About this file
This Addendum No. 1, issued by the San Bernardino County Department of Public Works on September 3, 2026, modifies the contract specifications for the US Highway 95 widening and intersection improvement project near Needles, California (Work Order H15280, Road No. 405600-010). The project involves widening US 95 southbound for approximately 2,380 feet, adding a southbound left turn pocket at the Havasu Lake Road intersection, constructing an 8-foot paved shoulder, and performing associated striping and appurtenant work over a total project length of 0.450 miles. Sealed proposals are due September 10, 2026, at 10:00 a.m., with a non-mandatory pre-bid meeting conducted via video conference on August 26, 2026, at 11:00 a.m. Questions from bidders must be submitted by 4:00 p.m. on August 28, 2026. The successful bidder must hold a Class A or C12 Contractor's license and maintain it from award through project acceptance. Contractors and all subcontractors, including ready-mix concrete suppliers, must register with the California Department of Industrial Relations prior to proposal submission and maintain registration throughout performance.
The addendum revises the pay items and applicable sections, introduces a Quality Control Program paid as a lump sum with payment distributed as 15 percent for development and approval, 70 percent for weekly inspection reports, and 15 percent for final documentation, and adds comprehensive Fire Prevention Plan requirements including equipment specifications, spark arresters, fire suppression capabilities, and compliance with the Wild Land Fire Danger Rating System. Additional modifications clarify payment structures for pavement repairs, asphaltic concrete materials, thermoplastic traffic striping, and recessed pavement markers. The contract is subject to California prevailing wage requirements under Labor Code section 1773, with contractors required to pay the higher of federal or state prevailing wage rates as specified in the Federal Prevailing Wage Addendum. The project is subject to the California Air Resources Board In-Use Off-Road Diesel-Fueled Fleets Regulation, Build America Buy America Act, Cargo Preference Act, and Iran Contracting Act of 2010 if contract value exceeds $1,000,000. Bidders must submit a proposal guaranty of at least 10 percent of the bid amount, and the successful bidder must furnish Labor and Materials Bond and Faithful Performance Bond, each equal to 100 percent of the contract price. Construction must begin within 15 days after receiving Notice to Proceed.

15. QUESTIONS AND ANSWERS
- Question: Article II of the Agreement makes the Contractor responsible for all loss or damage to the work "until its acceptance by the County," and SP-33 requires the Contractor to carry Course of
Construction / Installation property insurance that includes theft coverage. Please confirm the
Contractor bears the policy deductible, and any loss above the policy limits, for theft of or vandalism to materials and equipment before the County accepts the work.
Answer: Please refer to Section 7-1.06 of the Special Provisions for the insurance coverage information. Also refer to bullet #4 on the Special Provision Sections in this Addendum No.1.
- Question: Mobilization (Item 110000) is a lump-sum bid item, and the Bid Item List has no separate item for site security. Please confirm whether the cost of protecting materials and equipment is to be carried in Mobilization or spread across the other bid items, or whether the County would consider a separate bid item or additive alternate for construction site security.
Answer: Yes, the cost of protecting materials and equipment is to be included in the Mobilization cost.
- Question: Per Specification Section 19-6.02A, it states that during earthwork operations, if the R-value of the exposed subgrade soil comes into question, the exposed soils shall be sampled and tested to verify that the material meets the minimum required R-value. Who is responsible for determining when the R-value of the exposed subgrade soil is considered questionable and requires additional testing?
Once testing is deemed necessary, who is responsible for obtaining the soil samples and performing the required R-value testing?
Answer: County’s Pavement Engineer, Resident Engineer, and/or Materials Consultant will be on site during construction to determine whether a soil sample test is needed and will be performing the testing.
- Question: Please clarify the scope of work included under Bid Item 23, Pavement Full Depth Repair.
Specifically, what work activities are considered incidental to and paid for under this bid item?
Answer: This bid item has been removed and the payment will be separated into various pavement items. Please refer to Section 39-1.04 and Attachment #1 of this Addendum No.1.
