23073AMLBAML HUBERT SPENCE DRAINAGE (AML) RECLAMATION PROJECT
MARTIN COUNTY, KENTUCKY
Written Location Directions: GPS Location 37° 55’ 0.77”N, 82° 32’ 42.72”W. From the intersection of
US-23 and KY-3 near Prestonsburg: Travel East on KY-3 (Bays Branch Road) 2.6 miles and turn right onto KY-3N. Travel 16 miles and take the ramp (on right) to the intersection with KY-645W. Travel 4.2 miles and turn right onto KY-3411 (Fitch Branch Road). Travel 0.5 miles and turn left onto KY-3 at the intersection. Travel KY-3N 2.1 miles and turn right onto Big Lick Branch Road. Project site is on
Spence Mountain Road (First road on left on Big Lick Branch Road).
Basic Project Description: The Hubert Spence residence is being impacted by drainage from an eligible mine immediately upslope. The Cubert Spence residence is immediately downslope of the Hubert Spence residence with a gabion wall between the residence and Big Lick Branch Road. This wall was recently addressed as part of the Cubert Spence Soil Nails project and this project will remediate issues left after completion of the previous soil nail project. Neighboring residences with drainage addressed under the
Stepp-Webb AML Reclamation Project will require gradework to address settling issues after that project’s completion.
At the Hubert Spence residence, subdrain will be installed between the residence and eligible mine works, 2 portals will be closed with non-wildlife aceessible portal closures and Class II surface ditch will collect drainage. Collected drainage will be routed to the existing installed drains to the north and south of the residence.
At the Cubert Spence residence, a gabion wall will be constructed to support the citizen’s driveway.
Drains installed in the existing gabion wall prior to shotcrete placement will be cut/shortened to prevent issues with passing traffic. The ditch between Big Lick Branch road and the gabion wall will be reconstructed with a 2’ Concrete Swale ditch. Grout that erupted to the surface during soil nail installation will be removed and the yard graded, topsoil placed and revegetated. Shotcrete application resulted in overspray on the metal outbuilding, which will be removed by cleaning or replacement.
Existing gabions at road level previously damaged by an auto accident will be repaired. The top of the gabions subject to shotcrete application will have excess reinforcing steel removed and receive a concrete top treatment. The residential gas line exposed and damaged from the soil nail installation running from the meter at the south end of the gabion walls to the Curtis Spence residence will be replaced and installed under the concrete swale ditch.
At the former Stepp-Webb project properties, the respective yards will be regraded and revegetated after settling around drainage installed as part of the original project and remediation of effects from storage/staging of equipment during the Cubert Spence Soil Nails project. 4” of topsoil for regrading yard areas has been included at the Stepp residence.
Waste generated by construction activities will be transported to an approved waste area approximately
0.2 miles from the project site. The project and waste sites have previously been disturbed by coal mining operations and residential development. Construction disturbances will be kept to a minimum utilizing the approved Best Management practices prior to beginning any major earth disturbance (excluding initial site preparation for access only) until all silt control measures will be installed. These include but are not limited to silt barriers (bales & silt fence). No trees greater than 3” diameter at breast height will need to be cut or removed for completion of the project. All disturbed areas (including waste areas) will be promptly revegetated at the end of construction. Cover crop is also provided in order to provide quick vegetative cover on any disturbed areas that will go undisturbed for at least two weeks, but not be ready for application of permanent revegetation. This project will affect Big Lick Branch stream as waste material will be placed in the floodplain. A valid Stream Construction Permit has been secured.

A. STANDARD DOCUMENTS
The AML Standard Details, Technical Specifications, and Bid Item Descriptions are posted on the
Division’s website at https://eec.ky.gov/Natural-Resources/Mining/Abandoned-Mine-
Lands/Pages/default.aspx
Once on the web page, please click “Contractor Information” tab located on the right side. AML standard technical specification and detail are located under this tab. Contractors are strongly encouraged to review the complete AML website for additional information.
B. ALLOWABLE PRICE LIMIT
Allowable Price Limit (APL) is part of the contract documents and is stated on the Bid Schedule. The
Unit Price (UP) / Lump Sum Price (LS) has a low value defined for each item on the Bid Schedule. Any
Unit Price / Lump Sum Price outside this value may be considered an unbalanced bid and may have to be justified in writing if such bid is deemed the low responsive bid. The CONTRACTOR is also cautioned that other considerations for rejection, notwithstanding the APL, may be enforced (e.g.
total bid price being excessively over the ENGINEER’S ESTIMATE).
