About this file

This is an addendum to Request for Proposals No. 2019-103-DML issued by the County for recreational rental equipment concession services at Okeeheelee Park, dated July 12, 2019. The addendum clarifies and modifies the proposal evaluation and negotiation process outlined in the original RFP. Key modifications include revisions to the negotiation procedures, which permit the County to enter negotiations with the highest-ranked respondent following the ranking process, with the ability to progress to subsequent ranked respondents if negotiations fail. The addendum also establishes that the Selected Respondent must open the concession business within thirty days of the Agreement's effective date or risk contract termination. Additionally, the addendum modifies the proposal review process, specifying that the Selection Committee, comprised of representatives from the Property and Real Estate Management Division, Contract Development and Control, and the Parks and Recreation Department, will evaluate all responsive proposals at a public meeting based on evaluation criteria outlined in Section III of the RFP.

The addendum addresses a specific question submitted by Jupiter Outdoor Center regarding financial documentation requirements, noting that the vendor has withdrawn the question and clarifying that financial reporting certifying annual gross revenues is not a contractual requirement under the current concessionaire agreement. Respondents are required to acknowledge receipt of the addendum by signing and returning the acknowledgment page with their proposals, with failure to do so potentially rendering the proposal non-responsive. Poor formatting, documentation, or incomplete information may adversely impact proposal evaluation, though such deficiencies alone are not automatic grounds for rejection without evaluation by the Selection Committee.

Addendum No. 1 to RFP No. 2019-103-DML

Request For Proposals to Provide

Recreational Rental Equipment Concession Services at Okeeheelee Park

July 12, 2019

This Addendum shall be added to and become a part of the RFP and governed by all terms and conditions set forth therein.

A. The following are clarifications, changes, additions and/or deletions to the RFP:

1. Section I, Request for Proposal (RFP) General Information, O. Negotiations of the

RFP is hereby deleted in its entirety and replaced with the following:

O. Negotiations

After the ranking process, the County may elect, on the basis of the initial proposals received, to enter into negotiations for an Agreement with the highest-ranked Respondent

(the “Selected Respondent”). If the County elects to initiate contract negotiations, these negotiations cannot involve changes in the County’s requirements or the Respondent’s proposal which would, by their nature, affect the basis of the competition previously conducted. If the County and the Selected Respondent cannot successfully negotiate an

Agreement, the County may terminate said negotiations and begin negotiations with the next highest-ranked Respondent, who will then be considered the Selected Respondent.

This process may continue until an Agreement has been executed or all Respondents have been rejected. No Respondent shall have any right against the County arising from such negotiations. If the Selected Respondent fails to open its concession business in the

Premises within thirty (30) days after the Effective Date of the Agreement, and County terminates the Agreement as provided for therein, County may, at its sole option, either begin negotiations with the next highest-ranked Respondent who will then be considered the Selected Respondent, or issue a new RFP.

2. Section I, Request for Proposal (RFP) General Information, T. Review of Proposals of the RFP is hereby deleted in its entirety and replaced with the following:

T. Review of Proposals

Each proposal will be reviewed to determine if the proposal is responsive to the RFP. A responsive proposal is one which has been signed and submitted by the specified Proposal

Deadline, and has provided the information required to be submitted with the proposal.

While poor formatting, poor documentation, and/or incomplete or unclear information may not be cause to reject a proposal without evaluation, such substandard submissions may adversely impact the evaluation of your proposal. Respondents who fail to comply with the required and/or desired elements of this RFP do so at their own risk.

Proposals deemed to be non-responsive may be rejected without being evaluated by the

Selection Committee, which shall be comprised of County employees from the Property and Real Estate Management Division, Contract Development and Control, and the Parks and Recreation Department. The Selection Committee will appoint one member of the

Selection Committee as Chairperson of the Selection Committee. The Selection

Committee will evaluate all responses to this RFP that meet the proposal requirements and are deemed responsive. At a public meeting, the Selection Committee members will meet and review and discuss all responsive proposals. After review and discussion, each

Selection Committee Member shall evaluate all proposals based solely on the information submitted with the proposal. Each Selection Committee Member will score each proposal by reviewing each proposal against the evaluation criteria in Section III. Evaluation of

G:\PREM\RFP\2019\Okeeheelee Park Watersports Concession\Addendum\Addendum No. 1. hf app 7-15-2019.docx

Proposals. The scores awarded for all criteria will be totaled, the scores will be tabulated and added to achieve the total points awarded to each proposal. Each Selection Committee

Member shall then rank each proposal based on the total points awarded with the highest point total ranked 1, the next highest ranked 2, etc. The ranking of each proposal by each committee member will be tabulated and then combined with other committee members’ rankings to determine the score for each proposal with the proposal with the most #1 rankings as the “finalist” which the committee will recommend for award of the contract.

B. The County received a question as set forth below and is issuing the following response:

1. Question received from Rick Clegg, Jupiter Outdoor Center:

Question: Please provide 10 years of tax returns or financial statements with balance sheets of the current vendor.

Answer: Jupiter Outdoor Center has withdrawn its question. Financial reporting certifying the annual gross revenues of the concession is not a contractual requirement under the current concessionaire agreement.

NOTE: Please acknowledge receipt of this Addendum No. 1 by signing below and returning this page with your Proposal. Each Addendum to the RFP must be signed by an authorized agent and submitted with the Proposal or the Proposal may be deemed non-responsive.

Acknowledgment:
