About this file
This document is Addendum No. 5 for the Town of Granby North Service Area Water Treatment Plant project, prepared by SGM (engineering firm). The addendum modifies various contract documents and provides clarifications for bidders, with key changes including details about temporary construction power from Mountain Parks Electric, Inc. (MPEI), permanent power coordination, and modifications to the RV dump station access during construction. The addendum establishes a new Bid Alternate No. 2 that would allow public access to the existing RV dump station during limited periods of the construction timeline. The bid date is set for December 18, 2024, with the Owner (Town of Granby) expected to execute a Notice of Award within 100 days of the bid opening, by March 28, 2025.
The project is funded through the Colorado State Revolving Fund (SRF) and is classified as a "non-equivalency" project, which means certain federal requirements like Build America-Buy America (BABA) do not apply. The Engineer's estimate for the initial construction contract is $3.4 million, with a total estimated construction contract value of $27.5 million. The project will be bid in two phases: an initial contract for "Early Work" and a future primary Change Order for the remainder of the project scope. Bidders are required to submit a "Suspension and Debarment Certification Form" and must comply with Davis-Bacon Prevailing Wage Requirements. The project includes construction of a new 0.65-MGD drinking water treatment facility, improvements to existing water pumping systems, and approximately 1,400 linear feet of new buried raw water and process residuals pipelines.

7.01 Owner on its own initiative may issue Addenda to clarify, correct, supplement, or change the Bidding Documents.
7.02 Bidder shall submit all questions about the meaning or intent of the Bidding Documents to Engineer in writing. Contact information, submittal procedures and deadlines for questions are contained in the Advertisement for Bid.
7.03 Interpretations or clarifications considered necessary by Engineer in response to such questions will be issued by Addenda posted to the Owner’s Bidding Documents Website as designated in the Advertisement for Bid.
7.04 Only responses set forth in an Addendum will be binding. Oral and other interpretations or clarifications will be without legal effect, including statements made at the pre-bid conference.
Responses to questions are not part of the Contract Documents unless set forth in an Addendum that expressly modifies or supplements the Contract Documents.
ARTICLE 8—BID SECURITY
8.01 A Bid must be accompanied by Bid security made payable to Owner in an amount of five percent (5%) of Bidder’s maximum Total Bid Price for Overall Project as entered in Articles 3.01.C.1 through and 3.021.C.4 in the Bid Form. Bid security shall be in the form of a Bid bond issued by a surety meeting the requirements of Paragraph 6.01 of the General Conditions. Such Bid bond will be issued in the form included in the Bidding Documents.
8.02 The Bid security of the apparent Successful Bidder will be retained until all of the following conditions have been met:
A. The Owner executes and delivers a Notice of Award to the Successful Bidder for the initial Contract within 100 days of the Bid opening date.
B. The Successful Bidder delivers a fully executed Contract and furnishes the required Contract security within 15 days after the date of the Notice of Award.
C. The Owner executes and delivers by June 17, 2025 an executed Change Order to the Successful Bidder (then Contractor) authorizing completion of the overall Project scope at the Bid Price listed on the Bid Form of the accepted Future Primary Change Order Bid item (with any adjustments due to carry-over of unspent Cash Allowances from the initial Contract or as agreed upon by the parties due to changes in the overall Project scope).

D. The Successful Bidder delivers a fully executed version of the Change Order with evidence of the required adjustments in Contract security within 15 days after receipt of said Change Order.
8.03 If the Owner fails to meet its commitments within the corresponding times as listed in 8.02.A or 8.02.C (or alternative times as agreed to in writing by the Successful Bidder and, if required under the terms of the Bid Bond, its Surety), the Successful Bidder’s Bid security will be released.
8.04 If the Successful Bidder fails to meet its commitments within the corresponding times as listed in 8.02.B or 8.02.D (or alternative times as agreed to in writing by the Owner), the Owner may consider Bidder to be in default, annul the Notice of Award or Change Order, and the Bid security of that Bidder will be forfeited, in whole in the case of a penal sum bid bond and to the extent of Owner’s damages in the case of a damages-form bond. Such forfeiture will be Owner’s exclusive remedy if Bidder defaults.
8.05 The Bid security of other Bidders that Owner believes to have a reasonable chance of receiving the award may be retained by Owner until the earlier of 7 days after the Effective Date of the Contract or 101 days after the Bid opening, whereupon Bid security furnished by such Bidders will be released.
8.06 Bid security of other Bidders that Owner believes do not have a reasonable chance of receiving the award will be released within 7 days after the Bid opening.
ARTICLE 9—CONTRACT TIMES
9.01 The number of days within which, or the dates by which, the Work is to be (a) substantially completed and (b) ready for final payment, and (c) Milestones (if any) are to be achieved, are set forth in the Agreement.
9.02 Provisions for liquidated damages, if any, for failure to timely attain a Milestone (if any), Substantial Completion, or completion of the Work in readiness for final payment, are set forth in the Agreement.
ARTICLE 10—SUBSTITUTE AND “OR EQUAL” ITEMS
10.01 The Contract for the Work, as awarded, will be on the basis of materials and equipment specified or described in the Bidding Documents without consideration during the bidding and Contract award process of possible substitute or “or-equal” items. In cases in which the Contract allows the Contractor to request that Engineer authorize the use of a substitute or “or-equal” item of material or equipment, application for such acceptance may not be made to and will not be considered by Engineer until after the Effective Date of the Contract.
10.02 All prices that Bidder sets forth in its Bid will be based on the presumption that the Contractor will furnish the materials and equipment specified or described in the Bidding Documents, as supplemented by Addenda. Any assumptions regarding the possibility of post-Bid approvals of “or-equal” or substitution requests are made at Bidder’s sole risk.
ARTICLE 11—SUBCONTRACTORS, SUPPLIERS, AND OTHERS
11.01 A Bidder must be prepared to retain specific Subcontractors and Suppliers for the performance of the Work if required to do so by the Bidding Documents or in the Specifications. If a prospective