C. CONTRACT LENGTH
All work shall be completed within ONE HUNDRED TWENTY (120) calendar days from the effective date of the Award of Contract. Within the bounds of prudent project performance, it shall be the responsibility of the CONTRACTOR to plan and implement construction sequences which follow the intent of these CONTRACT DOCUMENTS, particularly as, reflected in the Drawings and Special
Conditions and to protect any portion of the contract which may be completed before others.
D. CONTRACTOR’S INFORMATION SHEET
The AML CONTRACTOR/SUBCONTRACTOR INFORMATION FORM sheet must be filled out and submitted with the bid. Failure to submit the AML Contractor/SubContractor Information Form sheet with the bid will be the basis for declaring the bid “Non-Responsive”
E. SPECIAL CONDITIONS & PROJECT NOTES
- On occasion, a property owner may require a CONTRACTOR to add them on their General
Liability and/or Automobile Insurance as an “Additional Insured.” AML will inform the
CONTRACTOR when this requirement is being made by the property owner. In these cases, the
CONTRACTOR must submit to AML copies of their certificate of insurance documenting the
“Additional Insured” before they will be allowed to mobilize equipment and forces on to said properties. Any fees, rate increases, or other costs incurred by the CONTRACTOR for this requirement, if any, will be considered incidental to mobilization and as such no compensation will be made by AML. The “Additional Insured” must remain on the CONTRACTOR’s policy(s) for the full length of the contract.
- Subdrain installed as part of this project is modified with 12” dia. HDPE pipe.
COR & BID & BMP 3
- The proposed waste area is within the 100-year floodplain, and a stream construction (floodplain) permit has been obtained. All permit restrictions must be observed and a copy of the permit available at the project site for review.
F. DAVIS BACON SCALE WAGES
The CONTRACTOR and all SUBCONTRACTORS are required to pay scale wages as defined in the contract documents. If all employment categories that may be used have not been listed and specified in the contract document, then the contractor must make his best determination of what the missing wage rate will be. Subsequently after the bid is awarded, the contractor must request the specific rate from the
Department of Labor. AML will not issue change orders for additional compensation if the wage rate determined by DOL is higher than the rate the contractor used to develop his bid. If wage rates are not included for a specific category, AML suggests that the contractor assume the highest operator or laborer wages that are listed when developing his bid.
G. PERMITS & FEES – AML will be responsible for obtaining any permits that are checked below.
(Check all that apply)
☐KYTC Encroachment Permit
☒KY DOW Water Permits
☐USACE Permit
The CONTRACTOR is responsible for all other permits and/or fees necessary to begin the project. The
CONTRACTOR is advised that on occasion, other permits and/or fees may be required by federal, state, and local government(s). Other types of permits and/or fees are not the responsibility of AML and as such, these will be the complete and total responsibility of the CONTRACTOR to obtain. These must be obtained before AML will allow mobilization of equipment and forces on to said properties. All costs associated with other permits or fees will be the responsibility of the CONTRACTOR. Please refer to
“General Provisions” in the AML Technical Specifications.

Erosion and Sediment Control
Best Management Practices (BMP) Plan
January 2017
COR & BID & BMP 23
OVERVIEW
This Best Management Practices (BMP) plan is a guide for Kentucky Division of Abandoned
Mine Lands (DAML) projects. It contains information regarding preventing, reducing and controlling erosion, sediment, and pollutant runoff from Abandoned Mine Land (AML)
Reclamation and Acid Mine Drainage (AMD) Abatement project construction sites. The information in this BMP will aid DAML staff and contractors in selecting, installing, and maintaining erosion prevention and sediment control measures during the different stages of construction. This BMP plan, in accordance with DAML Technical Specifications and Standard
Drawings, is intended to protect Kentucky’s streams from potential water quality impacts resulting from DAML projects.
This general BMP document is to outline the various pollution prevention measures used on
AML Reclamation or AMD Abatement Projects. The primary sources of pollutants are solids mobilized during storm events and precipitants from mineralized mine drainage. Other sources of pollutants include oil/fuel/grease from servicing and operating construction equipment, concrete washout water, sanitary wastes, and trash/debris.
EROSION PREVENTION AND SEDIMENT CONTROL MEASURES
Plans for Reclamation and AMD abatement construction projects will include erosion control measures on the planview sheets when possible, and will depict Disturbed Drainage Areas
(DDAs) and related information. The construction notes and project description may…
