, MuniNet Fiber Agency, East Kentucky Network and Bluegrass Network to construct and maintain the network in their areas of operation. Under these agreements, fiber optic cable is available for the new Wholesaler’s use to provide services.

Owensboro Municipal Utilities constructed and maintains fiber in its area, but the Commonwealth owns that fiber optic cable.

Refer to Attachment G for a diagram of the contractual relationships.

2.2.2 Technical aspects of the KentuckyWired network

KentuckyWired is fully operational, secure, and available. The network is open access, meaning all services are provided on a non-discriminatory, competitively neutral basis, consistent with KentuckyWired’s statutory mandate. The network is available 99% of the time.

The Network is comprised of more than ~3,400 miles of fiber including 3rd party Indefeasible Right to Use (IRU) territories ~2,400 miles installed by KCNA, ~1,000 miles of IRU fiber) that are arranged in six fiber rings identified as Rings 1A, 1B, 2, 3, 4, and 5.

Refer to Attachment H for a map representing the KentuckyWired network.

Most of the Rings were constructed with 288 count fiber cable, and a number of those fibers are unused and available.

KentuckyWired includes 33 core node locations, of which 13 are collocated in data centers and 20 are independent, free-standing telecommunication shelters (or huts). These locations utilize Fujitsu Flashwave 9500 DWDM equipment that is MEF 2.0 certified and supports integrated ROADM, SONET, and OTN.

20 Additional signal regeneration extender sites which currently utilize either EX4300 or EX4550 switches.

Core and edge routing supported by Juniper MX series routers

Utilize Juniper EX switches at Access sites, with some key locations using Fujitsu S100 Carrier Ethernet switches which have 100G client ports and are capable of an aggregated switching capacity of 1.2Tbps

Our service catalog includes:

100G Optical Lambda Transport Services:

• E-Line managed Ethernet services at speeds up to 100G

• Managed Routed Services, including L3VPN and Internet services

10G: E-Tree and E-LAN managed Ethernet services at speeds up to 10G

Direct Internet Access has top-of-the-line filtering and DDos protection from

Fortinet and Radware.

2.2.3 Refresh of KentuckyWired equipment

KCNA is in the early stages of a network refresh that is contractually driven every ten (10) years.

a. The network refresh will replace FW9500s with the 1Finity platform. This will provide capacity for 400 Gb bandwidth capabilities in Ring 1A locations.

b. The 1Finity platform supports 32 add/drop channels on the Wavelength Selectable Switches, which represents a significant expansion to our capacity if we start to utilize more of our fibers in the future and modernize the routing engines and interface modules of the core routers (MX480 and MX960 devices). Both MX node types will support cards that are MEF 3.0 certified.

c. The majority of the EX2300 and EX4300 switches used at the customer premises will be upgraded to EX4100 and EX4400 switches.

2.2.4 Definitions

“Dark Fiber Services” means optical fiber that has been constructed/installed but is not currently being used for fiber-optic communications.

“Lit Fiber Services” means any services provided to an ISP by the vendor other than rights provided to the ISP through an Indefeasible Right of Use (IRU). “Lit Fiber Services” does not include last mile retail service.

SECTION 3 – SCOPE OF WORK

PROPOSALS THAT DO NOT MEET MANDATORY REQUIREMENTS WILL BE

DEEMED NON-RESPONSIVE AND WILL NOT BE CONSIDERED. REFER TO

9.1 Agencies to Be Served

This contract shall be for use by the Kentucky Communications Network Authority (KCNA). No shipments shall be made except upon receipt by vendor of an official delivery order from the using agency.

9.2 Term of Contract and Renewal Options

The initial term of the contract shall be for a period of ten (10) years from the effective date of the Award of Contract.

This contract may be renewed at the completion of the initial contract period for two (2) additional five (5) year periods upon the mutual agreement of the Parties.

Such mutual agreement shall take the form of a contract modification as described in Section 10.7 of this RFP.

At the end of the contract, the vendor shall provide all agency data in a form that can be converted to any subsequent system of the agency’s choice. The vendor shall cooperate to this end with the vendor of the agency’s choice, in a timely and efficient manner.

The Commonwealth reserves the right not to exercise any or all renewal options.

The contract holder must request in writing a price increase at least thirty (30) days prior to the effective date, and shall provide firm proof that the price increase(s) is justified. The Office of Procurement Services may request additional information or justification. If the price increase is denied, the contract holder may withdraw from the contract without prejudice upon written notice and approval by the Office of Procurement Services. Provided, however, that the vendor must continue service, at the contract prices, until a new contract can be established (usually within sixty (60) days).

B. Price Decreases: The contract price shall be reduced to reflect any industry wide price decreases. The contract holder is required to furnish the Office of Procurement Services with notice of any price decreases as soon as such decreases are available.

C. Extended Contract Periods: If the contract provides for an optional renewal period, a price adjustment may be granted at the time the contract is renewed, subject to price increase justification as required in Paragraph A “Price Increases” as stated above.

9.4 Notices

After the award of contract, all programmatic communications with regard to day-to-day performance under the contract are to be made to the agency technical contact(s) identified during the negotiation phase of this procurement. 10.8 Changes in Scope

The Commonwealth may, at any time by written order, make changes within the general scope of the contract. No changes in scope are to be conducted except at the approval of the Commonwealth.

If the Commonwealth Buyer determines that deliverables due under the contract are not in conformance with the terms and conditions of the contract and the mutually agreed-upon project plan, the Buyer may request the contractor to deliver assurances in the form of additional contractor resources and to demonstrate that other major schedules will not be affected. The Commonwealth shall determine the quantity and quality of such additional resources and failure to comply may constitute default by the contractor.

10.10 Assignment

The contract shall not be assigned in whole or in part without the prior written consent of the Commonwealth Buyer.