- Question: Per California Assembly Bill 2953 will San Bernardino County allow 25% RAP in the asphalt mix on this project?
Answer: Please refer to Section 39-2.02B(11) of the Special Provisions for the allowable RAP.
- Question: The bid item schedule (page P-4) contains 23 items and no item for biological monitoring or environmental compliance. MM BIO-1 requires a pre-construction desert tortoise survey and, if a tortoise or active burrow is found, a qualified biological monitor present throughout construction. MM
BIO-2 requires a nesting bird survey and buffer monitoring. Please confirm whether the Contractor furnishes the qualified biologist for MM BIO-1 and MM BIO-2, or whether the County furnishes that biologist. If the Contractor furnishes, please identify the item under which this work is paid.
Answer: The County Environmental Management Division will be responsible for the biological surveys required under MM BIO-1 and MM BIO-2. Our EMD biological staff routinely conducts these preconstruction surveys, so the Contractor will not need to furnish a separate biologist for this work.
- Question: MM BIO-1 states a qualified biological monitor "shall be present throughout construction activities" only if a tortoise or an active burrow is observed. Please confirm that full-time biological monitoring is not required absent that trigger, and confirm how monitoring is compensated if the trigger occurs after award.
Answer: For MM BIO-1, a preconstruction desert tortoise survey is required prior to initiating ground disturbance. Full-time biological monitoring is not required unless a desert tortoise or active burrow is observed. If either is observed, no work may occur within 500 feet of the burrow and a qualified biological monitor must be present throughout construction activities. Refer to Bid Item 24 Environmental Mitigation
Measures in Attachment #4 of this Addendum No.1. The Contractor will need to coordinate the construction schedule with the County and comply with any buffers, monitoring requirements, or work restrictions identified during the surveys.
- Question: The project lies within USFWS designated critical habitat for desert tortoise. MM BIO-1 does not state a required qualification for the person performing the survey. Please confirm whether the pre-construction desert tortoise survey must be performed by a USFWS-authorized biologist, and whether any project-specific authorization must be in place at bid, at award, or before Notice to Proceed
Answer: County’s Environmental Management Division will coordinate to have desert tortoise survey performed.
- Question: MM BIO-1 does not specify a survey protocol. Please confirm the required survey method, transect spacing, survey area beyond the disturbance limits, and the validity period of the survey before ground disturbance
Answer: Since County EMD staff will be conducting the surveys, the detailed survey methodology will be handled by the qualified County biologist performing the work.
- Question: MM BIO-2 requires the nesting bird survey within 14 days prior to ground disturbance and a buffer of 100 to 300 feet. Please confirm the survey radius beyond the work limits, and confirm whether a new survey is required if ground disturbance slips more than 14 days
Answer: Bird nesting survey will be completed by County. For MM BIO-2, if construction occurs during nesting season, February 1 through August 31, a preconstruction nesting bird survey must be completed within 14 days prior to ground-disturbing activities. If an active nest is identified, the County biologist will determine the appropriate buffer, which may range from 100 to 300 feet, along with any necessary avoidance measures. The Contractor will need to coordinate the construction schedule with the County and comply with any buffers, monitoring requirements, or work restrictions identified during the surveys.
- Question: Section 14-1.01 states the Contractor must comply with permits from the Department of Fish and Game, the State Water Resources Control Board, and the Corps of Engineers "found elsewhere in these special provisions." A full-text review of the Special Provisions locates no such permit. Please confirm whether these permits exist for this project and, if so, issue them by addendum before the bid date.
Answer: No, these permits are not applicable to this project.
- Question: The First Order of Work requires encroachment permits from Caltrans and the Bureau of
Land Management. Please confirm whether the BLM permit carries biological survey, monitoring, or worker-education conditions beyond MM BIO-1 and MM BIO-2, and when those conditions will be made available to bidders.
Answer: No, all biological survey and monitoring will be done by the County, BLM will not involve in any environmental activities.
